accident, and has taken sick and annual leave time for her therapy,
thereby loeinq the benefit of paid vaoation. Mn. Firestone'.

Following her evaluation, she was discharged from the hospital with
m.dlcation and a cerVical collar. She was th.n ..en by her family

phYlllcian on several occasions and received some modalltie. of
therapy on a every other day basis for about six week..
She had been previously employed as a secretary and lost a period
of severlll months of work activity, however, had returned to
employment and "on the date of my evaluation in December 1992 was
working full time.
A review of the past medical history was noncontributory.
Her complaints were referable to discomfort In the cervical area,

although, she denied extremity radiCUlitis, pareathes1as or
augmentation of the pain subsequent to Increasell In Intra-abdominal
pressure manifested by coughing, sneeZing or IItralning at stool.
She had been haVing difficulty with sleeping because of discomfort
In the neck area.
A deta 11 ed examl r.llt I on was per formed and I t was noted she was
capable of holding her head In the neutral position, although,
there was definitely Increased paravertebral mUllcle spallm all well
as tenderness to palpation over the posterior spinous proc,sBell.
Flexion was precluded to twenty degreea with thirty degrees
Extension was performed only to ten degrees with thirty
normal and there was dlmlnlllhed lateral flexion and
rotation.

My Initial Impression referred to this lady as having a cervical
straIn an~ I suggested a conservative course of treatment. She was
given a cervical pillow, nonsterold.1I anl:1-lnflammatory medication
and a course ot ehyslcal therapy Inclusive of hydrocollator packs,
ultrasound, massage, neuroprobe, biofeedback, aquatherapy, stretch
and strengthening. Because of some obvious muscle Imbalance noted
aa well all qlJar<lln'l, nhe WIIS placfld on aome F.Ma Illofeedback.
She was t!valuated by me on November 30, 1992 ,HId appeared to be
experiencing 'I renolutlon of her aymptom c'll"plex since she was
markedly Improved. ^ very detailed examination was again performed
and It wac noted she had some decrease In tenderness to palpation
over the poster lor spinous processes as well as some focal
paravertebral muscle spasm. Neurologically, she remained Intact.
She had been working full time and was simply reassured and advised
to use wet heat at home when necessary. I asked for permission to
reevaluate her should It be necessary.
I felt this lady sustained a significant cervical strain directly
and causally related to the motor. vehicular accident of June 9,
1992. While she had responded qulte favorably to appropriate
measures and 1 considered her prognosis as excellent, I did explain
to her that strain patterns have a proclivity toward exacerbations
and remissions and asked for permission to evaluate her should It
be neceallar y. '

She was next evaluated by me on the 4th of May 1993. At this time,
she had been worklnq full time socretarlal aotlvltles and h.~ the
~~adual onset of discomfort In the cervlcal area with particular
dlstress noted durlnq eleepinq.
Her examlnation revealed increased paravertebral muscle spasm,
posterior splnou/l procass tenduness to palpation and a slqnlf1cant
loss of ranqe of motion In all dlrectlons.
The hand qrasps, blcepB, trlcepB and perlostul radlal reflexes
were present and equal bilaterally. The sensory and motor sy.tems
ware Intact.

It was my impression she had sustained an exacerbation of her
cervical atraln pattern.
She was then referred for biofeedback as well as a surface &:Ma
evaluation wlth stretch and strenqtheninq.
She was then followed by me on several occasions and on the 2nd of
June 1993 appeared to have marked Improvement. She was dlscharqed
from my care at that tlme, aqftln with Instructlons to return should

She was next evaluated by me on the 7th of September 1993. She had
been worklnq and had a chlef complalnt referable to locallzed
discomfort over the poster lor cervical area with some left shoulder
radlcular pattern, althouqh, she did not have a typlcal radicular
pattern, parestheslas or augmentatlon of the paln subllequent to
Increases In Intra-abdomlnal pressure manlfftsted by coughing,
sneezlng or stralnlnq at stool.

Her eMamination again revealed a lose of normal motion associated
with tenderness to palpation over the posterior spinous processes.
Because of the persistence of her symptomatology, r sUl/l/eated a
functional capacity evaluation.
This computer driven functional capacity evaluation revealed that
hllr r&Bulb were valid and conBistent without ulqnll of symptom
maqnification behavior.
According to the US Department of Labor Standards built into the
computer, Bhe achieved a medium level of work activity which would
require lifting and carrying up to fifty pounds occasionally and
twenty-five poundB or less on a mor~ frequent basis. Because of the
fact that her job, as described by the Oictidhary of Occupational
Titles, was a light level of work category, it was felt that work
hardening was not indicated, although, it weB Buggested she undergo
a two week stretch and Bhengthening program to increase her
scapular motion and strength.
Because of several higger pointB in the cervical area, ahe was
seen by the anesthesiologist and underwent injections with
appropriate steroid and analgesic medication. She did have some
benefit follOWing this procedure performed on several occasions.
In July 1994, Bhe developed the onset of weaknesB and pain
to the left upper extremity without other specific trauma.

of thh HRI for your review. She d011l have a moderate shed
paracentral disc herniation at C5-C6. In view of the fact that
this lady denies any prevlouB symptomatology and has had signs and
symptoms, althouqh, at times atypical reqardlnq the neck and left
uppnr extremlty/ I do b~ll11ve there 18 a direct and C811sll1

int.rsection of Rt. 34 and Wagner street in North Middletown
Township. ^ vehicle operated by Jane Firestone was stopped and was
rammed from the rear by ft vehicle operated by the Defendant, Robert
G. snyder, and owned by his grandmother.
The Defendant admitted

clearly the whole time up until acoident.
He contend. that
sunlight from his left somehow diverted his attention or interfered

The Plaintiff, Jane Firestone, was first treated by her family
doctor, then by two orthopedic surgeons, Thomas Green, M.D. and
Bruce Goodman, M.D., for recurrent neck spasms. Mrs. Fir..tone

underwent multiple rounds of p~ysioal therapy, and also reoeived
injections into the neck to alleviate the pain. More reoently/ sh.
lost some function in her left arm, and Or. Goodman eent her for an
EMG/ whioh wae negative, and an MRI, which was markedly positive
for disc herniation at C-5/6 on the left. The diso is pushing into
the spinal oord and accounts for her symptomatology. Dr. Goodman
will be sending her to a neurosurgeon. ^ copy of his final report
is attaohed.
Mrs. Firestone has missed many hours of work lince the
aooident, and has taken sick and annual leave time for her therapy,
thereby losinq the benefit of paid vacation.

and It was noted nhe had somll decrease In tRndernes8 to palpation
over the poster lor spinous processes as well as some focal
paravertebral muscle spasm. Neuroloqlcally, she remained Intact.
she had been working full time and was simply reassured and advised
to use Wllt heat at home when necessary. I asked for permission to
reevaluate her should It be necessary.
I felt this lady sustained a slqnlflci1nt cervical strain directly
and causally related to the motor vehicular accident of June 9,
1992. While she had rospondlld quite favor,lbly to approp~late
measures and I considered her prognosis as llxcllllent, did explain
to her that stri1ln patterns have a proclivity toward exacerbations
and remissions and asked for permission to evaluate her should it

Soe was next evaluated by mQ on the 4th of May 1993. At this time,
she had been working full time secretarial activities and had the
gradual onset of discomfort in the cervical area with particular
distress noted during uleeplng.
Her examination l'evealed Increased paravertebral mllacle epaam,
posterior splno~~ procoBs tenderness lo palpation and a algnlficant
loas of range or motion In all dlrectlonR.
The hand qraspa, biceps, triceps and periosteal radial reflexes
were present and equal bilaterally. The sensory and motor syatema
were intact.

been working and had a chlllf complaint referable to localized
dlecomfort over the posterior cervical area with eome left shoulder
radicular pattern, althouqh, she did not have a typical radicular

Her examination aqain revoaled a 10s8 of normal motion associated
with tenderness to palpat.lon over the pOBterlor spinous proceeses.
Because of the pereiBtence of her Bymptomatology, I suqgested III
functional capacity evaluation.
This computer driven functional capacity evaluation revealed that
hllr resultB were valid an<1 conBlstent without fllgn:l of Bymptom
magnification behavior.
According to the US Department of Labor Standards built into the
computer, she achieved a medium level of work activity which would
require Ilftlnq and carrying up to fifty pounds occaBionally and
twenty-five pounds or less on a more frequent basle. Because of the

fact that her job, as described by th~ Dlctidhary of Occupational
Titles, was a light level of work category, It was felt that work
hardening was not indicated, although, It wan ouqgeoted she undergo
a two week stretch and strenqthenlnq program to Increase her
scapular motion and otrength.
Because of Beveral trigger points In the cervical arllla, she was
eeen by the anesthesiologist and un<1erwent Injections with
appropriate steroid and analqeslc medication. She did have some
benefit following this procedure performed on eeveral occasions.
In July 1994, she developed the onset of weakness and pain
to the left upper extremity without other specific trauma.

instant civil action occurred on June 9, 1992, near the
intersection ot B.R. 34 (Spring Road) and Wagner Street, North
Middleton Township, Cumberland County, Pennsylvania.

reasonable investigation, Detendant, Robert G. Snyder, is without
sutticient knowledge or information to form an opinion regarding
the averments contained in paragraph 3 ot the Plainti!fs' Complaint
that allot t.he Plaintiffe' damage a occurred as a reault ot the
accident, and proof thereof is demanded.
4. Danied as stated. It i8 admitted that the Plaintiff,
Jane Firestone, was waiting to execute a left-hand turn from Spring
Road onto Wagner Street.
It i8 further admitted that the
Dofendant' s vehicle collided with the rear of the Plaintiff's
vehicle. It is denied that the Defendant's vehicle "forcefully
smashed" the rear of the Plaintiff' a vehicle. After reasonable
investigation, Defendant is without sufficient knowledge or
information to form an opiuion regarding the truth of the remaining
averments contained in paragraph 4 of the Plaintiffs' Complaint and
proot thereof is demanded.
5. The averments contained in paragx-aph 5 of the PlaintiHs/
Complaint are conclusions of law to which no response is required.
