I . STATEMENT OF FACTS
On or about July 29, 1993, Plaintiffs entered into an
Agreement of Sale with Defendant Witt1e to purchase 11 Roosevelt
Street, Enola, Cumberland County, Pennsylvania. (Complalnt,
Paragraph 1). Prior to entering into the Agreement of Sal.,
Plaintlffs inquired from Defendant Witt1e's real estate agent as
to what the status of the roof was and if there had ever bsen any
water problems with the roof. (Complaint, Paragraph 6).
Plaintiffs were advised by Defendant Wittle's real estate agent
that the roof had recently been replaoed by Defendant Wlttle and
that there were no water leaking problems. (Complaint, Paragraph
7). On Ootober 12, 1993, settlement was held on the property.
(complaint, Paragrftph 8). Defendant Wittle remained in the
property for two weeks after settlement. (complaint, Paragraph
9). After moving into the property, Plalntiffs eKperienced
elgnificant water problems (primarily leaking) from the roof.

(Complaint, Paragraph 16). After experlenoing the initial
leaklng/ Plaintiffs oontaoted Defendant Wittle, and Defendant
Wittle plaoed some oaulking on the roof in an attempt to oorreot
the leaking problems. (complaint, Paragraphs 19 through 21).
The oaulklng repair did not work and Plaintiffs have experlenoed
damages resultlng of water leaking through the roof and oei1ing
of the property. (Comp1alnt, Paragraphs 29 through 32).
Plaintlffs' Complaint alleges a breaoh of oontraot, a breaoh of
warranty of habitability, misrepresentatlon, and violations of
the Pennsylvania unfair Trade llraotioes and ConaUmer proteotion
Aot.
II. Dl~CUSSION OF ISSUES
A. Defendant Wittle's Preliml~ Obieotion Raising Lagal
Insuffioienoy ot the Pleading.
Defendant Witt1e's first preliminary objection raises the
legal insuffloienoy of Plaintiff's Complaint with regard to
allegatlons plaintiffs have made against Defendant Wittle.
A prellminary objeotion raising the legal insuffiolenoy of a
pleadlng (demurrer) admits every well-pleaded material faot
alleged ln the complaint, as well as all inferences reasonably
deduotible therefrom. Allstate Insuranoe Co. v. Fioravanti, 451
Pat 108, 299 A.2d 585 (1973). In order to sustain the
preliminary objeotion raising the legal insufficienoy of a
pleading (demurrer), it is essential that the Plaintiffs I
complaint indioate on its faoe that the olaim cannot be
8u8tained, and that the law will not permit recovery.

pleader will be unable to prove facts legally

In supportlng his claim, Defendant Wittle argues that the
Complaint avers that Detendant Witt1e complied with the Agreement
of Bale and that Plaintiffs have tailed to plead a breach of
contract or a duty owed. However, Detendant Witt1e's Preliminary
Objections references only paragraphs 11 through 15 of
PlaintJffs' Complaint. Count 1 ot Plaintiffs I Complaint, the

Wittle to the Plalntiff which were not performed or were
lnadequately or. improperly performed. Count 1 also aver.

Plaintlfts' Complaint lncorporates Count I and add. flve
additlonal paragraphs regarding Defendant Wittle's Breach of
Warranty of Habltability. Count 3 of Plaintiffs' complalnt
lncorporatss the previous two count. and adds averment. regarding
misrepresentations mad~ by Defendant Wittle to the Plalntlffs.
Finally, Count 4 of the complaint incorporates the previous three
count. and adds 5 paragraphs alleging Defendant Wittle'.
violation of the Unfair Trade Practices and Consumer Proteotion
Act, Section 201-3.
Furthermore, Defendant Wittle argues that Plaintifts'
complaint does not establish that a duty was owed by Defendant.
to Plaintiffs as to the roof. To the contrary, Paragraphs 5
through 7 of the Complaint clearly establish that the Plaintiffs
inquired about the status of the roof and if there had been any
water problems wlth the roof. (Complaint, Paragraphs 5 and 6).
Defendant Witt1e's agent advised Plaintiffs that the roof had
reoently been replaced and that there were no water problem..
(Complaint, Paragraph 7). Oefendant Witt1e through his agent
olearly lndicated and represented to Plaintlffs that the roof had
reoently been replaced and that there were no water prOblem. wlth
the roof. (complaint, Paragraph 7) .

Additionally, It would appear that Defendant Witt1e created
an addltional duty when he returned to the subject property to
effectuate repairs atter settlement. For Dstendant Witt1e to now
argue that he had no duty appears to bs contrary to logic, as
well aa contrary to law.
Theretore, in applying the well established standard
applicable to a preliminary objection raising legal insutflclenoy
ot . pleading to Defendant Witt1e's pre1lminary objectlon, said
preliminary objections should be denied.
B. Detendant's Preliminary Obiectlon Ralsing ~qreement fo~
Alternative Dispute Resolution.
Detendant Witt1e's second preliminary objection raises the
question that the Agreement of Sale (see Exhibit "A" of
P1aintift's CompJ.aint) contains a provision that any dispute or
claim arising out of the Agreement ot Sale shall be submitted to
non-binding mediation, in accordance with paragraph 22 of the
Agreement of Sale.
Plaintiff admits that Paragraph 22 of the Agreement of Sale
states, inter lllill., that "Any dispute arising out of or
relating to this Agreement, the breach of this Agreement or the
services provided in relation to this agreement shall be
submltted to medJ.ation in accordance with the RUles and
Procedures of the Real Estate Dispute Resolution system. II
Plaintiffs have submitted this matt~r to the Greater
Harrisburg Association of Realtors Real Estate Dispute Resolution
system. However, Defendant Wittle refused to particlpate in lald

4. On or about July 29, 1993, Plaintiffs entered lnto an
Agreement of Sale with Defendant Leroy E. Wittle to purchase a
oertain traot of real estate known as 11 Roosevelt atr.et, Enola,
Cumberland County, Pennsylvania 17025 (hereinafter "11 Roosevelt
Street>>) for a purohase price of $48,000.00. Defendant D'Ange10
Realty Group, Inc. was t.he realtor for both P1aintlffs and
Defendant Whittl.e. A copy of the Agreemont of Sale and Purchase
of Real Estate (hereinafter "Agreement of Sale>>) is attached
hereto as Exhib.1. t >>11." and by reference incorporated herein and
made a part hereof.
5. Prior to July 29, 1993, the contract date, Plaintiffs
contacted and inquired from Plalntiffs' real estate agent, Jlm
Irwin, who is employed by Defendant D'Angelo Realty Group, Inc.,
what the status of the roof was and if there had ever been any
water problems with the roof at 11 Roosevelt street.
6. Jim Irwin advised Plaintiffs that he (Mr. Irwin) would
flnd out about any water and/or roof problems and telephone
Plaintiffs with the information.
7. Mr. IrwJ.n telephoned Plaintiffs and Mr. Irwin advlsed
Plalntiffs that Mr. Robert D'Angelo, President of Defendant
D'Angelo Realty Group, had advised him (Mr. Irwin) that Defendant
Whittle had advised Mr. D'Angelo that the roof at 11 Roosevelt
street had recently boen replaced by Defendant Whlttle and that
there were no water leaking problems. Plaintiffs were further
advised that Defendant Whittle had not rep1aoed the oeilings.
8. On or about Ootober 12, 1993, pursuant to the Agreement
of Sa1., Plaintiffs purohased the property from Defendant Leroy
E. Witt1e. A copy of the Settlement Sheet is attached hereto as
Exhibit "B" and by reference incorporated herein and made a part
hereof.
9. Plaintiffs did not immediately move into 11 Roosevelt
street because after settlement, Plaintiffs waited approxlmately
two weeks for Defendant Whittle to move out of 11 Roosevelt
street. After Defendant Whittle moved out of 11 Roosevelt
Avenue, Plaintiffs renovated the bathroom.
10. After renovating the bathroom, Plaintiffs moved lnto 11
Roosevelt street.
11. The above-mentioned Agreement of Sale was contlngent,
in paragraph 9, to Defendant Leroy E. Witt1e making all neceseary
FHA repairs.
12. FHA required that certain painting and eel ling repairs
occur prior to settlement.
13. Defendant Witt1e and Defendant D'Angelo Realty Group,
Inc. agreed to have said repairs made. It is believed and
therefore averred that Defendant Whittle and Defendant D'Angelo
Realty Group, Inc. conspired together to have their employees
andlor agents make the FHA required repairs.
14. It is believed and therefore averred that omploye..,
aqents and/or busineBs associates of Defendant D'Anqelo Realty
Group, Inc. and/or of Defendant l,eroy Wittle, were hired to make
the repairs.
15. It appeared as though certain repairs were made to the
premises to satisfy the FHA inspector regarding the required FHA
repairs.
16. Since moving into 11 Roosevelt street, Plaintlffs have
experlenoed siqnificant water problems (primarily leakinq) from
the roof that was also allegedly repaired by Defendant Wittle as
described in Paragraphs 13 through 15.
17. Said water problems consist of water leaking through
the ceilings in the bedroom off the dinlng room, the kitchen and
the bathroom.
18. Plaintiffs have obtaIned a quotation from an
independent contractor, Daniel E. Schoffstall, for all necessary
repairs to correct said leaking problems at 11 Roosevelt Street.
A copy of said quotation/proposal is attached hereto as Exhlblt
"C" and by reference incorporated herein and made a part hereof.
19. After the first significant rainfall after Plaintiffs
moved into 11 Roosevelt street, which waB as soon as Plaintiffs
dlscovered the water problems with the ceiling and/or roof, they
contacted their realtor, Jlm Irwin, and Def~ndant Whittle's
realtor, Robert D'Angelo, both omployees of Defendant D'Anqelo
Realty Group, Ino., so that Defendant Whittle oould be advi.ed of
eam. and eo that arrangements oou1d be made to have sald leaking
problem. correoted.
20. PlaintiffS were advlsed via telephone by Hr. Robert
D'Angelo, president of D'Angelo Realty Group, Ino., that all
noce.sary repairs would be made and that D'Angelo Realty Group,
Inc. would oontact Defendant Witt1e to arrange for the
appropriate repairs.
21. It is be1iaved and therefore averred that after the
telephone conversation referenced in paragraph 20 above,
Defendant Whittle placed some sort of caulking on the roof ln an
attempt to correct the "leaking" problems.
22. Said caulking did not hold and did not remedy the
leaking problems through the cei lings of the bathroom, the
kitchen, and the bedroom off the dining room.
23. Since that one attempted repair, no other repair. have
been made to the premises by either Defendant Whlttle or
Defendant D'Angelo Realty Group, Inc. .
24. Plaintiffs have contacted Defendant Wittle, and ln taot

made arrangements for Defendant Witt1e to inspect the water
leaking problems and/or oei1ing and roof problems at 11 Rooeevelt
street on at least two (2) separate occasions.
25. However, Defendant Wl.ttle did not keep either
appointment.
26. Plaintlffa have sUffered an asoertalnable loss ofl
approximately $13,214.65 for the cost to make the neoessary
repairsl $1,000.00 for addItional rent since October, 1993, whloh
amount will increase at a rata of $200.00 per month, said amount
being the rent that Plaintiffs have paid to live in a se~arate
dwelling because of the uninhabitability of 11 Roosevelt streetl
$385.00 for storage costs sinca Ootober, 1993, which amount will
inorease at a rate of $77.00 per month, oald amount being the
amount Plaintiffs pay for the storage of P1aintiff'o furnlture on
acoount of the inhabitabilIty of 11 Roosevelt streetl plus
lnterest.
The loss regarding repairs represents the cost that would be
involved in having the roof and ceiling at 11 Roosevelt street
repaired pursuant to the quotation/proposal attached hereto as
Exhibit "C" and by reference incorporated herein and made a part
hereof.
WHEREFORE, Plaintiffs respectfully request demand judgment
against Defendant LeRoy E. Whittle for FOURTEEN THOUSAND FIVE
HUNDRED NINETY-NINE and 65/100 ($14,599.65), plus an addltlonal
TWO HUNDRED SEVENTY-SEVEN ($277.00) DOLLARS per month, whioh sum
does not exceed the limits requiring compulsory arbitratlon,
together with interest thereon, the costs of suit, and any
further relief this Honorable Court deems proper.

2'7. Paragraphs 1 through 27 are inoorporated hereln by
referenoe as if set forth in their entirety.
29. At the time Plaintiffs and Defendant Wittle oontraoted
and aqreed upon the tel'ms of the Agreement of Sale, Defendant
Wittle warranted that all FHA repairs would be made and that the
house would be habitable.
29. Plaintiffs and Defondant Whittle and Defendant D' Anqelo
Realty Group, Inc. had discussions regarding the cei1inq and lt
was agreed upon by Defendant Whittle and Defendant D'Angelo
Realty Group, Inc. that the ceiling would be repaired.
30. Beoause of Defendant Wittle's failure to correct know
defeots to the roof, Plaintiff's house is uninhabitable due to
the vast 1eaklng of water through the ceilinq of various rooms of
the hOlJse.
31. Said uninhabitability violates the warranty of
habitability that Defendant Witt1e and Defendant D'Angelo Realty
Group, Inc. orally gave to P1aintlffs.
32. Plaintiffs have BUffered an ascertainable loss Ofl

34. Defendant Wittle and Defendant D'Angelo Realty Group,
Inc. did intentiona11y, knowingly and with fraudulent intent

(Defendant Whittle and Defendant D'Angelo Realty Group, Inc.)
would solve any leaking problems and make the house habitable.
35. Defendant Wittle's and Defendant D'Angelo Realty Group,
Ino.'s representations were made knowingly and intentionally to
deoeive Plaintiffs, and as suoh the Defendants' aotions were
wanton, reok1ess and outrageous.
36. Defendant Witt1e and Defendant D'Anqelo Roalty Group,
Ino.'s representations were with regard to material faots and the
Defendants knew that Plaintiffs were relying on those
misrepresentations when contracting and agreeing for Defendant
Witt1e to make necessary repaIrs to the home looated at 11
Roosevelt Street.
37. Defendant Witt1e and Defendant D'Angelo Realty Group,
Inc.'s misrepresentations were made for the purpose of induolng
Plaintiffs to purchase the home located at 11 Roosevelt street
and were made with the knowledge that Plaintiffs would not have
contracted for the purchase of said home if they would have been
aware that the repairs which Defendant Witt1e would make to the
home would not comply with all applicable oonstruction standards.
38. Plaintiffs have suffered an ascertainable loss Ofl
approximately $13,214.65 for the cost to make the necessary
repairs, $1,000.00 for additional rent slnce October, 1993, whloh
amount will lnorease at a rate of $200.00 per month, sai~ amount
being the rent that Plaintiffs have pald to live in a separate
dwelling beoause of the uninhabitability of 11 Roosevelt Streetl
$385.00 for storage oosta since October, 1993/ which amount will
inorease at a rate of $11.00 per month, said amoun~ being the
amount Plaintiffs pay for the storage of Plaintiff's furniture on

against Defendants LeRoy E. Whittle and D'Angelo Realty Group,

39. Paragraphs 1 through 38 are lncorporated herein by
reterence as if set forth in their entirety.
40. Detendants Witt1e and Defendant D'Angelo Realty Group,
Inc. used untalr deceptive acts or practlces as detined in the
Untalr Trade practices and Consumer Protection Law (hereinafter
"UTPCPL"), Section 201-2(4) (vi) and (vii) with reterence to the
intentlonal and fraudulent misrepresentations and knowlnq
violations of the warranty as set forth above.
41. Defendants Wittle and D'Angelo Realty Group, Inc. are
ln vio1atlon of the UTPCPL, Section 201-3 by using unfair and
deceptlve acts or practices as set forth above.
42. Plaintiffs purchased Defendant Whittle's and Defendant
D'Angelo Realty aroup, Inc.'s repair services for the FHA repalrs
necessary to the home and roof and have suffered an ascertainable
loss Ofl approximately $13,214.65 for the cost to make the
necessary repairsl $1,000.00 for additlonal rent since October,
1993, which amount will increase at a rate of $200.00 per month,
said amount being the rent that Plaintiffs have paid to live in a
separate dwelling because of the uninhabitabl1ity of 11 Roosevelt
streetl $385.00 for storage costs since October, 1993, which
amount will lncrease at a rate of $77.00 per month, said amount
being the amount Plaintiffs pay for the storage of. Plaintiff'.
furniture on aocount of the inhabitability of 11 Roosevelt
streetl plus interest attorneys fees as authorized by the UTPCPL
due to Defendants' use of the aforementioned unlawful or
deceptive acts and practices.
43. The loes regarding repairs in paragraph 42 above,
represents the cost that would be involved in Plaintiffs having
the roof and oelling at 11 Roosevelt street repaired pursuant to
the quotation/proposal attached hsreto as Exhibit "c" and by
referenoe inoorporated herein and made a part hereof.
44. As a diroct result and proximate result of Defendants'
use of unfair deoeptive aots and practioes, P1aintlffs have
suatalned damages as desoribsd in paragraph 42.
WHEREFORE Plaintiffs demand judgment against Defendants
LeRoy E. Whittle and D'Angelo Realty Group, jointly and
severally, for an amount in excess ot Ten Thousand DOllars, whlch
sum does not exoeed the limits requiring oompulsory arbitration,
together with interest thereon, the costs of this suit,
attorney's fees, treble damages pursuant to UTPCPL, seotion 201~
9.2(a), and any further relief this Honorable Court deems proper.
