I. Plaintiffs Charles E, Yost, Jr, and Sandra J, Yost are individuals residina at 502 Diehl
Road, Mechanicsburll, Cumberland County, Pennsylvania,
2, A complaint for partial custody or visitation was filed on February 7, 1994, Plaintiffs
are the paternalarandparents of the minor child, Jamie Lynn Yost. who is the subject of these
proceedlnlls, The minor child is in the legal and physical custody of M, Robert Shenk and
Melissa Jane Shenk, the maternal grandfather and step-grandmother of the minor child
pursuant 10 Order of Court dated April ~, 1991 In the matter docketed to 2885 Civil 1990,
3. A custody conciliation conference was held on April 14, 1994 before Conciliator
Hubert )(, Ollroy. Defendants M, Robert Shenk, the minor child's grandfather, and Charles
E, Yost III and Stephanie M, Yost, the minor child's parents were not in attendance, The
present whereabouts of Charles E, Yost, III and Stephanie M, Yost are unknown. Defendant
Melissa Jane Shenk appeared pro se,
4, An agreement was not reached and Conciliator Gilroy dictated an order in the
presence of the pIlrties which stated that Plaintiffs would have partial custody of the minor

7, On July I, 1994, Melissa Shenk telephoned Plaintiff's counsel after ~:OO p.m, and
Indicated that Mr, and Mrs, Shenk and Jamie were going away for the weekend and

requested that the visitation schedule he altered, Sne offered to permit Mr, and Mrs. Yost to
see Jamie on July 9. 1994 Instead of July 2, 1994, Mrs, Yost Indicated that this was
satisfactory, A letter was sent to Mr. and Mrs, Shenk by Plaintiff's counsel confirming this

arrangement, This leller is attached to this petition as E~hibit 8, On July~. 1994. Mrs,
Yost telephoned her counsel and indicated that she had forgotten that her family had plans for
July 9, 1994 and asked whether she should call Mr. and Mrs, Shenk to work something out,
If Mr, and Mrs, Shenk were not agreeable to this change, Mrs, Yost Indicated that she would
change her plans and get Jamie as per the original agreement, Mrs, YOlt repeatedly tried to
call Mr, and Mrs, Shenk on July ~, July 6, July 7. and July 8, 1994, Mrs, Yost was finally
able to reach Mrs, Shenk at 10:00 p.m. on July 8, 1994, Mrs, Shenk indicated that there

was no problem with this change and that her family had been away from their home until
July 8, 1994 and that this was the reason Mrs, Yost had trouble reaching Mr, and Mrs,

Shenk. Mr.. Shenk Indicated that .he wal happy that Mrs. Yo.t had called without the
necellhy of the Involvement of a third party and that they should be able to talk about Jamie
without the Interventlon of a third party, Mrs, Shenk then IlCnt a lelter dated July II, 1994 to
Plalntlffs' counllCl Indlcatinll her disapproval of the unreasonable notice lllven by Mn, Yost
that .he would not be able to have Jamie on July 9, 1994 as orlllinally planned, Thll letter II

8, On July 16, 1994, Mrl, Yost went to the Shenk residence to pick up Jamie at 10:00
a,m, for the regularly scheduled visit, No one answered the door and Mrs, YOlt waited for
about ten minutes and approached some of the neighbors to IlCt'I If they knew where Mr, and
MJI. Shenk were, One of the neighbors Indicated that they had not seen the Shenks since
Thursday.
9, The next scheduled visit is July 30, 1994, Mr, and Mn, Yost have arranged a

meetlnll with Dr, Hazel Brown and Dr, Brown will be coming to the Yosts' home and
ob~rve the Yosts with Jamie In their home on July 30, 1994. Dr, Brown will not Issue her
report until she has had this opportunity to meet again with the Yosts and Jamie at the Yosts'
home, Dr, Brown has met once with Mr, and Mrs, Yost and once with Jamie and Mr. and
Mra, Yost. The Initial meeting with Dr. Brown, the Yosts and Jamie took place after two
visits had occurred. Dr, Brown wants to obSl!rve how the visits have progressed,
10. Defendants had no reason to unilaterally suspend visitation on July 16, 1994,

WHEREAS, M. Robert Shenk And Melissa Jane Shenk tiled
an action for oustody of the minor child, Jamie Lynn Yost, against
the child's natural parents, Stephanie M. Yost and Charles E.
Yost, IIII
WHEREAS, a hearing 011 said complaint is scheduled
bafore the Court on July 19, 1990 at 8145 a.mol
WHEREAS, the parties, desiring to act in the belt
interest of the ohild to amicably resolve this matter, do hereby
agree as follows 1
(1) Full legal And physical custody of the child,
Jami~ Lynn Yost, born May 29, 1988 shall be vested in Melilsa
Jane and M. Robert Shenk.
(2) The natural parents, Stephanie M. and Charlel
E. YOlt, III shall be given extensive supervised visitation
with the child al is arranged by mutual COli sent of the parties.

1. Plaintiffs Charles E, Yost, Ir, and Sandra J, Yost are individuals residing at ~02 Diehl
Road, Mechanlcsburg, Cumberland County, Pennsylvania,
2. A complaint for partial custody or visitation was filed on February 7, 1994, Plaintiffs
are the paternal grandparents of the minor child, Jamie Lynn Yost, who is the subject of these .
pl'QCeedlngs, The minor child Is In the legal and physical custody of M, Robert Shenk and
Melissa Jane Shenk, the maternal grandfather and step-grandmother of the minor child
pursuant to Order of Court dated April ~, 1991 In the matter docketed to 288~ Civil 1990,
3. A custody conciliation conference was held on April 14, 1994 before Conciliator
Hubert X, Gilroy. Defendants M. Robert Shenk, the minor child's grandfather, and Charles
E. Yost III and Stephanie M, Yost, the minor child's parents were not in attendance, As of
the time of the conciliation conference, the whereabouts of Charles E, Yost, 1lI and Stephanie
M, Vost were unknown, Defendant MellsSll Jane Shenk appeared pro Sf.
4. An asreement was not reached and Conciliator Gilroy dictated an ()rder in the
presence of the parties which stated that Plaintiffs would have partial custody of the minor
child on alternating Saturdays commencing May 7, 1994 from 10:00 a,m, until ~:OO p,m, A

21, 1994, June 4, 1994 and June 18, 1994,
7, On July I, 1994, Melissa Shenk telephoned Plaintiff's counsel after ~:OO p,m. and
Indicated that Mr, and Mrs, Shenk and Jamie were ioina away for the weekend and
requested that the visitation schedule be altered, She offered to permit Mr. and Mrs, Yost to
see Jamie on July 9, 1994 instead of July 2, 1994, Mrs, Yost indicated that this was
satisfactory, A leller was sent to Mr, and Mn, Shenk by Plaintiff's counsel confirminllthls
arranllement. This letter is attached to this petition as EMhiblt 8, On July ~, 1994, Mrs,
Yost telephoned her counsel and Indicated that she had forgotten that her family had plans for
July 9, 1994 and asked whether she should call Mr, and Mrs, Shenk to work something out.
If Mr, and Mrs, Shenk were not agreeable to Ihls change, Mrs, Yost indicated that she would
chanae her plans and get Jamie as per the orillinal agreement, Mrs, Yost repeatedly tried to
call Mr, and Mrs. Shenk on July ~, July 6, July 7, and July 8, 1994, Mrs. Yost was finally
able to reach Mrs. Shenk at 10:00 p,m. on July 8, 1994, Mrs. Shenk indicated that there
was no problem with this change and that her family had been away from their home until

Shenk, Mrs. Shenk indicated that she WIIS happy that Mu, Yost had called without the

without the Interventi'ln of a third party, Mu, Shenk then sent a letter dated July II, 1994 to
Plaintiffs' C'lunsel indicating her disapproval of the unreallOnable notice given by Mrs, Yost
that she would not be able to have Jamie on July 9, 1994 as originally planned, This letter Is
attached to this petition as Exhibit C,

8, On July 16, 1994, Mrs, Yost went to the Shenk residence to pick up Jamie at 10:00
a.m. for the regUlarly scheduled visit, No one answered the door and Mrs. Yost waited for

about ten minutes and approached some of the neighbors to see If they knew where Mr, and
Mn, Shenk were, One of the neighbors Indicated that they had not seen the Shenks since

9. The next scheduled visit Is July 30, 1994, Mr, and Mu, Yost have arranged a
meeting with Dr. Hazel Brown and Dr. Brown will be coming to the Yosts' h'lme and
observe the Yosts with Jamie In their home on July 30, 1994. Dr. Brown will not issue her

report until she has had this opportunity to meet again with the Yosts and Jamie at the Yost.'
home, Dr. Brown has met once with Mr. and Mu, Yost and once with Jamie and Mr, and
Mrs. Y'lst. The initial meeting with Dr. Brown, the Yosts and Jamie took place after two
visits had occurred, Dr, Brown wanlS to observe how the visits have progressed.
10. Defendants had no reallOn to unilaterally suspend visitation on July 16, 1994,

the plaintiffs' house for visits on special occasions around the holidays, The child has
developed a relationship with the Plaintiffs and their daughter, Jennifer, the child's aunt. The
Plaintiffs have not previously tiled for partial custody or visitation since the defendants, M,
Robert Shenk and Melissa Jane Shenk, and Winnie Grissinger were previously cooperative in
seeing that the child remained a part of plaintiffs' lives, In addition, the plaintiffs have not
previously l1Ied for partial custody or visitation due to problems associated with their son, the
child's father, Since the child's father left the plaintiffs' home more than five months ago
and his current whereabouts are unknown, plaintiffs desire to become better acquainted with

1. Plaintiffs, Charles E. Yost Jr, and Sandra J. Yost, are Individuals residing at 502
Diehl Road, Mechanlcsburg, Cumberland County, Pennsylvania,
2, A Complaint For Partial Custody Or Visitation was tlIed on February 7, 1994,
Plaintiffs are the paternal grandparents of the minor child, Jamie Lynn Yost, age five years,
who is the subject of these proceedings. The minor child Is In the legal and physical custody
of M. Robert Shenk and Melissa Jane Shenk, the maternal grandfather and step-grandmother
of the minor child, pursuant to Order of this Court dated April 5, 1991 In the mailer docketed
to 288~ Civil 1990.
3, A custody conciliation conference was held on April 14, 1994 before Conciliator
Hubert X, Gilroy, Defendants M, Robert Shenk. the minor child's grandfather, and Charlcs
E, Yost III and Stephanie M, Yost, the minor child's parents, were not in allendance. The
present whereabouts of Charles E, Yost III and Stephanie M, Yost are unknown, Defendant
Melissa Jane Shenk appeared pro se.
4, An ailreement was not reached and Conciliator Oilroy dictated an order in the
presence of the parties which stated that Plaintiffs would have partial custody of the minor
child on alternatlnil Saturdays conunenchlil May 7, 1994 from 10:00 a.m, until 5:00 p,m,
The hearhlil on this mailer has not yet beenllCheduled,
5, Defendant Melissa Jane Shenk Indicated that she opposed any partial custody
arranilement with Plaintiffs because she and her husband. Defendant M, Robert Shenk,
planned to l1le petitions to terminate the parental rlilhts of the natural parents, Charles E.
Yost 111 and Stephanie M, Yost, and a petition to adopt the minor child, Jamie Lynn Yost.
6. Defendant Melissa Jane Shenk stated tllat any order ilrantlnillhe paternal ilrandparents
partial custody or visitation riilhts with the minor child would not be beneficial since any
subsequent adoption of the minor child by Defendants would result In the extinction of any
custody riilhts teld by the paternal ilrandparents. On the contrary, 23 Pa, C. S. Section 5314
provides that any partial custody or visitation rlilhts ilranted pursuant to 23 Pa. C, S. Section
5312 are not terminated if the child is subsequently adopted by a stepparent or other
ilrllndparent.
7, It is believed by Plaintiffs that Defendants are planninil to file petitions to terminate
the parental riilhts of the natural parents and for adoption in order to prohibit Plaintiffs from

1 Defendant, Charles E. Yost III, is an adult individual residing at 88 West High Street,

4. Defendant, Stephanie M. Vast (now known as Slephanie Koker), is an adult individual
residing at II~ South SainI Clair Street, Wichita. Kansas.

dockcted to 2885 Civil 1990.
10. A complaint for partial custody or visitation was 11100 in thll above-caplloned malter on
I'chl'uary 7. 1994.
II. A conciliation conference was held on April 14, 1994 and an Interim order was
l'lilcrcd which permitted Plaintiffs to have partial custody of Jamie Lynn Yost on alternating
Suturdays commencing May 7, 1994 from 10:00 a.m, until 5:00 p.m, By order dated May 3,
19<)4, II hearln(! was scheduled for August 15, 1994 and the court reiterated that M, Robert
Shcnk and Melissa Jane Shenk were to have full legal and physical custody of Jamie Lynn

J,l, On July 16, 1994, Sandra Yost weill to the Shenk residence to piCk up Jamie Lynn
Yost at 10:00 a.m. for the regularly schoouloo visit. Jamie Lynn Yost, M. Robert Shenk and
I\ldiS!1I Jane Shenk were not at the residence located at 226 Reno Avenue, New Cumberland,
Pcnnsylvania,
1\. Onluly 18, 1994, a Perillon for Contempt was t1Ioo. A hearing on Ihis pellllon for
(~l)nlempt was acheduled for July 28, 1994.
14. Oil July 19, 1994, a l'etltlon to Modify Temporary CuslOdy/Vlsltatlon was filed by
Mclis~a Janel Shenk. In this petition, Mrs. Shenk indicated that there had been a siBnlflcant
chungc in circumstances and that Mr. and Mrs. Shenk had transferred physical cuslOdy of
Jllmie l.ynn Yost 10 her natural mother, Stephanie Koker, in Wichita, Kansas.
15. An amended petition for contempt was tiled by Plaintiffs on July 22, 1994 which
lllcluded information concerninllthe whereabouts of Jamie Lynn Yosl.
16, A hearinll on the contempl petition was held on July 28, 1994. Melissa Jane Shenk
ndmllled to the court that she and her husband had transferred physical custody of Jamie Lynn
Y051 to her natural mother, Stephanie Koker.
