Tal .~aTI Prom the birth of Brittany Nicole Haslock on March 27, 1992, and for eix months thereafter, the mother, ~risti Haslock, was her sole caretaker. The mother lived with her brother and sister-in-law for a short time before moving into her own apartment with her daughter. The father, John Featherlin, had minimum contact with the mother during her pregnancy and during the child's first six months, seeing the child only two times, once when the mothor brought the child to Pennsylvania and once when the father went to Massachusetts. In September of 1992, the mother was invited by the paternal grandfather to come with the child to Pennsylvania to reside with the father at his parenta' home, so she could get employment. The mother accepted the invitation and moved in with the father and paternal grandparents. The mother sought employment, and while she worked, the grandparents or father cared tor the child. , I After living at the grandparents' residencs for one year, the mother arranged to establish a residence for herself and Brittany and moved to her current residence in October of 1993. The mother tried to maintain a friendly relationship with the father for the sake Of Brittany. At the end of January of 1994, the mother invited the father to move into her apartment. The partiee relationship deteriorated a few weeks later, and the mother asked the father to leave her residenoe after a violent inoident. The father had thrown a book at her as she slept, overturned tables, and other pieces of furniture inclUding large ohairs, and had thrown heavy objeots around the room, waking Brittany. He continued this violent behavior in Brittany's presence, causing the mother and Brittany to be afraid. The tather left the residenoe after this incident but returned on several occasions and, aocording to the mother's witnesses, was intoxioated and urinated on the property on at least two occasions. The father admitted going to the residenoe on three oooasions, onoe late at night. In early February of 1994, the father filed a custody complaint and a petition for special relief requesting that the mother not be allowed to leave Pennsylvania. The mother had tamily and friends in Miohigan, and the tather feared she would go there with Brittany. At that time the mother had no immediate plan to move out at state. The tather attempted to file a criminal case against the mother when she took Brittany with her to visit a ~riend in Massaohusetts. The mother's intentions were to return to her home in Pennsylvania with Brittany. This court did not find the mother in contempt. A conoiliation oonference was held in April of 1994, after whioh an order was ent~red, giving the mother primary custody and the father alternate weekends and several hours on two evenings a week. The mother has never kept Brittany from her father and has faoilitated his oontact with her. When the father retained counsel after the oonoiliation oonference, he requested and paid for a psychologioal evaluation of the parties prior to the hearing. The mother agreed to participate. stanley Sohneider and Jessica Hart of Guidance Assooiates evaluated the parties. The plaintiff oalled Dr. Schneider as a witness. Dr. Sohneider reoommended that if the mother were moving at this time, Brittany should be with her father I however, he specifically stated that the current schedule oan remain in effect so long a. the mother stayed in the area. In addition to Brittany, the mother has a six-year-old daughter, Ashley Homer, a four-yoar-old daughter, Melissa Masters, and at the hearing was pregnant and due to have a baby in late December, 1994. sinoe the hearing she has had a boy, who resides with her and Brittany. The mother intends to keep this baby in her custody. For reasons which include the mother's employment in the armed services, the mother agreed that her daughters, Ashley and Melissa, be in the oustody of their paternal grandparents. The mother remains in touoh with her daughters through periodio phone oonversations and Brittany speaks with her half-sisters on those ocoasions. The mother's most recent visit with A8hley occurred in the spring of 1994, when ahe went to Michigan for her grandmother" funeral, 8he saw her daughter, Aahley, who live. there. Be.ides her tour in the ermed servioe., whioh included being oalled up in the 1990 Gulf War, the mother has worked in several temporary jobs, held a full-time nurse'. a.sistant position tor one-and-a-half-yeara, and at the time of the hearing, provided child care in her home on a part-time basis. In December she applied tor publio assistance, in part beoause of the erratio support payments from the tather, reoeived at time. on the last day of the month. Testimony at the hearing .howed that the mother has been with Brittany since her birth, providing for her needs on a daily basis. She has taken her for medioal attention when necessary, inoluding her regular immunization shots. She provides regular meals for her and ensures developmental progress, inoluding toilet training Brittany and working to improve her learning and developmental .kills. The rather tftstified that she i. a good mother and that she care. for Brittany. The mother has lived with Brittany in the same large apartment for one-and-a-half-years. She and Brittany have a eupportive baee of neighbor. who are friunds. The mother provide. a schedUle, inoluding regular meale for Brittany, and epende most of her time with Brittany. since Brittany's birth, the mother was away from Brittany only when she worked outside of her home. At the time of the hearing, .he oared for ohildren in her home and inoluded Brittany in daily planned aotivities. The mother has provided pet. for Brittany and all of the mother'. witne.... t..t~fied to Brittany'. fondne.s for the pete. Th. father .ugge.t. that there was a problem with fleas/ however, the mother'. neiqhbor, who is allergio to tleas, testified that she sits tor hours in the house and has no problem with tleas or even with cat hair. She further te.tified that the mother's home i. olean and that the animals are well cared for. The father did not dispute that the mother's home was ad.quate. On two ocoasions, when the father oomplained of .eeing uflea bite.u on Brittany's leg or seeing her .oratching her head, the mother took Brittany to the dootor. The dootor's examination revealed that Brittany had a rash on one occasion and a funqus on the other, and she was t~eated acoordingly. While on. of the pets nipped Brittany on her face, the mother aoted re.ponsibly by taking her to the dootor. The doctor advi.ed her that no stitohes were neoessary. The mother then qot rid of the dog and got Brittany another dog. While the tather raised some conoern regarding Brittany's care, inoludinq a ooncern rsqarding pets, he said Brittany loved her mother very much. Furthermore, the mother has kept Brittany safe from harm, healthy and in a loving environment. The father te.tified that child rearing was the mother's re.ponsibility. The oustody oase was initiated to keep the mother from going to Miohigan. She is not at this time askinq this court to allow her to move from Pennsylvania. She would, however, like to be able to vi.it tamily and friend. with Brittany snd her .on .0 they oan oome to know their relatives, inoluding the mother's other children. Althouqh the mother may request permission from this oourt to relooate in the future, she has no intention of doinq so at this time. She intends to remain in Pennsylvania and to raise her dauqhter Brittany and her new baby here. She has no intention ot denyinq the tather a relationship with Brittany and has not done so in the past. IIIUI Should a mother be denied primary physioal custody ot her ohild where the mother has been Brittany's primary caretaker for moet of Brittany's life, where the statue quo is primary oustody in the mother, where a psychologist has testified that the mother is adequately raising her ohild and approved the ourrent oustody arrangement as long as both parties oontinue to reside in Pennsylvania, and where the mother has recently given birth to a baby boy so that the removal of Brittany from her mother's care would result in the separation of siblinge. UG~.~ In Huao v. HUGo, 430 A.2d 1183, 1185 Cpa. Super. ct. 1981), the Superior Court held that an important taotor in deciding whioh parent ehould have primary cuetody is the tact that lithe removal ot a young child from his [or her) environment . . . bears o~ [the ohild's) emotional well being.1I The oourt held, "the oontinued residenoe of ohildren with one parent may be oontrolling." lJL. In HUgg, the court held that the ten month delay in the partie. cuatody hearing, during whioh time Brittany stayed with the mother, was "not insignifioant" and should be considored at the hearing. Quoting custody ot Phillip" 394 A.2d 989, 992 (pa. Super. ct. 1978), the oourt held that during the preoeding ten months, "attachments to family and environment [had] developed whioh would almost oertainly be a traumatio experience for the [child] to sever." 1!L. at 1186. In the case at bar the mother has been Brittany's primary oaretaker sinoe her birth, oaring for her by herself for the tirst six months, with the father and his parents tor the next year, and since ootober of 1993, in a separate residence. Brittany's fourteen months in her mother's home is far in exoess ot the ten months found to be significant in ~ and has certainly resulted in the attachments desoribed in ~ as traumatio to sever. Furthermore, Brittany appears to be developing normally in the oare of her mother. Indeed, there was ample evidenoe at the hearing to the contrary. Psyohologist Jessioa Hart reported in her evaluation that Brittany'S "activity level and need for attention were judged to be within normal limits." She further said that the mother supervised Brittany appropriately and set limits on her behavior. Sinoe Brittany is developing normally in the custod~ of her mother, and sinoe the mother has been the primary oaretaker, the oourts should not interfere. Although the mother has been the primary caretaker of Brittany, the father hae attempted to di.oredit her abilities by pointing to her pa.t in.tability and her alleged que.tionable moral conduot. However, the Penn.ylvania oourts are very clear that l)"[w)ithout evidenoe of a harmful effeot on the ohild, a parent's pa.t oonduot should have little weight in making a oustQdy deoi.ion," Miohael T.L. v. Marilyn J.L., 525 A.2d 414 (Pa. Super. ct. 1987) and 2) "the ability to oare for the ohild i. to be determined a. of the time of the hearing." ~ at 418. In Miohael T.L., the superior Court reversed the lower court'. finding that cu.tody ohould be awarded to the father .tating that the lower court had plaoed too muoh emphasis on the mother" past behavior. In Miohael T.L., there wa. strong evidence that the mother was sexually promisouous. The lower oourt had found that the mother had been sexually active with a number of men. Furthermore, the lower court had noted that at the time of the hearing, the mother was pregnant with her second ohild and that in addition to having two children, the mother had had at least one abortion. ~ at 416, 417. The oourt determined that the best interests of the ohild would be served by returning the child to the mother. In the case at bar, the mother has .hown that she can provide a stable home life for Brittany and her newborn baby. She has lived in her re.idence since Ootober of 1993 and she held her position at the Church of God nursing home for one-and-a-halt years. Aocording to a witness, the mother lost the job beoau.e of ab.enteeism related to her pregnanoy and her daughter's i illn.... Furthermore, the father has agreed that Brittany lovee her mother and that the mother is a good mother. While it i. true that the mother had ohildren out of wedlook and that two are not presently in her custody, the superior Cour.t noted in Mioha.l T.L~ that "[eJveryone develops a oode of personal conduot. It doe. not tollow that one is entitled to impose that oode on others, or penalize tho.e who do not oonform to it . . . [for example), a judge may believe that it is immoral for an unmarried woman to have sexual interoourse, but he is not for that reason to deny her oustody of her children." 525 A.2d at 420. Furthermore, the Superior Court noted in Hartman v. Hartman, 476 A.2d 938, 941 (pa. Super.. Ct. 1984), that "oustody oannot reasonably be granted on the basis of a parent'. "unsettled past" unless the past behavior lIad an ongoing negative effeot on the child's welfare." (citation omitted). In the case at bar, a. noted above, the psyohologists that the father hired both agreed that the mother was doing an adequate job raising Brittany. The mother has been with Brittany throughout her lite and there is no evidence that any ot her oonduct has had an adverse effeot on Brittany. conversely, the tather has admitted to violent behavior in front of Brittany. Throwing heavy objects and .mashing turniture in front of one's ohild, no matter what the rea.on, i. inexou.able and certainly doe. not contribute to a ohild'8 teeling8 of 8tability and seourity. Furthermore, there was evidenoe that the tather has a history ot alcohol abuse and that at times he deals with the difficulties in life by drinking. Finally, it is important to note that although the father oan boast about his stability, it is a stability rooted in the knowledge that he has parents who will provide him with childcare, II roof over his head, food on the table and emotional support. The mother has no such supportive family network and on her own has stayed in the same home for a year and a half and has provided for all of her ohild's needs. In addition to oonsidering the mother's inoreasing stability and her primary oaretaker rolG, this oourt should also consider the psyohologist's conolusion that the "ourrent sohedule oan remain in effeot so long as the mother stays in the area." The psyohologJ.at was oonoerned that Brittany's relationship with her tather and his family not be severed should thG mother leave Pennsylvania. He supported II continuing relationship with both parents. As the mother hos deoided to stay in Pennsylvania for at least the near future, this can be aohieved by maintaining the status quo. In addition to the faotors mentioned above, this oourt should grant primary physioal custody to the mother because ot the strong polioy in Pennsylvania not to separate siblings. During the hearing the mother was in the last stages ot pregnanoy and, since the hearing, she has had a bllby boy. In Wiskoski v. Wiskoski, 629 A.2d 996, 998 (pa. Super. ct. 1993), the court held, "[II)bsent oompelling reasons to the oontrary, it is the polioy of this commonwealth that siblings should be raised together whenever possible . . . A Parent-Child Observation and Parent-Child Pre.Asse9llment 8S well as clinical Interview was conducted by Jessica Hart, M.A., Psychologist, with John on August 24, 1994 when he brought Brittany to thl! offlco, Brlttony was seen on a second occasion when accompanied by her mother on August 26, 1994 and the same process was completed. Those results are Incruded with this report. You will note that an MMPI.2 was not given to John Featherlln. There were no Issues Identified by anyone who raised eny concerns or questions regarding his behavior, personellty, functioning or relationship with Brittany. Background of the parants Is known to counsel and will not be repeated herein. Sufficient to say that since the conciliation, the parents have been able to successfully share parenting on a ragular basis, However with Krlstl's stated Intent to relocate to Michigan, the situation potentially wl(1 change as will the status of her availability once she gives birth. This Is the expressed concern by John as well as the paternal grandparents regarding their experiences with Krlsll who they present as being unstable, In need of psychological help, question her judgment Bnd sometimes poor supervision of Brittany. The results of Krlstl's MMPI.2 are relevant and are therefore Included. Krlstl produced B valid profile. Individuals with her profllo evidence e balanced RE: Featherlln v. Haslock October 18, 1994 Pege 3 self-appralsel which Includes appropriate self.dlsclosure and self-protection. The velldlty scales suggests that her coping resources are adequate and she has a typlca level of effectiveness In everyday functioning. Affectlvely or emotionally, the results Indicate that emotlonsllnstllblllty Is characteristic. Her scores Indicate the possibility of resentment end hostility. The findings Indicate a verbally expressive Individual who may under-control emotions. Personality plus behavioral characteristics related to Krlstl's profile strongly Indicate eijocentrlclty, e low frustration tolerance and Impulsiveness. Similar clients are seen as Irresponsible, rebellious, adventurous, self-centered and unreliable. They tend to disregard the potential or actual consequences of actions and may not learn from experience. People with her profile ara also seen as childish, onergetlc, Immature, shallow end talkative. Exhibitionism end self-Indulgence mey be present. Sub-scores Indicate a person who Is competitive, flighty, immature, opportunistic and verbelly fluent. Difficulty In delaying gratification and Impulse control problems ere present. Interpersonally, the ability to form warm Intimate relationships Is dllllcult. Such relationships tend to be superficial. Insensitivity to others Is likely. These Interpersonal problems hava their origin In a long history of Inadequate family and social relationships. In fact, Krlstl's experlancas In her own family of origin suggast severe rupture In her relationships with adult caretakers coupled with evidence of being emotlonelly neglected as well as sexually abused by those whom she trusted. In response to a question In the Life Information Script. which asked what childhood stories she liked best, Krlstl Identified Cinderella beceuse "I always wished that someone would take me away to be happy". In this examiner's opinion. this seems to be a most edequate reflection of Krlsll's behavior patterns especially with members of the opposite sex. The findings Indicate that Krlstl's current parental behavior patterns with Brittany are sometimes questionable under even observed conditions. This examiner had an opportunity to obs~rve Krlstl and Brittany on Ser.tember 1 1994, when Krlstl brought Brittany to her session. At that appolntmen , Krlstl related to Brittany, "Children should be seen and not heard" and later It was obsarved that Brittany was climbing on the chair and table without Krlstl evidencing much concern about her safety. This was done while Krlstl was finishing one of the custody related Instruments (Parent Sentence Completion Test). Through the course of that session, It was noted that Brittany expressed a preference for her father end grandmother and It was Krlstl's explanation that "she (Brittany) knows It's her day with her dad". RECOMMENDATIONS: Based on the findings. we are recommending that primary physical custody be placad with the natural father. However, the current schedule can remain In effect so long as Krlstl stays In this area. Should sha decide to relocate, It appears to be for har benefit only. The findings Indicate that Brittany Is aware of the adult caretakers she has bonded to who Include her father end mambers of the CUSTODY EVALUATION RE: Brittany Haslock Page 2 playing with a cousin, Brittany loves animals, Mr, Feetherlln Indicated that Brlttany's ability to walt Is above average, Her eblllty to separate from her parents Is gradually Improving, Mr, Feathorlln reported that Rrlttany sometimes cries and tells her father she does not want him to go, Brittany does not take any medication on a reguler basis, She Interacts well with adults and peers. According to Mr. Ff;latherlln, Brittany can put on her pants and her shoes. She Is stili learnrng how to put socks on. She Is almost toilet trained and enjoys taklnll a bath. Brltteny Is generally quiet and well behaved at the doctor's office. She exhibits good behavioral control when shopping or at restaurants, Mr, Featherlln Indicated that Brittany tends to be shy at first with strangers but she gradually warms up, He Indicated that she has no unusual fears and no heelth problems, Brltteny Is described as an affectlonete child who often gives the adults In her life hugs and kisses. When asked to describe the parenting met.hods that he uses, Mr, Featherlln reported that he tells Brittany to stop Inappropriate actions. If this does not work, he uses e sterner warning, In some cases, he may smack her hand or sit her on a chair. A Parent-Clll1d Observation was used to sample family Interactions, During this observation, Brittany was observed with her father, Brltteny's Interactions with her father were extremely positive, Mr, Featherlln sat at a small round table with his daughter. He pertlclpated In her play and he provided good supervision, Brittany often crawled on her father's lap and was very affectionate with tllm. She laughed and giggled as she talked on the play phone, She also got out the toy dlsl'\es end utensllll and prepared e meal for her father. Throughout the observation session, Brittany's attention span and need for attention were both judged to be within normal limits. Mr, Featherlln appeared to be responsive to his daughter's needs and he often gave her positive feedback regarding her actions. He effectively set limits on Brittany's behavior and she complied with all of her father's requests. On August 26, 1994 the Parent-Child Pre-Assessment was administered to Ms. Haslock to obtain Information regarding Brltteny's behavior In a variety of settings. Ms, Haslock reported that Brittany tends to be slow to wake up In the morning, Although she usually wakes up at 6:00 am, she sometimes sleeps later If her mother does not have to get up to go to work. Ms. Haslock reported that Brittany eats breakfast et a small table with her dog. At lunch time, she eats at a table with her mother but continues to want to share her food with her dog, Abby, Brittany reportedly uses a spoon end fork to feed herself, With regerd to fiedtlme, Brlttany's mother reported that she sometimes falls asleep In a chair at night. On some occaslonsh Brittany asks her mother to lay down with her In bed. Brittany usually sleeps t rough the night but sometimes talks In her sleep. Ms, Haslock Indicated thet Brltteny enjoys helping her mother cook and bake. Brittany likes to telk on the phone, especially to her father, Brlttany's favorite activities Include pretending to cook, listening to Disney sing-a-long tepes, playing with a baby doll, apd playing outside with balls end her dog. Ms. Haslock reported thet Brittany's ability to follow directions Is variable, She Indicated that Brittany becomes more oppositional efter visits with her father. A!ter visits with hllr father, Brittany sometimes says "No" or "I don't want you', Brittany does not throw temper tantrums when her requests are denied and/or she encounters a problem. Brittany reportedly takes good care of her toys and loves animals. She does not take any medication on e re~uler basis. Ms. Haslock Indicated that Brittany does have e "wheezing problem when she gets a cold. Brittany Is well behaved at the doctor's office, She also seems to enjoy gqlng shopping and to restaurants. According to Ms, Haslock, Brittany Is afrald of monsters, Ms. Haslock Indicated that Brittany's desire to give hugs and kisses to her mother "depends on her mood". Regarding parenting methoosL, Ms. Haslock reported that she uses distraction end trickery. She also tells I:1rlttany "No", On some occasions, Ms. Haslock spanks Brittany or puts her In time out. A Parent-Child Observation was conductad to sample family Interactions. In this observation, Brittany was observed with her mother. Brittany's Interactions with har mother during this observation were positive. Shl,! saemed to enJoy' contact with her mother and she laughed while she plaved with har, Brittany and her mother conversed throughout the observation session. Ms. Haslock actively participated In her child's play, Brittany play'ed with the marble track and a doll house. She also got out the toy baking and kitchen utensils. Ms. Haslock showed her daughter how to C\lt up pizza. Ms. Haslock also got out the xylophone end showed -Brittany how to play ft. She asked Brittany to name the colors of the keys on the xyl9phone. Brittany and Ms. Haslock were physically affectionate with one another. Ms. Haslock tickled Brittany and asked her for a hug. Brittany Initiated a game of "you can't cotch me". She hid from her mother under the table and lau"hed and glgglad as her mother attempted to find her. Throughout th" observation session, Brittany's activity level and need for attention were Judged to be within normal limits. On February 24, 1994, a pre-hearing Custody wos scheduled by Order of Court to resolve the dispute for custody of minor child. On or about February 26, 1994, Defendant removed minor child from Cumberland County, Pennsylvania, ignoring the Order ot February 22, 1994. Defendant's brother, Jeff Haslook of Ayer, Maasachusetts, reported Defendant to Polioe authorities as a tugitive of justice and Defendant was arrested on suoh charges. A hearing was held on February 28, 1994, in Ayer, Massaohusetts and Defendant was released on her own recognizanoe. On February 28, 1994, Plaintiff submitted a Petition for Speoial Relief requesting consideration for temporary physical custody of minor ohild. A Petition for Contempt was also filed requesting a warrant be issued to defendant for Contempt of Court. On March 2, 1994, an Order was issued for the return of minor ohild to the jurisdiction of the Court and a hearing was scheduled to be held on March 9, 1994, for the Defendant's contempt of Court. At this hearing, Plaintiff entered a Motion for temporary physical oUstody of minor child pending outcome of custody 3 , '. complaint and an Order was issued granting joint physical custody of minor ohild and speoifically ordering that minor ohild not be romoved from the state of Pennsylvania. In Sept.ember of 1992, at the invitation of Wendell Featherlin, Kristi And Brittany moved to Pennsylvania into the home of Mr. and Mrs. Wendell Featherlin. John W. Featherlin Also resided in this home. Kristi and Brittany lived with the Featherlins from September 1992 until Ootober 1993, at which time Kristi obtained her own apartment.
