PLAINTIFF'S MOTION FOR CONFIRMATION OF SHERIFF'S SA~E
To the Honorable Courtl
AND NOW, comes the Plaintiff, u.s. Banoorp Mortgage
company, by and through its attorney, Federman and Phelan, prays
this Honorable Court grant Plaintiff's Motion for the following
reasons I
1. on February 14, 1994, Plaintiff, U.S. Bancorp Mortgage
Company, filed a Complaint in Mortgage Foreclosure against
Defendante, Wesley A. Riohoreek and R. Susan Shuttlesworth
Richoreek, in regard to certain property located at RD 12 Middle
Aons, Newville, PA, (hereinafter "property"). Attaohed hereto
made a part hereof, and marked as Ellh tbit "A" ill a true and oorreot
oopy of the complaint.
a. Defendants failed to respond to the oomplaint and a Judgment
by Default in the amount of $59,678.91 was entered against them
on June 3, 1994, and Sheriff's sale of the property soheduled for
the September 7, 1994.
~. In oomplianoe with Pa. R.C.P. 3129.2, the property was
advertised, end notice of the sale was .ent out to all known
interested partie., includir.g the Defendants.
4. Through inadvertenoe, no notioe of the sale was forwarded
to Catherine Anne Bridges (hereinafter "Bridges"), the holder of
a judgment against the defendants, pursuant to a complaint filed
January 29, 1993 to No. 344 civil 1993, whioh judgment wae entered
on July 30, 1993.
~. The property was offered for bidding at Sheriff's sale on
September 7, 1994 and the sole and suooessful bid was by the
foreolosing Plaintiff for oosts of sale.
6. Upon information and belief the property is, and has been,
vaoant and abandoned since at least the time of sale.
7. Beoause of the amount of the judgment obtained by
Plaintiff, there is no equity remaining for distribution,
as evidenoed by the results of the September Sheriff's sale.
8. At no time during tho oourse of the prooeedings have the
Defendant. responded in any way to the foreolosure of the property,
and, given the abandoned condition of the property, it is believed,
and therefore averred, that the Defendants are disinterested in
this !lotion.
9. At no time during the course of tneae proc~edinga hea any
entity contaoted plaintiff with regard to purohaaing the property,
ei.ther at the september 1, 1994 aale or anytime thereafter, deapit.
advertiaing of the aale aa provided by law.
10. Neither Detendant, nor Bridgea, will, in any way, be harmad
or prejudiced by the Court'e granting of the within Motion.
11. Unleaa plaintiff is granted the relief requeated, Plaintiff
will be unable to convey marketable title to the property and will
auffer irreparable harm tor which Plaintiff has no adequate remedy
at law.
