WHEREAS, the parties hereto did on the ~ day of pECEM~R ,
1993, entet' into an aQreement (hereinafterthe "Contr~ct'I, tnerelr,
and whereby ~aid Contractor undertook and aQreed to furnish a~~
materials, labor, equlpment, lItc" to complete tr.e work of the
Renovations and Additions to the Cumberland County Office BuildinQ
located in Carlisle, pennsylvania, more particularly described as
follQWS I
s.aid parcel of Qround is located in the city of carlisle,
pennsylvania,
NOW, THEREfORE, the Contractor for itself and any and a~~
subcontractors, ma~,erialism and parties actinQ for, through or
under the Contractor or for, throuQh or under .any of them, jees
covenant and .aQree that it will not at any time suffer or per~l:
any mechanics' lien or any other lien, attaci"Jl1ent or other
enc~~rance, under nay laws, reQulations or orders, federal, Sta:a
or local, or otherwise, by any person or persons whomsoever, to be
put or remain on the buildinQ or premises, into or upon which any
work ie done or labor or materials are f'Jrnished under thls
Contract, for such work, labor or material, or by reason of any
other claim or demand aQainst the Contractor, and the Contr~ctor
has not obtained absolute title/ and the Contractor aQrees,
further, that any mechanics/ liens, materialmen'S lien or any other
lien, attachment or other encumbrance or claim of a third party,
however arilinq (whether throuQh the Cont::actor' s or Owner's or any
other persons action or inaction, and whether valid or invalid),
until it il removed Ihall preclude any and all claim or demand for
any payment whatloever under or by virtue of the Contract, and, in
the event that .ame il not removed, the owner at its dilcretion may
remove lame at the expenl. (includinQ leQal f.es) of the
Contractor, and without reQard to the validity or invalidity
thereof,
