1, Plaintiff Is Derrick R. C. Miller, an adult Individual. currantly residing at
550 West Penn Street, Carlisle. Cumberland County. Pennsylvania. 17013,
2, Defendant Is Donna K. Rogers, an adulllndlvldual, currently rllsldlng
at 4833 Conestoga Road, Virginia Beach. Virginia, 23462.
3, Defendant seeks custody of the following children: Brandl Kay Miller,
born March 8, 1983, Clyde David Miller, born September 30. 1985 and Damlen Kleth
Miller, born January 12,1990,
The children were not born out of wedlock.
The children had been in the custody of the Father, and and the boys
remain with the Father, The prior Order Is allached and had been modified due to the
Mother being out of the area for several years In connection with her currer'lt husband's
military duties, It has most recently been modified with Brandl relocating to live with her
'mother due to allegations of sexual related crimes against the Father and Involving
Brandl.

Sicily. In December, 1998 Brandl moved to her Mother's home,
The natural mother of the children Is Donna K. Rogers,
She I. merrled to Michael D. Rogers,
The boys' natural fether Is Derrick R. C. Miller, Mr, Miller Is the Idoptlve
father of Brandl.
He Is merrled and has a child to his current wife,
4, The relationship of the Defendant to the children Is thElt of naturel
mother. The Defendant currenlly resides with her husband and Brandl since
December, 1998,
5, The relationship of the Plainllff to the children is that of natural father.

3, This Court has previously entered two Orders In this maller, The first Order of
March 17. 1994. granted shared legal and physical cllstody of the Children to the parties and
primary physical custody to Father, Subsequently. In an Order dated June 10,1994, physical
custody was awarded to Father, Sllbsequently. the parties have Informally altered the Order
In practice, In part because of Mother's temporary relocation ,to Sicily with her husband,
4, Mother's position on custody is as follows: Mother claims that Father has
Interfered with her attempts to have periods of partial custody subsequent to her return from
Sicily, Shfl presently has sole custody of her daughter, Brandi K. Miller, since approximately
December of 199B, Brandl Is In the care of her Mottler in large part due to present criminal
charges brought agalnslFather Involving a felony and four misdemeanors for sexual offenses
against Brandi. Mother feels It Is also In the best Interest of her sons to be In her primary
custody, She has expressed concern that Father does not support and at times will not permit
her to have periods of partial custody, She has also expressed concern that Father will
Involve the boys In defending him against the above.mentloned criminal charges, She Is
recently concerned about the level of adult supervision at home and the values being taught
by the Father,
5, Father's position on custody Is as follows: Father claims that Mother has had no
periods of custody since July of 1999, He claims this Is because the boys do not want to be

shall have physical custody of the minor children

Father shall enjoy physical custody of the minor
chJ.ldren when the children are not with the Moth.r.

3 Derrick Rob~rt-Clide Miller, The defendant is present with
4 privately-retained counsel, Hubert Gilroy, Esquire,
5 Pursuant to a negotiated plea, the defendant
6 will be pleading to Count 3, Corruption of Minors, graded
7 as a misdemeanor of the third degree, in full satisfaction
8 of all charges at 00-1939.
9 The facts to support this plea are up until
10 May of 1995, when the victim, Brandy Miller, was the age of
11 twelve, the defendant, as her adopted father, did engage in
12 acts that would corrupt or tend to corrupt the morals of
13 Brandy Miller, Brandy was under the age of eighteen, And
14 the defendant was above the age of eighteen,
15 During that time period, while in Cumberland
16 County, while in the defendant and the victim's home, the
17 defendant did give the victim what they call, quote,
18 unquote, tittie twisters. He did touch the victim's
19 breasts, He also left suck marks on the victim's face,
20 And while the victim would be taking a shower, he would
21 open the shower door and throw cold water on the victim,
22 Your Honor, pursuant to this plea also the
23 Commonwealth and defense counsel are recommending a period
24 of unsupervised probation, 8S a misdemeanor of the third
25 degree, the standard range is RS to RIP. I believe the

maximum period at probation i. one year,

would like tho record to refloct that we did meet with Your

8 proceeding. before Judge Ouido. Mr, Miller withdrew hi.
9 plea before Judge Guido this morning,
10 THE COURT, And I undentand that U part of
11 that that Judge Ouido then authorized this matter to go to
12 another judge?
13 MR, GILROY: That I s correct, Your Honor,
14 And I had adviaed his office this morning that it would be
15 coming across the hall to this courtroom,
1~ Judge, on the factual basis of the plea, Mr.
17 Miller has indicated a willingness to acknowledge that, in
18 fact, Your Honor, even before charges were filed during 11
19 criminal investigation that was being done by investigator8
20 of the Pennsylvania State Police, where Mr. Miller was
21 employed, He did in fact admit those exact circumstanoo8
22 during that time. And he is hsre today entering a plea
23 aoknowledging that although he intended no harm. In
24 reflection he acknowledges that these types of acts tended
25 and could recklessly or potentially tend to corrupt a

3 I And AI the District Attorney has indicated,
3 we are here today with the understanding thAt the court
4 will accept this plea and will Accept the recommendation ot
5 the Commonwealth, that Mr, Miller receive a sentence ot
6 unsupervised probation tor ft period ot one year, And I
7 would also like to relate to the court in your
B consideratio~ tor this plea that the child ot Mr, Miller's
9 that was the subject ot this incident is no longer in the
10 home, She has been out ot the home for approximately two
11 years.
12 That Mr. Miller himself notified Children's
13 Services with respect to these charges. And Children's
14 Services declined to investigate or take any action
15 whatsoever, And that he continues with his wife, who is
16 here in the courtroom, He continues to remain in
17 Cumberland County with hie child of his current wife and
18 two children of his former spouse, And he continues to
19 remain employed, He has always cooperated, and we believe
20 under all of the circumstances, Your Honor, that he has
21 admitted and prepared to enter a plea, and that the plea
22 disposition as proposed is fair And reasonable,

24 assuming from thil that the District Attorney is spe.king
25 for the victim in this case

services In first grade at Bellalre Elementary. With cognitive ability estimates In the low averaQe rang.
and current achievement scores consistently much lower, Damlen continues to be eligible for special
education Intervention.
Presently Damlen receives direct Instruction outside the general education selling for reading, math,
spelling and English, A detailed description of his current educational level of performance In these
areas Is provided by his teacher within this rttport under Section IIR.
In summary, Damien's strongest acadllmlc area Is math. He completes and returns homework
asslgnmente and Is Interested In his social studies class. He has a keen understanding of how things
work and enjoys hands on activities. He learns bsst with this approach to learning.
Damlen's needs are primarily In the area of reading. He has consistently struggled with reading and
has been offc"ed a variety of teaching lechnlqulls In this area but success has been difficult 10 achieve,
Assignments, tests, quizzes and Instructional materials have been adapted and modified, Any reading
aaslgnment or reading portion of any subject aeslgnment requires adult assistance,

a tea~her usually one to one for a total 1 hours per week for 6 to 8 weeks
of tutorlnaln a spedn~ subject. There are no new objectives worked on
durlna this time. The obje~tlve of this proaram Is helplna the student
retain what he Ishe has learned this year. Therefore, when the student
aoes back to school, the 6.8 weeks of review at the bealnnlna of the year
Is sumdent and the student Is ready to learn new material after that 6.8

money other than transportlna the student to and from the site where
ESV will be held.
Damlen's placement for the school year 1001.2001 will be
discussed at his next IEP medina. The next mp meetlna will be held
sometime within the next month and half. He does qualify to have
replll~ement currl~ulum at the middle s~hool beuuse of how low his
readlna level Is.
Replacement curriculum Is where Oamlen will have all his subjects with
learnlna support tea~her8. This means he will be with a learnlna
support tea~her for English, spelllna, math, readlna, soda I studies,
sclen~e and nealth. The social studies, sdence and health have more
hands on activities. less readlna Involved and objectives written In the
IEP. He will stili have the opportunity to be In dubs and other activities
like any other 6tb arader. I have suggested to Fiona at the last IEP
meetlna to go look at the proaram at Wilson Middle S~hool before we
hold the next IEP.

behaviors and no medication Is taken regularly, Developmental milestones
were normal.
Damlen lives with his father and two slhllngs who are In sixth and
fourth grade, His older sister has SOllie difficulties In math while his fourth
grade brother has been Identified with attcntlonal deficit problems,
When Bsked to provide a statement about Dmnlen Dad writes the
following: "Overall a good kid, Only likes to do what he wants. when he
wants, Cannot always get his shoes on the right feet but docs not care If they
are. Sometimes he does not make It to the hathroom In the middle of the
night. That docs not hanpen very often or for about three months,"
It Is understood that Damlen's family has llloved into the Carlisle
School District. This Information therefore will be processed there In
regard to determining If special services would be appropriate,

thing about it Is "toys" and the worst thing ahout It Is "having to do

him, It was also observed that during testing when Pumlcn was asked to
write his first name he could not. do so,
Intellec~ual functioning as measured by the Wechsler Intelligence
Scale for Chlldren.lII yielded a full scale IQ of 81, A verbal score of 88 and
performance score of 77 round out the Intellectual profile, When compared
to others of his age group his overall al:1l1l1les exceeded 10% of those tested,
In looking at tile overall subtest configuration all but two subtests fell
at scaled score 7 or below, thus showing a general flattening Into the lower
limits of the average range, He was able to come up with good solutions to
practical problems and his vocabulary development was satisfactory, All
other Intellectual areas were seen as generally deficient. He Is a concrete
thinker and wl1l find anything dealing wlth abstractions or Ideas quite
difficult. He wl1l still have to flrst be presented with something that he can
feel, touch, handle and manipulate before one would dare move on to
something less tangible, Totally falling Into the deficient area were his
memory processes, His long-term as well as short-term auditory memory
were very weak, It Is unknown If this memory deficit Is the result of
Inattentiveness or memory problems themselves, The fact that It Is In
concert with other basic limitations would suggest that this Is a general
dulling of the Intellect and may not respond significantly to treatment for
attentlonal problems,
The performance section was uniformly dcpressed, His sensitivity to
environmental detail, his vlsualmcmory, sequencing, and visual perceptual
motor Integration skl1ls were all seen at the lower limits of the average
rangc and dipped Into the below.average range,
Damlen's figure reproduction Is typical of a youngster who Is beginning
kindergarten rather than one going Into first grade, There was no body. and
the arms, ears, and legs ~1I emanated from Ihe head, He did have eyes,
nose, and mouth and sor[e hair,
The Bender Gestalt Test was administered using the Koppltz scoring
system, A score of 11 represented an average visual perceptual motor age of
about 5-1/2 rears, This places Damlen about one year behind his present
chronologlca age,
Academic achievement levels as meAsurcd by the Woodcock.Johnson,
Psycho-Educational Battery reflected severe defiCiency when compared to
othcrs of his age and placement In grade, St.andard scores or 56 and 57
were noted In word recognition skills, Here he was unable to recognize an

all major non.emergency decisions affecting the Children's general well-
being Including, but not limited to, all, decisions regarding their health,
education and religion, Pursuant to the terms of this paragraph, each
parent shall be entitled to all records and information pertaining to the
Children Including, but not limited to, school and medical records and
Information, To the extent one parent has possession of any such
records or Information, that parent shall be required to share the same, or
copies thereof, with the other parent within such reasonable time as to

In practice, In part because of Mother's temporary relocation to Sicily with her husband,
4, Mother's position on custody is as follows: Mother claims that Father has
interfered with her attempts to have periods cf partial custody subsequent to her return from
Sicily. She presently has sole custody of her daughter, Brandl K. Miller, since approximately
December of 1996, Brandl Is in the care of her Mother in large part due to present criminal
charges brought against Father Involving a felony and four misdemeanors for sexual offenses
against Brandl. Mother feels It Is also In the best Interest of her sons to be in her primary
custody, She has expressed concern that Father does not support and at times will not permit
her to have periods of partial custody, She has also expressed concern that Father will
Involve the boys in defending him against the above,mentloned criminal charges, She Is
recently concerned about the level of adult supervision at home and the values being taught
by the Father,
5. Father's position on custody Is as follows: Father claims that Mother has had no
periods of custody since July of 1999, He claims this is because the boys do not want to be

with her, He denies that she calls the boys and states that he leaves the decision up to the
boys whether or not they spend time with their Mother, Father's counsel would not allow him
to anawer any questlolls with regard to the pending criminal charges, It Is p06lllble that the
criminal matter may go to trial In January of 2001, A writ of habeus corpus has been flied
which will be heard on or about December 8, 2000.
5. The Conciliator met with the parties and counsel and was able to negotiate an
Interli,n Order pending a hearing, The Conciliator recommends an Order In the form as
attRched which will also schedule a hearing In this motter, It Is expected t,hat the hearing will
require one-half day,
