BRENDA L. DARHOWER,
Defendant
: NO, 471 CIVIL 1994
PETIT.O!'; TO WITHDRAW
Pursuant to Penmylvanla Rules of Professional Gonduct 'II 1,16(b)14) and 1,16Ib)(5),
the family Law Clinic, attorneys of record for the Defendant, Brenda L, Darhower, hereby
petitions the Court for leave to withdraw. In the above-captioned maller, and in support
thereof, avers as follows:
1, The Family Law Clinic entered Its appearance in the first of two child l~ustody
actions brought by the above indicated parties, docketed as 3627 CIVIL 1990 on behalf of
the Defendant, Brenda L, Darhower, on October 16, 1990.
2, The parties reconciled, yet the me remained open until March 15, 1991, and
was finally closed by the Prothonotary due to inactivity,
"
3, The present action, the second child custody action involving the above-
captioned parties, was commenced by the Plaintiff against the Defendant on February 23,
i" '
1994.
4, Upon the request of the Defendant, the Family Law Clinic entered its
appeirance as counsel of recclrd representing the Defendant in this mailer on June I, 1994,
.
$, A custudy conciliation wa~ scheduled on June '7, 1994; since an allreement was
not rellChed, a cusllldy hearhl11 was scheduled, Within a short period foliowinllthat
conciliation, the Defendant became unresponsive tl) the Family Law Clinic's numerous
attempts 10 contact her by the telephone, Further, on July 7, 1994, the Defendant asked the
Domestic Relations Ofl1ce to terminate her child and spousal support payments,
6, On July 22, 1994 and allaln on July 26, 1994. Ihe Family Law Clinic sent a
letter to Ihe Defendant asking her to conlact the Family Law Cilnic,
7, By letter dated AUllust 4, 1994, II ~tudent attorney with the Family Law Clinic;
advised Ihe Defendant Ihat If she does nOltelephone or otherwise contact the Family Law
Clinic. the Family LlIW Clinic would petitionlhe Court to withdraw In this matter, The
Defendant did not contact the Clinic,
8, For the aforementloncd reasons, It Is cvldentthat the client has failed
substantially to fulfill an obligation to her legal represeJllatlve regarding the lellal services
and has been jlven a reasonable warning that the lawyer will seek to withdraw unless the
obligation Is fulfiiled, constituting a basis for permissive withdrawal as set forth In the
Pennsylvania Rules 01' Professional Conduct I 1,16(b)(4), Further, the Defendant's actions,
continuing failure to respond to reasonable requests to contact the Family Law Clinic, and
her refusal to otherwise communicate with her legal represeJllative has rendered her
representation by the Family Law Clinic to be unreasonably dlft1cult and unduly burdensome,
also constituting a basis for pennlssive withdrawal as set forth In the Pennsylvania Rules of
Professional Conduct I 1.16(b)($),
WHEREFORE, lhe PlIIlIily Law Clinic requesls thaI Ihls honorable COUl'l IIranls its

I, The father lives alone in a 3-bedroom aplI'tment In Carlisle. He h the .anager of
tb. Carlisll Electronic. Store and works three days s week (Honday, Thurlday, and
frlday) from 9100 a.m. until 9100 p.m. and then from 9100 a.m. until ~:OO p.M. evtry
Tu..day and Wedntsday and every other Saturday.
The mother lives in a 3-bedroom apartment in Carlisle with her daughter, Nicole
Madison, age 14, who i. also the stepsister of the child which I. tht .ubjtct of tbil

I! The parties, each with the advice of counuel, worked out a custody arungemtnt

The rather initially wanted to change the order to correct the probleM he eees in
not having the child for five days in a row. At the conference, however, he de.anded

Frankly, I belilve his .0tivI in bringing the child cUltody aclion i. to fo~c. h.r back

The mother had a very logical explanation al lo what happlned at the ti.e of

which took aboul two weekl, Ihe lought and hal had at lealt Ihared custOdY of the

The fatber made Beveral atatementl at tbe conference whicb demonltrated tbat hi.
Motivl' in thi. action were More to punilh or recapl~re the Motbl~ tban to Make a
better home for the child. He does appear to be vary angry and ~ery jUdg.ental. The
court, will, of courle, reacb itl own conclusions, but the mothar appeared to be a far
More capable anu reasonable perlon than the father in their brilf appearance before .e.
I Ixpect thil cale may well take a full day to hear. I have attached an order
Icheduling a hearing and requiring the disclolure of witnellel.
