C. Ilverhart, M.D. (hereinafter referred to as IIDr. EVerhartll) wa.
the owner of a raa1dential dwelling looated at 709 MoCormiok
Road, Meohanio.burg, Upper Allen Town.hip, cumberland county,
penn.ylvania (hereinafter r.eferred to as the IIMocormiok Road
re.idencell).
13. Previously, Dr. Everhart had entered intq an exclu.ive
li.ting contract with Jaok Gaughan, Ino. tla Jaok Gaughen Realtor
(hereinafter referred to as lIoaughenll) to list the MoCormiok R9ad
residenoe for .ale.
13. On July 23, 1993, Dr. Everhart exeouted a written
agreement for the eale and purchase of the McCormiok Road
reaidence (IIAgreementll) with Denny W. Hamilton and Patsy Burkhard
(hereinafter referred to a. the IIHamiltonell).
14. Ae part af the Agreement, Mr. and Mrs. Hamilton were to
puroha.e the MoCormiok Road residenoe at a ooet of Two Hundred
Seventeen Thoueand Dollare ($317,000).
15. Upon exeoution of the Agreement, the Hamiltons then
depo.ited Ten Thousand Dollars ($10,000) into Gaughen's esorow
acoount pursuant to applioable rule. of the State Real I.tate
Comraiedon.

bre.ching the Agreement to purchase the Mccormick Road r.eidenQe.

30. Mr. and Mre. Hamilton's tailure to tollow the term. and
condition. ot the Agreement, a. well as settle on the contracted
date ot October 30, 1993, constitute a detault under the term. of

AND NOW, comes the Petitioner, Wilson C. f:verhart, by and
through his counsel, Keefer, Wood, Allen & Rahal, and file. this
petition, averring as followSl
1. On or about July 23, 1993, Petitioner entered into a
contraot for the sale and purchase of real estate ("Agreement")
with Denny W. Hamilton and Patsy Burkhard Hamilton
("Re.pondents").
2. In acoordance with the contract, Respondents depo.it~d
$10,000 with Jack Gaughn, Inc. as escrow agent, pursuant to the
applicable rule. of the state Real Estate commission.
3. The Respondents breached the Agreement and as a result
the transaotion was not concluded.
4. Both Petitioner and Respondents made claim for the
return of the $10,000, which resulted in Jack Gaughn, Inc.
in.titutinq thi. action in February, 1994, and payinq the $10,000
into Court in December, 1994.

~. Re.pondent. were in violation ot the Agr..ment in that
they failed to have lettlement on or before Ootober ~O, 1993, for
rea.on. other than failure to obtain finanoing, in aooordanoe
with the Agreement.
6. The rea.on artioulated by Respondents for r.efusing to
go forward with the settlement was that several snakes had been
di.covered in the house.
7. Respondents refused to accept the property,
notwithstanding the taot that the snakes were exterminated.
B. The house was habitable and met all other terms at the
Agreement. Theretore, Respondents were not justified in r.t'Jsi~9
to olose or in their breaoh ot the Agreement.
9. Further, Respondente agreed to aocept the house "as
is," without having extermination, but at a substantially reduoed
prioe.
10. As a result at the Respondents' breaoh of the
Agreement, Petitioner is entitled under the terms at the
Agreement to the $10,000 that has been paid into Court in this
matter.
WHEREFORE, Petitioner, Wilson c. Everhart, requests that
this Court issue a rule to show cause why the $10,000 paid into

Burkhard) tile this Claim pursuant to Pa.R.C.P. 2309 and in
accordanoe with the Court'l Order ot June 19, 1995 al follows:
1. Claimants Denny W. Hamilton and Patsy Hamilton, hi.
wife, are adult individuals reliding at 131 Oak Park Road,
Harrisburg, Penneylvania 17011.
2. Plaintiff Jack Gaughen, Inc., trading ae Jack Gaughen
Realtor, is a Pennsylvania corporation with a principal office
located at 3800 Market street, camp Hill, Cumberland county,
Pennsylvania. On February 7, 1994 Plaintiff Jaok Gaughen, Ino.
initiated the above action in equity.
3. Defendant Wilson C. Everhart is an adult individual with
an address of 1417 Brandon Road, Mechaniclburg, Cumberland
county, Pennlylvania.
4. on or about July 23, 1993, Claimants executed an
Agr.ement for the Sale and Purchale of Real Eltate ("Agreement")
r..peotinq property improved with a r...idential dwellinq owned by
Detendant Everhart locat~d at 709 McCormiok Road, Meohanic.burq,
Upper Allen Township, Cumberland cQunty, Pennsylvania
(herelnatter the "premis.e"). A true and oorreot oopy of the
aforementioned Aqreement is attaohed hereto and incorporated by
reference herein as "f:xhibit A".
~. On or about July a4, 1993 Claimants paid to Jack Gauqhen
Realtor by oheok the sum of $10,000 as a deposit on the purohaee
of the premioes.
6. After July a3, 1993, on a date unknown by Claimants,
Defend4nt Everhart exeouted the Agre~ment and paok-dated it to
July a3, 1993.
7. Claimants were not provided a oopy of the Agreement
which was executed by Everhart ul,til on or after Auguet a7, 1993.
8. Subsequent to executing the Agreement made reference to
in paragraph 4, above, Claimants reoeived a oopy of Seller'S
Property Disclosure statement (hereinafter "Disclosure
statement") which had been signed, initialed and completed by
Defendant Everhart. A true and correct copy of the
aforementioned Disclosure Statement is attached hereto and
incorporated by reference herein aa "Exhibit B".

Everhart represented that the information set forth thereon was
acourate and oomplete to tho belt of hil knowledge.
10. At all times relevant hereto, Defendant Everhart knew/
or had reason to know, that Claimante would rely upon the
representations made by him in the Disololure Statement and that
claimantl would utilize the Disolosure statement tor purpose. ot
assistinq them in evaluating the premises.
11. On or about october 4, 1993/ while in the prooess of
inspeoting the premises and investigating and oontirminq the
existence ot termite infestation, Claimant Denny W. Hamilton
dilcovered and learnod that the premises was intested with and
inhabited by snakes.
12. On or about October 4/ 1993, as a result of an
inspection of the promises, evidenoe of water penetration was
disoovered throughout the premises. In addition, evidenoe ot
shifting and movement of the foundation of the garage was
observed.
13. During Claimant's inspection of the premises prior to
their executing the Agreement, Claimants observed nothing patent
whioh would lead them to conclude that the premises was other
than habitable and as repr,sented to them by Detendant Everhart
in the Disolosure Statement.

14. At no time prior to Claimant. exeouting the Agreement,
did Oefendant Everhart disolo.e or reveal to Claimant. the
exi.tence of .nake infe.tation, the penetration of water into the
home or the .hiftinq and movement of the foundation.
1~. Claimant. believe and therefore aver that Pefendant
Everhart knew or .hould have known of the exi.tenca of .nak.. on
the premises, the penetration of water into the premi.e. and the
shiftinq and movement of the foundation prior to Claimants
executinq the Agreement to purchase the premises.
16. The infestation of snakes in the premises was a latent
defeot not reasonably discoverable by Claimant. prior to their
executinq the Agreement.
17. The infestation of snakes in the premises rendered the
premises inhabitable.
18. The repre.entations made by Defendant Everhart in the
Pi.olosure statement, specifioally, but not limited to, those
made under items l1(a) and l1(b) were false, ullt.rue and
oaloulated to deoeive Claimants, and in fact, did so deceive
Claimants.
19. Claimants did in fact rely upon the purported acouraoy
and truthfulness of the repreeentations made by Defendant
Everhart in the Disclosure statement.
20. On October 8, 1993, Claimants communioated to their

real eitate agent that they were re.cinding the Agreement to
purcha.e the premi.e. due to, inter Ilia, the infe.tation of
.nake. in the premi.e. ae well .e the evidence of water
penetration and the .hifting and mov.ment of the foundation, all
of which condition. were known by Defendant Everhart or with
rea.onable diligence .hould have been known by him prior to
Claimant. executing the Agreement.
21. It i. believed and therefore averred that Defendant
Everhart did not execute the Agreement or provide written
approval for the .ale of same on or before July 25, 1993.
WHEREFORE, Claimants Denny W. Hamilton and Patsy Hamilt~n
reque.t this Court to enter jUdgment in their favor and again.t
Jack Gaughen, Ino, and Defendant Everhart in the amount of
$10,000, enter an order directing that the $10,000 depo.it made
by them for purchase of the premises be paid over to them free of
any claim, right or interest of Plaintiff Jack Gaughen, Inc, and
Defendant Wilson C. Everhart, and provide all other relief which
this Court deem. just and appropriate under the circumstances.

Wilson c. Everhart, Denny W. Hamilton, and Patsy Burkhard
Hamilton, were directed to file a statement of claim within
twenty (20) days of the court's order relativ~ to the $10,000
deposited with the prothonotary by the plaintiff in this matter.
2. Everhart and the Hamiltons have been negotiating in
good faith to resolve the matter and believe that a settlement
regarding the disposition of the $10,000 is imminent. However,
additional time is needed.

1. Claimant, Wilson C. Everhart (IIEverhartll), 11 an adult

cumberland County, Penn.ylvania.
2. Plaintift i. Jack Gaughen, Inc. tla Jack Gaughen
Realtor (IIJack Gauqhenll), a pennsylvania corporation with it.
principal ottice located at 3800 Mal.'ket street, Camp 11111,
Cumberland County, penneylvania.
3. Defendant., Denny W, Hamilton and pat.y Hamilton
(formerly Burkhard) (IIHamilton.II), are adult individual. re.icling
at 131 Oak Park Road, Harrilburg, PA 17011.
4. On July 23, 1993, the Hamilton. executed an agreement
for the .ale and purcha.. of real e.tate (IIAqreement") tor
pl'op.rty then owned by Everhart and located at 70' McCormick
Road, Kachanic.burq, Qpper Allen Town.hip, cumbel'land County,
Penn.ylvania (hereinafter "the Premiae."), which waa accepted by
Everhart. A true and correct copy of the Aqreement i. attaohed
to the claim filed by the Hamilton., a. well.. the complaint
filed in thi. mater by Jack Oauqhen.
e. On or about July 24, 1993, the Hamilton. paid to Jack
Oauqhen a oheck in the .um of $10,000 a. a depo.it on the
purcha.e price of the premi.e. in acoordance with the Aqreement.
6. The Aqreement provided for the Hamilton. to obtain a
financinq commitment by October 1, 1993, and that .ettlement wa.
to be ..de on Ootober 20, 1993. Neither of the.e condition. were
met, and the Hamilton. were, therefore, in breach of the
Aqreem.nt.
7. Hamilton. never notified Everhart that they were unable
to obtain financinq under the term. .et forth in paraqraph 6 of
the Aqr.ement.
e. The primary rea.on artioulated by the Hamilton. for
refu.inq to honor the commitment .et forth in the Aqreem.nt wa.
that .nake. had been di.cov.red in the hou.e. Th. houee wa.
habitable and met all oth.r term. of the Aqr.ement. Therefore,
the Ha.ilton. were not ju.tified in refu.inq to olo.e or in their
breach of the Aqre.ment.

9. .The di.olosure .tatement made by Everhart wa. true and

10. Ths Hamilton. visited the property on several oooa.ion.
prior to exeoutinq the Agreement on July 23, 1995. Further, in
paraqraph 16 ot the Agreement, they oertitied that they in.pected
the property and agreed to purchase the property as a result ot
suoh in.peotion and ngt beoause ot or in relianoe upon any
representation made by Everhart.
11. Aocordingly, the Hamilton8' breaoh ot the Agreement and
retusal to proceed was not justitied.
12. Under paragraph 20 ot the Agreement, all dep08it monies
paid by the buyer (Hamilton8) were to be retained by the 8eller
(Everhart) as liquidated damag.s.
13. The Hamil tons later agreed to aooept the hou8e "a. is"
without having any extermination ot the snakes or doing any other
repairs, but at a substantially reduced price.
14. As a result of the Hamiltons' breaoh of the Agreement,
Everhart is entitled, under paragraph 20(c) ot the Agreement, to
the $10,000 escrow money that has been paid into Court.
WHEREFORE, Claimant, Wilson C. Everhart, request. that the
Court enter judgment in his favor and against Jack C. Gaughen and
the detendant8, Denny W. Hamilton and pat.y Hamilton, in the

Everhart, on a date unknown by Claimants Hamilton, executed the
Agreement and back-dated it to July 23, 1993.

6. Admitted in part! denied in part. It is admitted that
the Agreement contained a terminal date for obtaining a financing
commitment by Claimants Hamilton of October 20, 1993. By way of
further answer, the Agreement being in writing, speaks for
itself. Although it is admitted that a formal financing
commitment was riot obtained by october 1, 1993, said Agreement
remained effective, according to its terms, as if the financing
contingency were not a part thereof. Although it is admitted
settlement under the Agreement did not occur on or before Ootober
20, 1993, eettlement by that date did not occur due to the
infeetation ot the eubject premisee by snakee and the existence
of varioue detecte in the premisee, which conditione were known
by Oetendant Everhart, or ehould have been known by him prior to
Claimante Hamilton executing th~ Agreement. The infestation ot
.nake. rendered the premi.es inhabitable and the various detect.
in the premiaes were contrary to representations made by
Defendant Everhart on a Disclosure statement provided to
Claimants Hamilton. Accordingly, it is denied that Claimants
Hamilton were in any way in breach of the Agreement,

the primary reason articulated by Claimants Hamilton tor not
olosing on the purohase was that snakes were inte.ting the house.
This oondition, together with the discovery of water intiltration
and other oonditions of the premisss which wsre not disclo.ed to
them by Oetendant Everhart, were also articulated tor not
settling on the purohase of the premises.
It is denied that the house was habitable and met all

uninhabitable due to the intestation of snakes and contained
various defeots and conditions not disclosed to Claimants

Hamilton were.not juetified in refu.inq to clo.e on the purcha.e
of the premise. or that they breached the Agreement, for the
rea.ons set forth in their statement of claim, the averment. ot
which are inoorporated by reference herein by way of further
answer hereto.

by Everhart wae true and correot to the best of hi. knowledge at

more tully described and set forth in Claimants Hamilton's
statement ot Claim, the averments of which are incorporated by
reterence herein.
10. Admitted in part; denied in part. It is admitted that
the Claimants Hamilton visited the property on several occasions
prior to Bigning the July 23, 1993 (fi2t 1995) Agreement ot Sale.
The contents of the Agreement of Sale, being in writing, speak
for themeelves; therefore, Everhart's characterization of same is
denied. By way of further answer, Claimants Hamilton incorporate
by referenoe the averments of their Statement of Claim in
response to Everhart's allegation that Claimants Hamilton did not
rely on Everhart's representatione.

11. Denied. Paragraph 11 contains an unwarranted
conclueiorl ot law to which no response is requi1:ed by thil party,
therefore, same is deemed to be denied pursuant to Pa.R.C.P.
1029(d). To the extent a responee is necessary, it is denied
that the Claimant. Hamilton at any time breached the Agreement or
that they unjustifiably refueed to proceed. To the contrary,
there was neither a breach nor unjustitied refusal to proceed tor
the rea.ons set forth in Claimants Hamilton'e statement of Claim
and this Answer, the averments of both being incorporated by
reterence herein.
12. Denied, The contents of the Agreement, being in
writing, speak for themselves, therefore, Everhart'.

reason set forth herein and in Claimants Hamilton's statement of

be denied pureuant to Pa.R.C.P. 1029(d). To the extent a

file this Amended Claim pursuant to Pa.R.C.P. 2309 and in
accordance with the Court's Order of June 19, 1995 a8 followSI
1. Claimants Denny W. Hamilton and patsy Hamilton, hie
wife, are adult individuals residing at 131 Oak Park Road,
Harrisburg, Pennsylvania 17011.
2. Plaintiff Jack Gaughen, Inc., trading as Jack Gaughen
Realtor, is a Pennsylvania corporation with a principal office
located at 3800 Market Street, Camp Hill, Cumberland County,
Pennsylvania. On February 7, 1994 Plaintiff Jack Gaugh.n, Inc.
initiated the above action in equity.
3. Defendant Wilson C. Everhart is an adult individual with
an address of 1417 Brandon Road, Mechanicsburg, Cumberland
county, pennsylvania.

4. On or about July 23, 1993, Claimants executed an
Agreement for the Sale and Purchase of Real Estate ("Agreement")

re.pecting property improved with a residential dwelling owned by
Defendant f:v$rhart looated at 709 McCormick Road, Mechanicsburg,
Upper Allen Townehip, Cumberland county, Pennsylvania
(herllinatter the "premises"). A trl,le and correct copy of the
atorement~oned Agreament is attached her$to and incorporated by
reterence herein as "f:xhibit A".
5. On or about July 24, 1993 Claimants paid to Jack Gaughen
Realtor by check the sum of $10,000 as a deposit on the purchae.

6. After July 23, 1993, on a date unknown by Claimants,
Defendant f:verhart eKecuted the Agreement and back-dated it to
July 23, 1993.
7. Claimants were not provided a copy of the Agreement
which was executed by f:verhart until on or after August 27, 1993.
8. subsequent to executing the Agreement made reference to
in Paragraph 4, above, Claimants received a copy of Seller's
Property Disclosure statement (hereinaftor "Disclosure
statement") which had been signed, initialed and completed by
Defendant f:verhart. A true and correct copy of the
aforementioned Disclosure statement is attached hereto and
incorporated by reference herein as "Exhibit B".
9. By and through the Disclosure statement, Defendant

Evorh"rt represented that the intormation set torth thereon waG
aoourate and oomplete to the best of his knowledge.
10. At all time. relevant hereto, Defendant Everhart kn.w,
or had reason to know, that Claimants would rely upon the
repr..entations made by him in the Diaolo.ure statement and that
Claimants would utilize the DiscloDure statement for purpo.e. ot
assisting them in evaluating the premises.
11. On or about October 4, 1993, while in the proo... ot
inspecting the premises and investigating and oontirming the
.~istenoe ot termite intestation, Claimant Denny W. Hamilton
disoovered and learned that the premises was intested with and
inhabited by snakes.
12. On or about October 4, 1993, a. a result of an
in.pection of the premises, evidence of. water penetration was
discovered throughout the premises. In addition, evidenoe ot

shitting and movement of the toundation ot the garage was
observed.

13. During Claimant's inspection of the premises prior to
their executing the Agreement, Claimants observed nothing patent
which would lead them to conclude that the premises was other
than habitable and as represented to them by Defendant Everhart
in the Disclosure statement.

14. At no time p~io~ to Claimants executing the Agreement,
did Defendant Everha~t disclose or ~eveal to Claimants the
existence of snake intestation, the penetration of water into the
home or the shifting and movement of the foundation.
15. Claimants believe and therefore aver that Defendant
Everha~t knew or should have known of the existence of snakes on
the premises, the penetration of water into the premises and the
shifting and movement of the foundation prior to Claimants
exeouting the Agreement to purohase the premises.
16. The infestation of snakes in the premises wae a latent
defeot not reasonably disooverable by Claimants prior to their
exeouting the Agreement,
17. The infestation of snakes in the premises rendered the
premises uninhabitable,
18. The rep~esentations made by Oefendant Everhart in the
Disolo~ure statement, speoifioally, but not limited to, thoss
made under items 11(a) and 11(b) were false, untrue and
oaloulated to deoeive Claimants, and in fact, did so deoeive
Claimants.

19. Claimants did in faot rely upon the purported aoouraoy
and truthfulness of the representations made by Defendant
Everhart in the Disclosure statement.
20. On October 8, 1993, Claimants communicated to their

real estate aqent that they were resoindinq the Aqreement to
purohase the premises due to, i~ter AliA, the infestation of
snake. in the premises as well as the evidenoe of water
penetration and the shiftinq and movement of the foundation, all
of whioh oonditions were known by Defendant Everhart or with
reasonable diliqenoe should have been known by him prior to
Claimants exeoutinq the Aqreement,
21. It is believed and therefore averred that Defendant
Everhart did not exeoute the Agreement or provide written
approval for the sale of same on or before July 25, 1993.
WHEREFORE, Claimants Denny w. Hamilton and Patsy Hamilton
request this Court to enter judgment in their favor and aqainst
Jaok Gauqhen, Inc. and Defendant Everhart in the amount of
$10,000, enter an order direotinq that the $10,000 deposit made
by them for purohasp of the premises be paid over to them free ot
any claim, riqht or interest of Plaintiff Jaok Gallqhen, Inc. and
Defendant Wilson c. f:verhllrt, and provide all other relief whioh
this Court deems just and appropriate under the ciroumstanoes.

Defendants Denny W. Hamilton and Patsy Hanlilton (nee Patsy
Burkhard) ("Defendants Hamilton"), submit this Motion and in
support thereof state the fOllowing'
1. This action in equity was initiated by Plaintiff Jack
Gaughen, Inc. by complaint filed February 7, 1994 seeking, inter
AliA, authori~ation to pay over to the Prothonotary the sum of
$10,000.00, which sum represented a depooit made by Defendants
Hamilton in purchase of real property owned by Defendant Wilson
c, Everhart, over which sum a dispute had arisen between the
Defendants.

2. In accordance with the terms of a stipulation dated
November J, 1994 and filed of record in this action, Plaintiff
deposited with the Prothonotary the sum of $10,000.00.
3. On or about Septembur 26, 1997, Defendants Hamilton
initiated a civil action in law against Defendant Everhart
docketed to No. 95-5257 in this Court seeking recovery of certain
alleged damages and losses, among them the $10,000.00 deposit
ade reference in Paragraph 1, above.
4. In the aotion dooketed in this Court ta No. 9~-6a~7,
Detendant Everhart joined Defendant Jack Gaughen, Inc. aa an
additional defendant and Jaok Gaughen, Ino. joined ReHax Realty
Assooiate., Inc. as a aeoond additional defandant.
6. The parties to this action in equlty and the action in
law docketed in thJ.s Court to No. 95-5267 have reached a
.ettlement af all their respective claims and ditferenoes whioh
they have documented hy a written settlement agreement.
6. As a result ot the settlement reached hotween the
partie. as set forth in Paragraph 5, ahove, Plaintiff Jaok
Gaughen, Inc., Defond~nts Hamilton and Defendant Everhart agree,
authorize and consent to pay and release to Defendants Hamilton
the sum of $10,000.00 being held by the Prothonotary in this
Equity action, together with accrued interest thoreon, if any,
and upon such payment, the parties agree that this action shall
be considered dismissed and ended.

7. The conditions precedent to dishursement of the sum
deposited with the Prothonotary as set forth in the stipulation
dated November 3, 1994 and filed in this action have ooourred.
8. C. Roy Weidner, Jr., Esquire, attorney for Plaintiff
Jack Gaughen, Inc. and William E. Mill~r, Jr., Esquire, attorney
tor Defendant Everhart oonsent to this Hotion with the authority
of their respeotive clients to do so.
WHEREFORE, Defendants Hamilton request this Court to issue
an Order authorizing and directing the Prothonotary of cumberland
County to distrihute to Defendants Denny W. Hamilton and Patsy

Hamilton the sum of $10,000.00 to~ether with interest accrued
thereon, if any.
