7. Ce.pite filing ita appeal from Distriot Justioe
judgment entered to No. ao civil 1994 on January 3, 1994,
Defendant failed to serve the Notioe of Appeal on Plaintiff until
Maroh 1, 1994.
8. On February 7, 1994, the date on which Plaintiff filed a
Tranaoript to Distriot Ju~tioe jud~_ent to No. ~68 Civil 1994 in
the Court of Common Pleas, Plaintiff had no notioe of Defendant'.
appeal.
9. On February 22, 1994, the date on which Plaintiff filed
a Writ of Exeoution against Defendant, Plaintiff had no notioe of
Defendant's appeal.
10. Prior to Plaintiff'. February 7, 1994 and February 22,
1994 aotions, Plaintiff's oounsel notified Defendant on January
24, 1994 and February 21, 1994, re.peotively, that Plaintiff
planned to take further legal action to enforoe its Distriot
Justioe judgment if no effort wa. made by Defendant to satisfy
such judgment.
11. Defendant wholly failed to re.pond to Plaintiff's
January 24, 1994 and February 21, 1994 corre.pondence.
12. On Maroh 2, 1994, Plaintiff filed a Praeoipe requesting
the Prothonotary to strike Defendant's appeal for failure to
timely serve Plaintiff with a Notioe,of Appeal.
13. Defendant'. Notioe of Appeal should be strioken from
the reoord pursuant to Pa.R.C.p.D.J. 1006 for failure to oomply
with Pa.R.c.p.D.J. 100~B, relating to .ervice of the Notioe upon
Plaintiff.
