AND NOW comes the Petitioner, Stephen T. Benjey, by and
through his attorney, Jeanne' Bereznicki, ESQuire, and respectfully
represents as follows in support of this Petition I
1. PetiUoner reeides at 1871 Holly Pike, Carlisle,
Cumberland County, carlisle, Pennsylvania 17013,
2. peU tioner is duly licensed by the Department of
Transportation to operate a motor vehicle under Operator's Lioense
No. 21-460-634,
3. In a J.etter dated January 06, 1994, Petitioner was
notified by the Department that his driver'lI lioense privileges
would be suspended for a period of one (1) yeer for a ohemical test
refusal pursuant to Section 1547 of the Motor Vehicle Code. A
copy of the letter is appended to this appeal.
4, This violation arises from Petitioner being stopped by
Carlisle Polioe in Deoember of 1993, for suspioic)n of driving under
the influenoe of alcohol.

5. Petitioner did not make a knowinw, voluntary, and
intelligent deoieion in regard to taking a B.A.C, teat beoauae he
waa not properly advised' of the harsh oon8.~uenoes following a
refuaal to 8ubjeot him.elf to such te8ting.
