Defendant Lindora Johnson has violated this rule by failing to file a Brief in support of her Petition. 6. Consequently, Defendant LJ.ndora Johnson's Petition I.'Ihould be dislllissed. 7. Furthermore, Defendant Lindora Johnson's Petition should be dismissed beoause she has improperly delayed legal proceedings in this matter for two years so as to prevent Plaintiff frolll oonveying the real property in question to a third party. As suoh Defendant Under.a Johnson has proceeded in bad faith. This allegation is shown as followSI 8. On November 2, 1989 Plaintiff and Defendant Lindora Johnson entered into a sales agreement for the property at 1~0-162 Lincoln street, carlisle, PA. 9. In January of 1994 Defendant Lindora Johnson retained Attorney Gary L. Kelley, Esquire, to negotiate a purchase of the property in question. 10. A sales price was agreed-upon and a closing date scheduled for the proposed purchase of the property. 11. However, Defendant Lindora Johnson backed out of the proposed eale and the sale was never oonsumated. 12. After this failure Defendant Lindora Johnson terminated Attorney Gary Kelley's services. 13. On February 9, 1994, Plaintiff filed a confesBion of Judgment in Ejeotment against Defendant Lindon Johnson relative to the property at 160-162 Lincoln street, carlisle, PA. 14. On March 4, 1994, Plaintiff attempted to sell the property in question to Eugene and W11ma Jean 'rhomas pursuant to an executed sales agreement. 15. Sinoe said date Defendant Lindora Johnson, through bad faith acts, has attempted to void said Aales agreement. 16. In Maroh of 1994 Defendant Lindora Johnson hired Attorney Anthony Penn to represent her in a Bankruptcy action. 17. On March 8, 1994, Defendant Lindora Johnson filed a Chapter 13 Bankruptcy Petition. 18. On March 15, 1994, Plaintiff Orlean Elliot filed a writ of Po.....ion for the promiae. in qu.stion. 19. On March 28, 1994, Defendant I.indora John.on f U.r.t a Motion to Void plaintiff's Judgment in F.jectm.nt und.r S.ction 522 (f)(l) of the Bankruptcy Code. 20. On March 29, 1994, plaintiff filed a Motion tor R.li.f from the automatic otay to regain POBBossion of said premises. 21. on August 26, 1994, Bankruptcy Judge Robert J. Woodside entered an Order requiring Lindora Johnson to amend her Chapter 13 Bankruptcy Plan. 22. on septomber 21, 1994, Bankruptcy Judge Woodside ord~red that the automatic stay is vacated and lifted with respect to acts by orlean s. Elliot to enforce her interests in the real property situated at 160-162 Lincoln street for failure to filed an Amended Chapter 13 Plan. 23. After this decision Defendant I.indora Johnson terminated Attorney Anthony Penn a8 her a~torney. 24. In the fall of 1995 Defendant Llndora Johnson retained the servioes of the law firm of Wolfson , ~ahan. 25. On December 5, 1994, Michelle Pokrifka, Esquire, for the law firm of Wolfson & ~ahan filed Defendant Lindora Johnson'. Petition to Open Judgment or, in the Alternative, to Set Aside Judgment. 26. Pursuant to said Petition the parties took deposition. over Il onll year period on seven different oocllsions at great expense to Plaintiff. n. Miohelle pokritka, ilsquire, 11'1 her MoUon to withdraw as Counsel represented that she has had no oontaot with Defendant Lindora Johnson since ootober 9, 199B and that Ms. Johnson owes attorney'e fees. 28. Once again, by not filing a required Brief by the moving party in this matter I Defendant Lindora Johnson hap failed to follow through in a legal proceeding which she has initiated. 29. The effect of paid bad faith acUons by Defendant Lindora Johnson is to prevent plaintiff for a two year period from conveying the property in question which has caused plaintiff great expense. :)0. said bad faith actions by Defendant Lindora Johnson provide a further basis for granting plaintiff's Motion to Dismiss. On March 15, 1994, plaintiff Orlenn Elliot filed B writ of possession tor the premises in question. 19. On Mllrch 28, 1994, Defendant Lindora Johnson filed a Motion to void Plaintiff's Judgment in Ejectment under seotion 522 (t)(l) of th~ Bankruptoy Code. 20. On March 29, 1994, Plaintiff filed a Motion for Relief from the automatic stay to regain possession of said premises. 21. On August 26, 1994, Bankruptcy Judge Robert J. Woodside entered an ortler requiring l,indora Johnson to amend her Chapter 13 Bankruptcy Plnn. 22. On September 21, 1994, Bankruptcy Judge Woodside ordered that the automatic stay is vacated and lifted with respect to acts by orlenn fl. r-:Jliot to enforce her interests in the real property situated at lfiO-162 Lincoln street for failure to filed an Amended C)lapter 13 Plan. 23. At the time of default peU Uoner had made payments of only $3700.00 sinoe 1989 on the purchase price of $20,000.00. In addition, she had failed to make any installment payments since Maroh of 1993/ had failed to pay $1860.00 in property taxes required under the agreement and had failed to maintain the property as required under the agreement. 1. Admitted in part and denied in part. Admitted that on January 3, 1994, Respondent gave Petitioner notioe of her default. Denied that Respondent did not inolude the right to oure in the notioe. On the oontrary Respondent gave Petitioner notioe of the ri9ht to cure in Paragraph 4 of the notice. 8. Admitted in part and denied in part. Admitted that on February 9, 1994 Respondent oonfessed judgment in ejectment against Petitioner. Denied that Respondent failed to properly notify Petitioner. After reasonable investigation Respondent ha. no knowledge of what prompted Petitioner to file her petition to open judgment and strict proof thereof is demanded at trial. (Act 6)/ as it relates to residential mortgage debtors. On the contrary said Confession of Judgment and prior notice did have the operative effeot of terminating the sales agreement and giving Respondent possession because Title 41 P.B. 403 et .eq. (Aot 6) is not applioable sinoe the sales agreement is not a residential mortgage for the reasons that said building oontained three units and Petitioner was an absentee landlord who did not reside on the premiel.. Denied. It is denied that the Judgment in confession was a scam delligned to allow Respondent to olear the title to a traudulent conveyance of real property. On the oontrary the Confession of Judgment in Ejectment was a proper judgment entered against Petitioner after Petitioner had defaulted under the terms 8 of the sales agreement and atter Respondent had given Petitioner proper notioe to oure detault under the terms ot the sales agreement. The Respondent, at all pertinent ttmes, knew that the Petitioner was engaging in good faith continued negotiation concerning the sales agreement. 33. The Respondent refiled a Writ of Possession on October 5, 1994 and has not to date provided the Petitioner with proper notice under Act 6, 41 P.8. 401 et seq~ or the Pennsylvania Rules' of Civil Procedw'e regarding posse..ion of real property under a mortgage and/or sales agreement. 34.
