5. The relationahip of the Defendant to the child is that
of Father. The Defendant currently residea with the following
personal No one,
6. Plaintiff haa not participated as a party or witneos, or
in another capacity, in other l.itigation concerning the custody
of the child in thia or another court.
Plaintiff has no information of a custody proceeding
concerning the child pending in a court of thia Commonwealth,
Plaintiff doea not know of a person not a party to the
proce~dings who has physical custody of the child or claims to
have custody or visitation right a with respect to the child.
7. The best interest and permanent welfare of the child
will be served by granting the relief requested for the following
reasonsl
A. Plaintiff has undertaken and performed the primary
parental responsibilities for the child, and
B. Plaintiff ia best able to provide the care and
nurture which th\! child noeds for hoalthy development I and
C. A Court Order of custody and atructured viBitation
is desired ao that Plaintiff and the child may plan their
sohedules accordingly, and so that misunderstandingB and
unmet expectations regarding cuatody and visitation can be
avoided, and also ao that the child ia not used in a
manipulative fashion.
D. Defendant ia erratic and his abuaive behavior poses
a threat of harm to the childl and
E. Defendant frequently abuses alcohol and is
therefore unreliable aa cuatody of the child I and
F. Although Plaintiff haa encouraged the Defendant's
contaot with the chJ.ld, that contact haa been very Bporadic
and Plaintiff needs to know when Defendant ia going to see
the ohild ao that Plaintiff can plan thooe perioda of
visitation and/or partial custody and so that the child does
not have unmet expectations in that regard, and
G. In the recent past, Defendant haa becol,ie very
abuaive verbally toward Plaintiff in the presence of the
child, has threatened to harm himself and Plaintiff, and has
eVftn threatened to take the child and disappear with her,
H. Becauae of the recent conduct of Defendant,
Plaintiff believes that for the immediate future any
visitation or partial custody should be structured in such a
manner as to avoid possible violence, abusive conduct,
