I, MABEL D. FLUCK, of the Borough of Somerset, Somerset
County, Pennsylvania, declare this to be my Last Will and revoke any
Will previously made by me.
1. I direct that all my just debts and funeral expenses,
including my gravemarker and all expenses of my last illness, shall
be paid from my residuary estate as soon as practicable after my
decease as .a part of the expense of the administration of my estate.
2. I devise and bequeath all of my estate of every nature
to my husband, HENRY K. FLUCK, provided he shall survive 'me by
thirty (30) days.
3. Should my husband, HENRY K. FLUCK, predecease me or
die on or before the thirtieth (30th) day following my death, I
.devise and bequeath all of my estate of every nature and wherever
situate in equal shares to such of my children, CAROLE ANN FATZINGER
.and HENRY K. FLUCK, as survive me by thirty (30) days.
4. Should my daughter, CAROLE ANN FATZINGER, or my son,
HENRY K. FLUCK, predecease me or die on or before the thirtieth
(30th) day following my death, I devise and bequeath the Ihare of

first (31st) day following my death; and should either my said

S. The beneficiaries under this Will may take their share
in kind or partly in cash and partly in kind or in such manner as
they may mutually determine, The executor shall have a professional
appraiser fix the valuations of the in kind assets us needed. In
case of disagreement among the beneficiaries of thIs Will, the exec-
utor is authorized to make the division having due regard for each
beneficiary's preference and making the in kind personal property
distributions as equal as possible.
6. I appoint CAROLE ANN FATZINGER, my daughter, guardian
of any property which passes either under this Will or othorwise to
a minor and with respect to which I am authorized to appoint a guar-
dian and have not otherwise specificallr done so, provided that this
appointment of a guardian shall not supersede the right of any fidu-
ciary in its discretion to distribute a share where possible to a
minor or to another for the minor's benefit. Such guardian shall
have the power to use principal as well as income from time to time
for the minor's support and education (inCluding trade school and
college education, both graduate and undergraduate) without regard
to his or her parent's ability to provide for such support and
education or to make payment for these purposes, without further
responsibility, to the minor or to the minor's parent or to any
person taking care of the minor.

7. No fiduciary under this Will shall be requirod to give
bond or other security for the faithful performance of the fidu-
ciary'~ duties.
8. Any such fiduciary shall have the following powers, in
addition to those given by law:
To invest in, accept and retain any real or
personal property, including stock of a corporate
fiduciary or its hOlding company, without restriction
to legal investments;
To sell, exchange, partition or leaso for any
period of time any rual or pursonal property and to
give options therufor for cash or crudit, with or
without security;
To borrow money from any person including any
fiduciary acting hereunder, and to mortgage or pledge
any real or personal property;
To hold shares of stock or other securities in
nominee registration form, including that of a
clearing corporation or depository, or in book entry
form or unregistered or in such other form as will
pass by delivery;
To engage in litigation and compromise,
arbitrate or abandon claims;
To make distributions in cash, or in kind at
current values, or partly in each, allocating
specific assets to particular distributees on a
non-pro rata basis, and for such purposes to make
reasonable determinations of current values; and
To make elections, decisions, conces&ions and
settlements in connection with all income, estate,
inheritance, gift or other tax returns and the
payment of such taxes, without obligation to adjust
the distributive share of income or principal of any
person affected thereby.
9. I direct that all taxes that may be assessed in con-
sequence of my death, of whatever nature and by whatever jurisdic-
tion imposed, shall be paid from my residuary estate as a part of
the expense of tho administration of my estate.
