the Equitable Distribution Claim In the above-captioned divorce action.

The parties hereto, intending to be legally bound, hereby qree u follows:
1. The husband and wife were married on May 2', 1977 In Newville, Cumberland
County, Pennsylvania 17241.
2. The husband and wife have lived separate and apart since March of 1992.
3. The husband and wife Intend to divorce each other and therefore wish to fully
resolve their financial obliaations and property riahts.
4. All personal property has been satisfactorily divided between husband and wife,
and neither party shall make a claim to personal property that is in the possession or conti'l)l
of the othef.
6. The husband hereby relinquishes to the wife all c:lalms to the martial residence,
and proceeds from Its sale, if sale is eventually held, located at 247 South PIU Street,

8. Prom May 28, 1992 throuah lune 6, 1992, the Cumberland County Sherlfrs
Department made unsuccessful attempts to serve the Respondent.
9. On lune 8, 1992, the Court of Common Plw of Cumberland County IlSued an
Order for Continuance of the Temporary Order Issued on May 28 (attached hereto),
10. The Respondent wu never served with the above orders.
11. The Petitioner had no contact with the Respondent from May 1992 throuah
Pebruary 4, 1994.
12. The Petitioner made no attempt to finalize the Prote<:tlve Order because her
COlltact with the Respondent apparently had ceased.
13. The Respondent has not been In the marital residence since the Temporary
Prote<:tlve Order was issued,
14. On Pebruary 4, 1994, the Respondent called the Petllloner to Inform her that he
Intended to return to the marital residence.
15. On Pebruary 3, 1994 and alaln on February 4, 1994, the Respondent called the
Cumberland County Office of leila) Services, which had represented the Petitioner In the prior
abuse acllon, and told someone In the office that he was retumlnl to his residence.
16. The Respondent's presence In the home is not conducive to a harmonious home
life for the Petitioner, lennlfer, and Courtney.
