det.ctor that fell from a wall onto Plaintiff's head as

1. Plaintitt Brian Fish, is an adult individual residing at
4:l15 Mumper Lane, Dillsburg, Cumberland COUllty, Commonwealth ot
Pennsylvania, 17019.
". Detendant Appleton papers, Ino. i. a Oelaware oorporation
qualitied to do business in Pennsylvani.a, with its registered
addres8 tor purposss of service at 1635 Market street,
Philadelphia, Oelaware County, commonwealth of PennsylvanJ.a, with
a plaoe ot business looated at :l8~0 Appleton street, Camp Hill,
Cumberland county, Commonwealth ot Pennsylvania, 17011-8099.
3. At all times material to this action Detendant Appleton
Papers, Inc. was in exclusive possession, management and control ot
the premises located at 2850 Appleton street, camp Hill, Cumberland
county, commonwealth ot Pennsylvania,

4. At all times material to thil action, Plaintiff Brian
Fish wal a bUlinels invitee on the premi.e. known a. Appleton
Pap.rD, Ino., at 2860 Appleton street, Camp H111, Cumberland
County, Commonwealth of Pennsylvania.
6. On February 26, 1992, Plaintiff Brian Fish was working
for Ralph E. Jones, Ino., a Paint contraotor, oontraoted by
Oefendant to paint on the premiles ot Appleton Papers, Ino.
6. On February 26, 1992, Plaintiff Brian Fish was .tandinq
at the northwest exit of Oefendant Appleton Papers, Ino., waiting
for an eleotronio door to open, when an improperly mounted motion
sensor mounted at approximately 15-20 feet high, weighinq
approximately 10 lbs., fell from the wall atop the roll top door
striking Plaintiff in the head.
7. The motion sensor and bracket were attaohed to Il blook
wall with four plastio plugs and sorews above a roll top door whioh
oreated heavy vibration when operated.
8. As a result of the impaot of the motion sensor, Plaintiff
Brian Fish suffered severe and permanent bodily injury, inoluding
but not limited to, a laoeration of the .oalp, oonous.ion, oervioal
strain, blurred vision, chronio headaches, loss of memory, and a
hole to the back of his eye.
g. The occurrence of the aforeeaid accidQnt and the injuriee
to Plaintiff Brian Fish reSUlting therefrom were oaused direotly
and proximately by the negligence of the Oefendant Appleton Paper,
Inc., generally and more speoifically al set forth belowl

Appleton Paper, Inc., Plaintitf Brian Fish has sutfered, and
probably will in the future, oontinue to sufter pain and agony to
his qreat detriment and loss.
11. As n result of the negligence of Oefendllnt Appleton
Paper, Inc., Plaintiff Brian Fish has underqone qrlllt phydcal

endure the same for an indefinite period of time in the tuture to
hi~ great physioal, emotional, and finanoial detriment and loss.
12. AI a re.ult of the nlgligenoe ot Oetlndant Appleton
Paper, Ino,/ Plaintitt Brian Fish has be.n, and probably will in
the tuture, be hindered from fttt.ndin~ to his usual daily
aotivities and duties to his great detriment, loss, humiliation and
embarraesment.
13. As a result ot the negligenoe of. Oefendant Appleton
Paper, Ino" Plaintitt Brian Filh, has and probably will in the
future, sufter a loss ot lite'l pleasures, and a olaim i. made
therefore.
14. As a result ot the negligenoe of Defendant Appleton
Paper, Ino., Plaintiff Brian Filh has been oomp$lled, in order to
affect a cure for the aforeeaid injuries, to expend large sums ot
money for medioine and medioal attention, and will be roquired to
expend larqe sums ot money for the same purposes in the tuture, to
his great detriment and 1080.
15. Plaintiff Brian Fish believe6 and theretor avers that hil
injuries are permanent in nature.
16. As a result at the negligenoe of the Detendant Appleton
Paper/ Ino. / the Pl...intiff Brian Fish sustained a loss ot waq.s and

TO THE HONORABLE JUDGES OF THE ABOVE COURT I
The petition of BRIAN FISH, plaintiff above named, by his
attornllYI, HANOLER AND WIENER, petition. this Court under Pa.
R.C.P. 1033, to add the name of hie wife, Valerie, in this action,
and in support therefore avers the followinql
1. Brian Fish is the plaintiff in the above captioned
action.
2. Due to the inadvertence of oounsel, the name of
Mrs. Val.rie Fieh all Plaintiff was erroneously left off the Writ in
this matter. The Writ was filed on February 15, 1994.
3, Pa. R.C,P. 1033 provides I
"A party, either by filed consent of the
adverse party or by leave of court, may at any
time ohange the form of the action, correct
the nama. of a party, or amend his pleading,
The am.nded pleading may aver transactions or
occurrence. whioh have happened before or
atter the filing of the original pleading,
even though they give riee to a new cause of
action or defense. An amendment may be made
to conform the pleading to the evidence
offered or admitted."
4, The Writ was served on Defendant on February 17, 1994.
5. Defendent's oounl.l entered hia appearanoe on Maroh 16,
1!1!14.
6. The Rule to File Complaint was filed on Maroh 18, 1994 by
D.tendant.
7. The complaint wal filed in this matter on April 6, 19!14.
8. Thb aotion is a third-party aotion aridnq Qut of a
work-related injury.
!I. The injury in this oase ooourred on February 26, 1992.
Sinoe 1992, Oefendant haa had multiple oommunications with
Plaintiffs Brian Fish and Valerie Fiah, by both telephone and mail,
regarding settlement of this oase.
10. Aa the statute of limitations has run on this olaim,
Oefendant's oounsel has advised Plaintiff's oounsel that he will
Argue that the statute of limitatione haa run on the olaim of
Valerie Fish.
11. Plaintiff Valerie Fish suffered a loss of consortium and
lociety of her husband Brian Fish beoause of the negligenoe of
Defendant Appleton Papers.
12. This olaim is ol.arly a pendant olaim in this aotion as
opposed to a new olaim or oause of action.
13. Plaintiff's requested amendment will only correct and add
the name of Mrs. Fish in this case, and will not unduly prejudice
the Defendant in any way.
14. Defendant Appl.ton Papers will not be unduly prejudioed
or surprised by this amendment, sinoe Defendant has been aware of
both P,laintiUs Mr. and Mn. ri8h dno. the injury which 18 the
subjeot matter of this oalle, and pl:"ior to the runnin9 of the
applioable statute of limitations.
WHIRIFORI, Petitioner respectfully requ..ts that the Court
grant Plaintiff's p.tition to amend the caption in the above stated

Defendant hae failed to respond to Plaintiff's

the time required by Pennsylvania Rules of Civil Procedure 4006
and 4009. Rule 4006(a) (2) provides, in relevant part, as

Each interrogatory shall be answered fully
and completely unless objected to, in which
event the reasons for the objection shall be
stated in lieu of an answer . . . The
answering party shall serve a copy of the
answers, and objections, if any, within
thirty days after the service of the
interrogatories.
Pa, R. Civ. P. 4006 (a) (2). Similarly, Rule 4009 (b) (2) requires
the answering party who has boen served a request for production
of documents to respond within 30 days after the service of the
request. The thirty day filing requirement for Rules 4006(a) (2)
and 4009(b) (2) is mandatory and the failure to timely object will

result in a waiver to any objections. Lane v. Hartford Aocident
and Indemnity Co., 6 Pa, D. & C.4th 537 (1990).
In the present situation, Defendant was served with
Plaintiff's Interrogatories and Request for Production of
Documents on or about April 5, 1994. Pursuant to Rules 4006 and
4009, Defendant's response to theae requests were due on May 5,
1994. Defendant has had ample time to prepare a response to
these discovery requests. Defendant was reminded on June 15,
1994, of the pending discovery requests. At that time,
Defendant's secretary from Attorney Young's office stated that
"most attorneys do not pay attention to deadlines." To date,
Defendant has failed to supply such information as requested, nor
has Defendant set forth any objections pertaining to the
disoovery requests.

Sanctions may be imposed on a party who fails to comply
with the 30-day filing requirement of Rules 4006(a) (2)) and
4009(b) (2). Several Pennsylvania courts have strictly enforced
the time requirements in the discovery rules. Voael v. Berkley,
40 Pa, D. & C.3d 339, 350-51 (1985). The mildest sanction
ordinarily imposed is an order compelling compliance within a
fixed time thus giving the answering party another opportunity to
comply to requests. RaDoport v. Sirott, 418 Pa. 50, 209 A.2d 421

(1965). However, it the defendant fails to Qomply with another
request directing a responae in this matter, this Court should
consider more drastic or sever$ sanctions.
In the present situation, Plaintiff has attempted to elicit
the response required through informal communioat ions, however,
to no avail. Defendant's unwillingness to comply with the
discovery requests in this matter is detrimental to the interests
of expeditious and efficient administration of justice.
Therefore, this Honorable Court should consider more severe
sanctions in order to elicit the Defendant's reoponme as required
by the Pennsylvania Rules of Civil Procedure.
nl.lrOItI, for all the foregoing reasons, Plaintiff
respectfully requests that this Honorable Court enter an Order
compelling Defendant to supply the information sought in this
Motion within 10 days of the date of said Order of This Court.

AND NOW, come a the Plaintiff, Brian Fish, by and through
his attorneY8, HANDLI. . WI.~R, hereby objects to the li8ting of
the above-captioned case for trial. In support of thi8 objection,
Plaintiff avers as followst
1. Plaintiff, Brian Fish, filed a Complaint in the above-
captioned matter on April 15, 1994, alleging that he was injured
when, due to improper installation, a motion sensor from an doorway
fell on his head.
2. On July 18, 1996, Plaintiff filed a Reque.t tor
Production of a steel metal rod from the camera mounted above the
doorway.
3. On December 6, 1996, Plaintiff filed a Motion to Compel
Response to hi8 request for the above-mentioned steel metal rod.
4. On Cecember 13, 1996, the Honorable J. Wesley Oler, Jr.,
issued a Rule to Show Cause why the above-miBntioned item should not
be produced.
5. To date, Def~ndant haa not produced the steel m~tal rod
requested in Plaintiff's Requeat for Production of Documents, nor
has it responded in an acceptable manner to the request for same.
6. On July 16, 1997, Defendant filed a Praecipe for Listing
Case for Trial, requeeting that t.he trial commence on September 15,
1997, with pre-trial on August 27, 1997.

7. Plaintiff's counsel of record, Carolyn Anner, Esquire,
gave birth to a child on July 4, 1997, and will not be returning to
her active, full-time practice until late September of this year.
8. Furthermore, the request for the steel metal rod is still
outstanding.
9. Plaintiff believes, and therefore avers, Chat if the
abova-captioned case is compelled to commence on September 15,
1997, with pre-trial on August 27, 1997, Plaintiff would be
severely prejudiced in two ways. First, Plaintiff will h!lve a muoh
more difficult task meeting his burden of proof without the
production of the above - referenced steel metal rod.

trial so as to zealously represent Plaintiff.
