1. The Plaintiff., I(athryn L. Marks and John A. Marks, are
adult individuale reaiding at 417 West Market Street,
Williametown, Dauphin County, Penn8ylvania 17098.
2. The Defendant, Bargain Brakes and Mufflera, Inc., is a
Penneylvania corporation in good 8tanding and doing bueiness at
3 East Shady Lane, Enola, Cumberland County, Pennaylvania 17025.
3. The factI and occurrence a hereinafter set forth
occurred on or about August 3, 1993, at approximately 2100 p.m.,
at or about the facility of the Defendant located at 3 East
Shady Lane, Enola, cumberland county, Pennsylvania 17025.

4. At all times relevant to the Plaintiffs' cause of
aQtion, the aforeaaid facility waa under the direct supervision
and Qontrol of the Defendant.
e. At the atore8aid time and place, a 1991 Ford Ranger,
owned by Michael I(elly, waa repaired by an employee of the
Defendant, Bargain Brakes and MUffler, Inc.
6. At the atoresaid time and place. the employee who
repaired Mr. Kelly'8 motor vehicle was acting within the courae
and scope of his employment with the Defendant and/or on behalf
of said Defendant as an employee, aqent, servant. and/or
representative of the Defendant, Bargain Brakes and MUffler.,
Inc.
7. At the aforesaid time and place, Mr. Kelly was leaving
the Defendant's facility when the left front tire of his Ford
Ranger cam~ off and rolled away from hi8 motor vehicle.
8. At the aforesaid time and place. the Plaintiff, ~athryn
L. Harks, was standing be8ide her motor vehicle in front of the
~-Mart store in the Summerdale Plaza, when suddenly, without
warning, she was atruck on the right leg by the left front tire
that had rolled away from Mr. Kelly's Ford Ranger, thereby
knocking her to the ground caUsing severe and permanent injury.
