5. Defendant Lindora Johnson has violated this rule by
failing to file a Brief in support of her Petition.
6. Consequently, Defendant LJ.ndora Johnson's Petition I.'Ihould
be dislllissed.
7. Furthermore, Defendant Lindora Johnson's Petition should
be dismissed beoause she has improperly delayed legal proceedings
in this matter for two years so as to prevent Plaintiff frolll
oonveying the real property in question to a third party. As suoh
Defendant Under.a Johnson has proceeded in bad faith. This
allegation is shown as followSI
8. On November 2, 1989 Plaintiff and Defendant Lindora
Johnson entered into a sales agreement for the property at 1~0-162
Lincoln street, carlisle, PA.
9. In January of 1994 Defendant Lindora Johnson retained
Attorney Gary L. Kelley, Esquire, to negotiate a purchase of the
property in question.
10. A sales price was agreed-upon and a closing date
scheduled for the proposed purchase of the property.
11. However, Defendant Lindora Johnson backed out of the
proposed eale and the sale was never oonsumated.
12. After this failure Defendant Lindora Johnson terminated
Attorney Gary Kelley's services.
13. On February 9, 1994, Plaintiff filed a confesBion of
Judgment in Ejeotment against Defendant Lindon Johnson relative
to the property at 160-162 Lincoln street, carlisle, PA.
14. On March 4, 1994, Plaintiff attempted to sell the
property in question to Eugene and W11ma Jean 'rhomas pursuant to
an executed sales agreement.
15. Sinoe said date Defendant Lindora Johnson, through bad
faith acts, has attempted to void said Aales agreement.
16. In Maroh of 1994 Defendant Lindora Johnson hired Attorney
Anthony Penn to represent her in a Bankruptcy action.
17. On March 8, 1994, Defendant Lindora Johnson filed a
Chapter 13 Bankruptcy Petition.
18. On March 15, 1994, Plaintiff Orlean Elliot filed a writ
of Po.....ion for the promiae. in qu.stion.
19. On March 28, 1994, Defendant I.indora John.on f U.r.t a
Motion to Void plaintiff's Judgment in F.jectm.nt und.r S.ction 522
(f)(l) of the Bankruptcy Code.
20. On March 29, 1994, plaintiff filed a Motion tor R.li.f
from the automatic otay to regain POBBossion of said premises.
21. on August 26, 1994, Bankruptcy Judge Robert J. Woodside
entered an Order requiring Lindora Johnson to amend her Chapter 13
Bankruptcy Plan.
22. on septomber 21, 1994, Bankruptcy Judge Woodside ord~red
that the automatic stay is vacated and lifted with respect to acts
by orlean s. Elliot to enforce her interests in the real property
situated at 160-162 Lincoln street for failure to filed an Amended
Chapter 13 Plan.
23. After this decision Defendant I.indora Johnson terminated
Attorney Anthony Penn a8 her a~torney.
24. In the fall of 1995 Defendant Llndora Johnson retained
the servioes of the law firm of Wolfson , ~ahan.
25. On December 5, 1994, Michelle Pokrifka, Esquire, for the
law firm of Wolfson & ~ahan filed Defendant Lindora Johnson'.
Petition to Open Judgment or, in the Alternative, to Set Aside
Judgment.
26. Pursuant to said Petition the parties took deposition.
over Il onll year period on seven different oocllsions at great
expense to Plaintiff.
n. Miohelle pokritka, ilsquire, 11'1 her MoUon to withdraw as
Counsel represented that she has had no oontaot with Defendant
Lindora Johnson since ootober 9, 199B and that Ms. Johnson owes
attorney'e fees.
28. Once again, by not filing a required Brief by the moving
party in this matter I Defendant Lindora Johnson hap failed to
follow through in a legal proceeding which she has initiated.
29. The effect of paid bad faith acUons by Defendant Lindora
Johnson is to prevent plaintiff for a two year period from
conveying the property in question which has caused plaintiff great
expense.
:)0. said bad faith actions by Defendant Lindora Johnson
provide a further basis for granting plaintiff's Motion to Dismiss.
WHilRilfORil, for. the foregoing reasons this court should grant
plaintiff's Motion to Dismiss Defendant Lindora Johnson's Petition

20. On March 29, 1994, Plaintiff filed a Motion for Relief
from the automatic stay to regain possession of said premises.
21. On August 26, 1994, Bankruptcy Judge Robert J. Woodside
entered an ortler requiring l,indora Johnson to amend her Chapter 13
Bankruptcy Plnn.
22. On September 21, 1994, Bankruptcy Judge Woodside ordered
that the automatic stay is vacated and lifted with respect to acts
by orlenn fl. r-:Jliot to enforce her interests in the real property
situated at lfiO-162 Lincoln street for failure to filed an Amended
C)lapter 13 Plan.
23. After this decision Defendant Lindora Johnson terminated
Attorney Anthony Penn as her attorney.

Respondent, Orlean Elliot, by her attorney, Peter B. Poster,
answers the Petitioner's P~tition as followsl
1. Admitted.

6. AdMi tted. At the time of default peU Uoner had made
payments of only $3700.00 sinoe 1989 on the purchase price of
$20,000.00. In addition, she had failed to make any installment
payments since Maroh of 1993/ had failed to pay $1860.00 in
property taxes required under the agreement and had failed to
maintain the property as required under the agreement.
1. Admitted in part and denied in part. Admitted that on
January 3, 1994, Respondent gave Petitioner notioe of her default.
Denied that Respondent did not inolude the right to oure in the
notioe. On the oontrary Respondent gave Petitioner notioe of the
ri9ht to cure in Paragraph 4 of the notice.
8. Admitted in part and denied in part. Admitted that on
February 9, 1994 Respondent oonfessed judgment in ejectment against
Petitioner. Denied that Respondent failed to properly notify
Petitioner. On the oontrsry Respondent properly notified
Petitioner in her letter of January 3, 1994.

Opinion was filed by the Honorable Robert J. Woodside on or about
AU9ust 26, 1994 stating that the Reepondent'8 interest in the

automatic stay. On the contrary, the bads for the Judge'.

P.B. 8 401. On the contrary, the Bankruptcy Court specifically

septe~ber 21, 1994, the Bankruptcy Court lifted the automatic stay
to allow Respondent to enforce her interests in the real property
in question. Denied tl1at this was done following a Petition by
Respondent. On the oontrary the Bankruptoy Court rendered its
deoision sua sponte.
18. Denied. It is denied that on or about October 5, 1994,
the Respondent filed a Writ of Possession with the Cumberland
county prothonotary without proper notice to P.titioner. on the
contrary on October 5, 1994, Respondent filed a Writ of Po....sion

20. Oenied. It is denied that upon notiae of the Writ of
Po.....ion, the Petitioner has promptly petitioned thi. Court to
op.n the judgment. After reasonable investigation Respondent ha.
no knowledge of what prompted Petitioner to file her petition to
open judgment and strict proof thereof is demanded at trial.
Further, Petitioner's Petition was not filed in a timely fashion
aooording to the applioable case law.
21. Oenied. It is denied that Petitioner has meritoriou.
defenses to the pending action. Said averment states a conolusion
of law to which no responsive pleading is required.

have broadly dotined a residential mortgage and the Penneylvania
Courte have held that installment sales oontracts for residential
property qualify as a "residential mortgage" under Aot 6. On the
oontrary Petitioner is not atfol'ded the protections of 41 P.S.
Seotion 403 since the Penr~ylvania Courts havo not held that the
salee agreement in this calle qualifies as a "residential mortgage"
given the faots ot this caso in that said building ha~ three units
and Petitioner WIlS an absentee landlord who did not live on the
premises.
25. Denied. It is denied that Respondent has not afforied
Petitioner proper notice according to the Aot 6 provisions and,
therefore, the Petitioner has the continued right to oocupy and
enjoy the premises. On the oontrary ReBpondent has provided
Petitioner with the proper notice. Act 6 is not applicable sinoe

units and Petitioner was an absentee landlord who did not reDids
on the premises.
27. Admitted. On Deoember 14, 1993, Respondents prior
oounsel attempted to transfer said property to third parties
without giving notiol! of default to Petitioner, as requir.ed by said
sales agreement.
28. ,Admitted. It is admitted that in Deoember of 1993
Respondent's prior oounsel had attempted to convey said property
to third parties under a sales agreement whioh provided for a
purohase prioe of $6,000.00 more than the price provided under the
parties' agreement. Said attempted sale was never carried out.
29. Denied. It is denied that the purpose of Respondent in
entering Judgment by confeseion was for the sOle, oaloulated and
improper purpolIl! of attempting to olear the olouded title the
Respondent attempted to oonvey to the Thomss' in Deoember of 1993,

whil~ the Petitioner held a righttul interest in the proporty and
without attording the Petitioner the proper protections under Act
6. On the contrary the purpoBe ot ReBpondent in entering Judgmont
by contession waB to enter proper judgment against Petitioner after
Petitioner had defaultBd under the terms of the Sale. Agreement and
atter ReBpondent had given Petitioner proper notice to cure default
under the terms of the Bales agreement. The purpose tor entering
Baid contession of Judgment was not to attempt to olear the title
Respondent's prior lawyer had attempted to convey to the Thomas'
in December of 1993. The attempted sale to the Thomas' in December
ot 1993 was never consumated. Respondent entered into a sales
agreement tor the purchase of the property with the Thomas' after
tiling the Confession of Judgment in Ejectment and after giving
proper notice. The notice requirements of Act 6 were not
applicable because said sales agreement wall not a "residential
mortgage" within the meaning of Aot 6 since said building contained
three units and Petitioner was an absentee landlord who did not
live on the premises.
30. Denied. It is denied that the Judgment in confession was
a scam delligned to allow Respondent to olear the title to a
traudulent conveyance of real property. On the oontrary the
Confession of Judgment in Ejectment was a proper judgment entered
against Petitioner after Petitioner had defaulted under the terms

of the sales agreement and atter Respondent had given Petitioner
proper notioe to oure detault under the terms ot the sales
agreement. The attempted sale to the Thomas' in Deoember of 1993

pertinent times, knew that the Petitioner had an equitable and real
interest in the residential property. On the contrary the
Confeesion of Judgment 1n Ejeotment was property entered against
Petitioner after Petitioner had defaulted under the terms of the
salee agreement and after Respondent had given Petitioner proper
notioe to oure default under the terms ot tho sales agreement.
Consequently, after the f 11ing of the Confession ot Judqment in
Ejectment on February 9, 1993, Petitioner no longer had a legal or
equitable interest in said real property and, at that time,
Respondent knew that P.titioner no longer had a legal or equitable
interest in said real property.
32. Denied. It is denied that Respondent, at all pertinent
timee, knew that the Petitioner was engaging in good faith
oontinued negotiation ooncerning the sales agreement. On the
contrary, in January of 1994 Respondent gave Petitioner the

opportunity to purohaae the property for the balanoe owed under the
.ales agreement betore Reapondent filed a oonfe8sion ot judgment.
Petitioner aooepted this offer but renec;yed Qn her promi.e to
puroha.e the property tor aaid prioe. consequently, after default
Re.pondent tiled her Confession of Judgment in Ejeotment against
Petitioner on February 9, 1994. At this point Petitioner's rights
to the property were terminated. Therefore, any negotiations for
the purohase of the property under the sales agreement atter this
date were not one in good taith.
33. Admitted in part and denied in part. Admitted that
Respondent refiled a Writ of Possession on ootober 5, 1994. It is
denied that Petitioner has not to date provided the petitioner with
proper notioe under Aot 6, 41 P.S. 401, et seq. or the Pennsylvania
Rule. of civil Procedure regarding possession of real property
under a mortgage and/or sales agreement. On the oontrary the
notioe provisions of Act 6 are not applioable sinoe the sale.

43 . On February 9, 1994 Respondent filed a Confession of
Judgment in Ejeotment against Petitioner for defaulting under the
Bales agreement. Attaohed to Baid Judgment was a "coMplaint".
44. Petitioner never responded to Baid complaint and never
appealed the entry of the judgment against her within the
applicable thirty day appeal period.
45. At the time of the entry of said Confe.sion of Judgmont
in Ejectment, Petitioner was represented by oompetent oounsel, Gary
Kelley, Esquire, who failed to appeal the entry uf said judgment.
46. Petitioner has failed to explain why she didn't appeal
the entry of Baid Judgment and why she did not answer said
Complaint.
WHEREFORE, Respondent requests this Honorable Court to deny
Petitioner's Petition to Open Judgment.

Respondent pur.uant to Artioles of Agreement on March 4, 1994.
48. Relying on the validity of said confession of Judgment
in Ejectment and the failure of petitioner to appeal or attaok said
Judgment the Thomas' put $6000 into improvements of said property.
49. Petitioner did not petition to open said judgment until
December 5, 1994.
50. Consequently, Petitioner iB estopped from attempting to
open said judgment at this late date.
WHEREFORE, Respondent requests this Honorable Court to deny
petitioner'. petition to Open Judgment.

The only thing that would of kept me away would of been death.
3. Orlean Elliot has yet to answer either in person or written
plaintiff,s attorney argument Peter Foster, Esquire has yet
not provided a defendant the same right to crOBS examine
Mrs. Orlean Elliot, neither proof ahe can,t reply in her own
words or written questionare.
4. I further charge Orlean S. Elliot, Eugene Thomas and Wilma
Jean H. Thomas, and Walter Johnson did in fact scheme and plot
together to steal that property from me.
5. Mr. & Mrs. Edward ClolJse made available alld gave me in writtin
a loan of twenty thousl;lnd dollars in order to secure that
building.
6. In December 1993 Eugene and Wilma 'l'homas made telephone
calls to my then attor.ney Tony Penn Esquire seeking information
and attaching my caricature.
7. Eugeno Thomas also told a co worker and friend of defendant
one Lewis Green about purchase in 1993.

ha~ poon aevered due to tho lies and mslipulatione of a piece
of property that the Thomas had no interest in what so ever
until they removed Vickie 1. Coleman from on November 1, 1994
in attempt to cover up the echeme to where they held a eix
thousand dollars they claim they already had put in. The
improvements ae of today has that bUilding in a condemn state
today, only after Hud approvall needed and was done by the
defendant approval.
11. The Thomas went to great extent to keep me off said property
lnVolving the Carlisle Police Dept. and filing of false charges
~ith MeS Correal only to inter drop charges
12. Vickie Coleman (daughter) tenant as well seen Walter Johnson
and the Thomas,s numerous times together spending hours at
a time 50 as she questioned Wilma Thomas (grandmother) concern-
ing what was going on with them.
13. The Thomas,B repeatedly visited Linda Ness, occupant of
bottom apt, along with Wright Parker.
14. Said bad faith actions by Plaintiff and the Thomas,s also
Wdlter Johnson provide further basis for not granting the
Plaintiffs motion to Dismiss solely on the rule.
15. Wherefore, for the foregoing reasons this Court should
nlt grant Plaintiff,s Motion to Dismiss Defendant Lindora
T. Johnson,s Petition to Open Judgement or, in the Alternative

depoBitions and, in support thereof, avers as followsl
~. on February 9, 1994, Plaintiff filed a confession of
Judgment in Ejectment against Defendant Lindora T. Johnson.
2. On December 5, 1995, Defendant Lindora T. Johnson filed
a Petition to Open Judgment, or, in the altarnative, Petition to
strike Judgment.
3. on December 5, 1995, the Honorable Edgar A. Bayley signed
a Rule to Show Cause Order as to why the requested relief should
not be granted and ordered the parties to proceed pursuant to

depositions to develop a reoord.
5. On May 9, 1995, Plaintlff requested the scheduling and
takinq of oral depositions from Diana Mosten and Eugene Thomas to
elicit testimony in support of her case.
6. plaintiff deaires to talte the deposition of Diana Masten
to refute Defendant Lindora Johnson's oontention that the sales
agreemont was orally modifiod and to take the deposition of Eugene
Thomas to introduce and authentic photoqraphs taken of the
apartment in question.
7. Defendant Lindora Johnson's attornoy reBponded by
indioating she was not amenable to participating in the taking of
said depositions.
WHEREFORE, Plaintiff requests this Honorable court to oompel
Defendant Lindora Johnson to attend the Plaintiff'9 depositions of.

Respondent to clear the tttle to a fraudulent conveyance ot real

Petitioner had an equitable and real tnterest in the restdential
property.

Petitioner was engaging in good faith continued negotiation
concerning the sales agreement.
33. The Respondent refiled a Writ of Possession on October
5, 1994 and has not to date provided the Petitioner with proper
notice under Act 6, 41 P.8. 401 et seq~ or the Pennsylvania Rules'
of Civil Procedw'e regarding posse..ion of real property under a
mortgage and/or sales agreement.
34. The entry of the Judgment by Confession against the
Petitioner i8 therefore void and invalid.

agreement by tal ling to make the required monthly payments under
said agreement, by failing to make the balloon payment called for
under said agreement and by failing to pay the real estate taxes
required by said agreement. Plaintif fs have 8erved Defendant
Lindora Johnson with a notioe indicating she was in breach of said
agreement, which is attached as r;xhibi t "B", and said Defendant
tailed to cure said breach wi thin ten (10) days, as required,
thereby being in default. Plaintiffs have served Defendant Walter
Johnson with a notice indicating he was in breach of. said
agreement, whioh is attached as Exhibi t "C", and said Defendant
tailed to oure said breach wi thin tEln (10) daYB, as required,
thereby being in default.
7. Defendants owe Plaintiffs $16,300.00 a8 the balance owed
for the sales price, $1,860.00 for unpaid taxes and $1630.00 for
Plaintiff's attorney's fees.
8. Peter B. Foster, Enquire, an attorney duly authorized to
practioe law in Cumberland county, Pennsylvania, is authorized to
appear for Defendants under Paragraph 11 ( a) of said sales agreement
and pursuant thereto hereby confesses judgement in an amicable
action of ejectment against thEl said Buyers, Walter and Lindora
Johnson, their heirs, assigns, executors and administrators, for

Dear Mr. Kelley,
I represent Orlean S. Elliott who owns the property at 160 and
162 Lincoln street, carlisle, Pennsylvania 17013. You repre8ent
Lindora A. Johnson. On November 2, 1989, Lindora Johnson and h.r
husband, Walter Johnson signed a sales agreement for the purchase
of the property at 160 and 162 Lincoln street, carlisle,
Pennsylvania 17013, with my client, orlean Elliott.
The purpose of this letter is to give your client notice,
through you, that she is in breach of this Agreement. She is in
breach of the Agreement because she and her husband have failed to
make several of the one hundred ($100.00) dollar, monthly payments
provided for under Paragraph 2 of the Agreement. My client has
only received $2700.00 of the $3600.00 oalled for under this
provision.
Secondly, your client and her husband have failed to pay the
property taxes for the property as required by paragraph 4 of the
Agreement. Lastly, your client had hel' husband have failed to
malntain the property as required by paragraph 4 of the Agreement.
Consequently, they are in breach of the Agreement.
rhe purpose of this letter is to give your client notice of
the breaches of the Agreement pursuant to paragraph 11 of the
Agreement. Under paragraph 11 your client has ten (10) days to
cure thele breaches. If these breaches are not cured Orlean

embarrassment, oppression, burden and expense of the

obtain information over objection of the defendant/petitioner'.
counsel, Buch information is irrelevant, scandalous and impertinent
and which has caused embarrassment and oppression in relation to
the motion that was filed. Specific examples of such misconduct
