1. Plaintiff, CITICORP MORTGAGE, INC., is a servicing
company with an office at p, O. Box 790014 MR 314, st. Louis,
Missouri 63179-0014.
2. Defendants, William S. curtis and Kathleen A. curtis, are
adult individuale whose last known residence is 7 Graham Road,
Newville, PA 17241-9560 and/or 223 coventry Rd., York, PA 17402
and/or 13 Baben Road, Hudson, Massachusetts 01749-3102.
3. On or about May 7, 1990, Defendants executed and delivered
a Mortgage Note in the sum of $110,350.00 payable to Sears Mortgage
corporation, (original mortgagee), a copy of silid Note is attached
hereto and marked Exhibit "A".
4. Contemporaneously with and at the time of the execution of
the aforesaid Mortgage Note, in order to secure payment of the same,
Defendants made, executed and delivered to the original Mortgagee, a
certain real estate Mortgage which is rocorded in the within
Commonwealth and county in the Office of the Rocorder of Deeds in
Mortgage Book 975, Page 1150, convoying to the original Mortgagee the
real estate described therein. 'l'he mortgage was assigned to citicorp
Mortgage, Inc., as recorded in the within county on May 23, 1990,
recorded in Book 393, Page 101B.
The Mortgilqo and Assignments are

6. Defendants are tho real ownero of tho land subject to the
Mortgage.
7. The Mortgage is in default due to the fact that Mortgagors
have failed to pay the installmont due on April 1, 1993 and all
subsequent inotallments thoreon, and the following amounts are due on
the Mortgage:
(a) Unpaid principal balanco $ 108,499.38
(b) Interest at $29.7259 por day
from 3/1/93 to 2/1/94
(based on contract rate of 10.00%) 10,017.63
(c) Accumulated Late charges
759.56
(d) Escrow Deficit
(e) 5% Attorney's commission

reinstated prior to the sale, reasonable attorney's fees will be
charged that are actually incurred by Plaintiff.
8. No Judgment has beon entored upon said Mortgage in any
jurisdiction.
9. Notice of intention to foreclose and to accelerate the
loan balanoe has been given to the Mort<ji\lJon\ in acoox'dance with
Section 403 of Pennsylvania Act No.6 ot 1974, but the Mortgagor has
tlliled to reinstate the Mortgage in aC(1()rdilnce wIth thie provis.l.ons
thereof. A copy of the Notice is attached hereto and mada a part
hereof as Exhibit "C".
10. Defendants are not membero 01 the Armed ForceD of the
United state~ of America, nor engilged in any way which would bring
him within the Soldiers and Sailors Relief Act of 1940, as amended.

11. Plaintiff has complied with the procedures required by
Pennsylvania Act 91 of 19B3 (lIomoownero' Emergoncy Mortgage
Assistance Paymonts program) and Defendants have either failed to
meet the time limitations as sot forth therein or have been
determined by the Housing Finance Agency not to qualify for
assistance.
WHEREFORE, Plaintiff do~andn judgment in mortgage foreclosure
against Defendants for the aforementioned total amount due together
with interest at the rate of. 10.00% ($29.7259 per diem), together
with other charges and costs inclUding escrow advances incidental
thereto to the date of Sheriff.'s Sale and for foreclosure and sale ot
the property within described.

1. Plaintiff, CI'rICORP MORTGflGE, INC., is a servioinq
oompany with an office at P. o. Box 790014 MR 314, st. LOUis,
Mi~~ouri 63179-0014.
2. Defendants, William S. curtis and Kathleen A. curtis, are
adult individuals whose last known residence is 7 Graham Road,
Newville, PA 17241-9560 and/or 223 coventry Rd., York, PA 17402
and/or 13 Baben Road, /tudson, Massachusetts 01749-3102.
3. On or about May 7, 1990, Dofendants executed and delivered
a Mortgage Note in the sum of $110,350.00 payable to Sears Mortg~ge
Corporation, (orig ina 1 mortgagee), a copy of sa id Note is attached
hereto and marked Exhibit "A".
4. contemporaneously with and at the time of the execution of
the aforesaid Mortgage Note, in order to secure payment of the same,
Defendants made, executed and delivered to the original Mortgagee, a
oQrtain real estate Mortgage which is recorded in the within
Commonwealth and county in the Office of the Recorder of Deeds in
Mortgage Book 975, Page 1150, conveying to the original Mortgagee the
real estate described therein. The mortgage was assigned to citicorp
Mortgage, Inc., as reGarded in the within county on May 23, 1990,
reoorded in Book 393, Page 1018.

5. The land subject to the Mortgage iSI 7 Graham Road,

Nuwvillo, Pennsylvania 17241-9560, and is more particularly descrtbed
in Exhibit "B" attached hereto.
6. Defendants are the real owners of the land subject to the
Mortgage.
7. The Mortgage is in default due to the fact that Mortgagors
have failed to pay the installment dllC on April 1, 1993 and all
subsequent installments thereon, and the following amounts are due on
the Mortgage:
(a) Unpaid principal balance
(b) Interect at $29.7259 per day
from 3/1/93 to 2/1/94
(based on contract rate of 10.00%)

*Togetherwith interest at the per diem rate noted in (b) above after

attorney's fees set forth above are in conformity with the Mortgage
documents and Pennsylvania law, and will be collected in the event of
a third party purchaser at Sheriff's Sale. If the Mortgage is
reinstated prior to the sal~, reasonable attorney's fees will be
charged that are actually incurred by Plaintiff.
8. No JUdgment has been entered upon aaid Mortgage in any
jurisdiction.
9. Notice of intention to foreclose and to accelerate the
loan balance has boon qivon to tho Mortqagoru in ~ucordance with
section 403 of l'onnflylvania Aut No. Ii ot 19H, but thll Mortqagor has
failed to reinstate the Mortqagu in accordance with the provisions
thereof. A copy of the Notice is uttached hereto and made a part
hereof as Exhibit "C".
10. Defendants are not mmmbors at the Armed Forces of the
United states of America, nor engaqed in any way which would bring
him within the Soldiere and Sailors Relief Act of 1940, ae amended.

11. Plaintiff has complied with the procedures required by
pennsylvania Aot 91 of 19B3 (Homeowners' Emorqoncy Mortgage
Assistance Payments Program) and Defendants have either failed to
meet the time limitations as set forth therein or have been
determined by the Housing Finance Agency not to qualify for
assistance.
WHEREFORE, Plaintiff demands judgmont in mortgage foreclosure
against Defendants for the aforementioned total amount due together
with interest at the rate of 10.00% ($29.7259 per diem), together
with other charges and costs inclUding escrow advances incidental
thereto to the date of Sheriff's Sale and for foreclosure and sale of
the property within described,

company with an office at P. o. Box 790014 MR 314, St. [,ouis,
Missouri 63179-0014.
2. Defendants, William S. Curtis and Kathleen A. curtis, are
~dult individuals whose last known residence is 7 Graham Road,
Newville, PA 17241-9560 and/or 223 Coventry Rd., York, PA 17402
and/or 13 Baben Road, Hudson, Massachusetts 01749-3102.
3. On or about May 7, 1990, Dofendants executed and delivered
a MortqRqe Note in the sum of $110,350.00 payable to Sears Mortgage
Corpor~tion, (original mortgagee), a copy of said Note is attached
hereto and marked Exhibit "A".

4. contemporaneously with and at the time of the execution of
the aforesaid Mortgaqe Note, in order to secure payment of the same,
Defendants made, executed and delivered to the original Mortgagee, a
certain real estate Mortgage which is recorded in the within
Commonwealth and county in the Office of the Recorder of Oeeds in
Mortgage Book 975, Page 1150, conveying to the original Mortgagee the
real estate described therein. The mortgage was assigned to citicorp
Mortgage, Inc., as recorded in the within county on May 23, 1990,
recorded in Book 393, Page 1018.
The Mortgage and Assignments are

5. Tho land subjoct to tho Mortgngo is: 7 Graham Road,

Newville, ponnsylvnnia 17241-9560, and Ls more particularly descrtbed
in Exhibit "8" attached hereto.
6. Defendants arc tho real ownors of the land aubject to the
Mortgage.
7. The Mortgage is in default due to the fact that Mortgagors
have failed to pay the installment duo on April I, 1993 and all
aubsequent installments thereon, and the following amounts are due on
the Mortgage:
(a) Unpaid principal balance
(b) Interest at $29,7259 per day
from 3/1/93 to 2/1/94
(based on contract rate of 10.00%)

10. Defendants are not membero of the Armod forces of the
United states of America, nor engaged in any way which would bring
him within the Soldiers and Sailors Rollor Act of 1940, as amended.

11. Plaintiff has complied with the procedures required by
Pennsylvania Act 91 of 1983 (Homeowners' Emergency Mortgage
Assistance Payments Program) and Defendants have either failed to
meet the time limitations as set forth therein or have been
determined by the Housing finance Agency not to qualify for
assistance.
WHEREFORE, Plaintiff demands judgment In mortgage foreclosure
against Defendants for the aforementioned total amount due together
with interQst at the rate of 10.00% ($29.7259 per diem), together
with other charges and costs including escrow advances incidental
thereto to the date of Sheriff's Sale and for foreclosure and sale of
the property within described.
