in the above entitled action, upon the within named defendant, to wit I
Linda K. Spagnolo, by making known unto ~inda K. Spagnolo, at 543 South

Commeroe Bank, by its attorneys, METTE, EVANS , WOODSID~,
files the following Complaint in Mortgage Foreclosure.
1. Plaintiff is Commerce Bank, a Pennsylvania corporation
maintaining offices at 100 Senate Avenue, Camp Hill, Cumberland
County, pennsylvania 17011.
2. Defendant, Carmen N. Spagnolo is an adult individual
residing at 1125 Red Hill Road, Dauphin, Dauphin County,
Pennsylvania 17018,
3. Defendant, Linda K, Spagnolo is an adult individual
residing at 543 South Third Street, Lemoyne, Cumberland County,
Pennsylvania 17043,
4. On January 27, 1993, Defendant, Carmen N, Spagnolo
filed his Petition under Chapter 11 of the Bankruptcy Code in
"
the United Statel Bankruptoy Court, Middle Dietriot of
Pennlylvania, Harrisburg Division, CaBe No. 93-00148RJW.
5. By Order of the Honorable Robert J. Woodside, Chief
Bankruptcy Judqe, dated Deoember 20, 1993, Commercs Bank
obtained relief from the automatic Btay to pursue its state law
remedies and to commence this action in Mortgage Foreclolure.
6, On September 27, 1908, Defendants, as Mortgagors,
execut.d an Indenture of Mortgage in favor of Plaintiff, al
Mortgaqee, securing Defendants' indebtedness to Plaintiff
evidenced by their Bond executed on September 27, 1988 in the
original principal amount of One hundred twenty-nine thousand
($129,000.00) dollars, plus interest thereon at the rate
provided in thv Bond, payable with other charges as provided
therein (hereinafter the "Bond"). A true and correct copy of
the Bond 18 attached hereto as Exhibit "A" and made a part
hereof,
7. The eaid Indenture of Mortgage was racorded on
September 29, 1989, in the Office of the Recorder of Deeds in
and for the County of Cumberland, Commonwealth of Pennsylvania,
in Record Book 918 at Page 496 et, seq, (hereinafter the
- 2 -
"Mort'Jage" ). A true and correct copy of the Mortgage 11
attached hereto a. Exhibit "B" and made a part hereof,
8, The property subject to the Mort9age is described with
particularity tharein a. parcel "A". The .treet addres. i. 543
south Third Street, Lemoyne, Cumberland County, Pennsylvania
11043, Defendant, Llnd/\ K. Spagnolo is the pre.ent real owner
of such property.
9. Plaintiff has not assigned the Bond or the Mortgage,
either in whole or in part.
10, The Bond and Mortgage are in default because
Defendants have failed to make monthly payments that are due
and owing for the months of July, August, SF.lptember, October,
November and December, 1993, and a final payment of all
outstanding principal and interest due on January 1, 1994.
Plaintiff provided notice in writing of such defaults to Carmen
Spagnolo on December 28, 1993 and to Linda K. Spagnolo on
October 18 and November 21, 1993. Such defaults are
continuing.
11. The entire indebtedness represented by the Bond and
secured by the Mortgage is now due and payable in full by

Defendants to Pl~intiff. Such indebtedness inoludel principal,
interelt at the rate provided in the Bond, late feel, tax.I,
municipal aseemements or charges, and attorney's commislion and
cOltl of luit.
12, The interest, late fees, taxes, municipal allessmentl
And ohargel and other COlts and expensel al provided in tho
Bond and Mortgage will continue to aocrue until distribution by
the Sheriff of Cumberland County, and are to be computed when
judgment is entered in this proceeding.
13, Defendants are presently liable to Plaintiff for the
