I, EDNA M. STARNER, of Lower Allen Township, Cumberland
County, Pennsylvania, make, publish and declare this as and for my
Last Will and Testaloent, hereby revoking all other Wills and
Codicils heretofore made by me.
E~: I give and bequeath my household furniture and
furnishings, my personal effects, jewelry, clothing, automobiles
and all other tangible personal property, inclUding all insurance
policies covering those items, to my children who survive me, to
be divided between or among them equally as they may agree.
SECOND: I devise and bequeath all the rest, residue and
remainder of my estate of whatever nature and wherever situate,
together with any insurance policies thereon, unto my children,
MYRA E. SPAHR, LOUELLA M. REYNOLDS, BARBARA J. DUNCAN, CAROL A.
HARTMAN, CARL E. STARNER and SUSAN K. HERMAN, in equal shares.
Should any of my children predecease me, I direct that their share
under this, my Last Will and Testament, be divided among or
between my surviving children.
THIRD: In addition to all powers granted to them by law
and by other provisions of this Will, I give the fiduciaries
acting hereunder the following powers, applicable to all property,
exercisable without court approval and effective until actual
distribution of all property:
(A) To sell at pUblic or private sale, or to lease, for
any period of time, any real or personal property and to give
~ options for sales, exchanges or leases, for such prices and upon

such terms (including credit, with or without security) or
, conditions as are deemed proper.

This includes the power to give
legally sufficient instruments for transfer of the property and to

receive the proceeds of any disposition of it.

To partition, subdivide, or improve real estate and
to enter into agreements concerning the partition, subdivision,
improvement, zoning or management of real estate and to impose or
extinguish restrictions on real estate.
(C) To compromise any claim or controversy and to
abandon any property which is of little or no value.
(D) To invest in all forms of property, including
stocks, common trust funds and mortgage investment funds, without
restriction to investments authorized for Pennsylvania fiduci-
aries, as are deemed proper, without regard to any principle of
diversification, risk or productivity.
(E) To exercise any option, right or pdvilege granted
in insurance policies or in other investments.
(F) To exercise any election or privilege given by the
Federal and other tax laws, including, but not necessarily being
limited to, personal income, gift and estate or inheritance tax
laws.
(G) To make distributions to my herein named benefici-
aries in cash or in kind or partly in 9ach.
(H) To borrow money from themselves or others in order
to pay debts, taxes, or estate or trust administration expenses,
to protect or improve any property held under my will, and for
investment purposes.
(I) To select a mode of payment under any qualified

retirement plan (pension plan, profit sharing plan, employee stock
ownership plan, or any other type of qualified plan) to the extent
the plan or the law permits them to do so, and to exercise any
other rights which they may have under the plan, in whatever
manner they consider advisable.

WHEREAS, the said Edna M. Starner by her Last Will and Testament,
duly proved and recorded in the Cumberland County Register of
wills Office, Pennsylvania, in Docket Book 1994-00093, Letters
Testamentary being issued on February 4, 1994, provided, in
pertinent part, as follows:
THIRD: In addition to all powers granted to them by law and
by other provisions of this Will, I give the fiduciaries acting
hereunder the following powers, applicable to all property,
exercisable without court approval and effective until actual
distribution of all property:
(A) To sell at public or private sale, or to lease, for any
period of time, any real or. personal property and to give options
for sales, exchanges or leases, for such prices and upon such
terms (including credit, with or without security) or conditions
as are deemed proper. This includes the power to give legally
sufficient instruments for transfer of the property and to
receive the proceeds of any disposition of it...
I1Illil I nominate and appoint my daughter, MYRA E. SPAHR
and SUSAN K. liERMAN, or the survivor thereof, Co-Executrixes of
this, my Last Will and Testament. I direct that my Co-
Executrixes or. Executrix, as the case may be, and their
successor.s shall not be required to post security or a bond for
the performance of their duties in any juriSdiction.

NOW THIS INDENTURB WITNESSETH, that the said parties of the first
part, by virtue of the power and authority aforesaid, in said
Will contained, and in consideration of the sum of Forty Thousand
Dollars ($40,000.00) to them paid by the said parties of the
second part, at and before the ensealing and delivery of these
presents, the receipt whereof is hereby acknowledged, have
granted, bargained, sold and conveyed, and do hereby grant,
bargain, sell and convey to the said parties of the second part,
their heirs and assigns forever:
ALL THAT CERTAIN piece or parcel of land situate in the Township
of Lower Allen, Cumberland County, Pennsylvania, bounded and
described as follows, to wit:
BEGINNING at a point in the public road known as the Slate Hill
Road which point is at the northwestern line of lands now or
formerly of William strongl thence along the same South 59
degrees 47 minutes West, one hundred eighty-seven and sixty-eight
one-hundredths (187.68) feet to a point at line of lands now or
formerly of Nathaniel Moore and Eleanor R. Moore, his wife;
thence along the same, North 20 degrees 55 minutes West, forty-
four and twelve one-hundredths (44.12) feet to a point, thence
along lands now or formerly of Nathaniel Moore and Eleanor R.
Moore, his wife, North 51 degrees 53 minutes East, one hundred
seventy and two one-hundredths (170.02) feet to a point in the
Slate Hill Road; thence along the same, South 40 degrees 30
minutes East, sixty-eight and one one-hundredths (68.01) feet to
the point of BEGINNING.
HAVING THEREON erected a dwelling house known as and numbered
1600 Sheepford Road, Mechanicsburg, PA 17055.
BEING the same premises which Nathaniel Moore and Eleanor R.
Moore, his wife, by deed dated October 28, 1960 and recorded
September 20, 1965 in the Cumberland County Recorder of Deeds
Office in Deed Book "S", Volume 21, Page 975, granted and
conveyed unto Paul Richard Starner and Edna M. Starner, his wife.
The said Paul Richard starner died February 21, 1975, title to
the above described real estate remained vested by operation of
law solely in his surviving spouse, Edna M. Starner, the Decedent
herein.

TOGETHER with all and singular the rights, liberties, privileges,
heraditaments anu appurtenances whatsoever thereunto belonging or
in anywise appertaining, and the reversions and remainders,
rents, issues and profits thereof, and all the estate, right,
title, interest, property, claim and demand whatsoever of the
said Edna M. starner at and imnlediately before the time of Edna
M. starner's decease, in law or equity or otherwise howsoever,
of, in, to or out of the same:
TO HAVE AND TO HOLD the said granted premises t,o the sa id parties
of the second part, their heirs and assigns forever.
AND the said parties of the first part, do covenant, promise,
grant and agr~e, to and with the said parties of the second part,
their heirs and assigns, by these presents, that the said parties
of the first part, have not done, committed, or knowingly or
willingly suffered to be done, any act, matter or thing what-
soever, whereby the premises aforesaid, or any part thereof, is,
are, shall or may be charged or incumbered, in title, charge or
estate, or otherwise howsoever.
