COM P L A I N T
1. Plaintiff, FEDERAL NATIONAL MORTGAGE ASSOCIATION, is a
oorporation originated under an Aot of congress and existing pursuant
to the Federal National Mortgage Assooiation Charter Aot, with a
Servicing Agent of Margaretten & company, Inc., having an office at
201 East cery street, Post Office Box 26388, Richmond, Virginia
26388-6388.
2. Defendants, Robert A. Griffiths and Reni E. GriffithS, are
adult individuals whose last known address is 38 West ~eller street,
Mechanicsburg, Pennsylvania 17055.
3. On or about May 29, 1975, said Defendants executed and
delivered a Mortgage Note in the sum of $26,000.00 payable to Bogley,
Harting, Mahoney & Lebling, Inc., (original Mortgagee), a copy of
whioh Note is attached hereto and marked Exhibit "A".
4. contemporaneously with and at the time. of the exeoution of
the aforesaid Mortgage Note, in order to secure payment of the same,
Defendants made, executed and delivered to original Mortgagee, a
oertain real estate Mortgage whioh is reoorded in the Reoorder of
Deeds Offioe of the within county and Commonwealth in Mortgage Book
589, Page 952, oonveying to original Mortgagee tho subjeot premises.
The mortgage was assigned to Federal National Mortgage Assooiation,
and reoorded in Book 215, page 275 on June 5, 1976.
6. The land subjeot to the Mort9age iSI 38 West Reller
street, Meohaniosbur9, Penn~ylvania 17055 and ls more partioularly
desoribed in Exhlbit "B" attaahed hereto.
6. The said Defendants are the real owners of the land
subjeot to the Mortgage.
7. The Mort9age is in default due to the faot that Mortgagors
have failed to pay the installment due on April 1, 1993 and all
subsequent installments thereon, and the following amounts are due on
the Mortgagee
(a) Unpaid prinoipal balance $
(b) Interest at $3.14 per day
from 3/1/93 to 1/31/94
(based on oontract rate of 8.5%)
(0) Accumulated Late Charges
(d) Esorow defioit
(e) 5% Attorney's commission

-Together with interest at the per diem rate noted in (b) above after
January 31, 1994, other charges and costs to date of Sheriff's sale.
The attorney's fees set forth above are in conformity with the
Mortgage doouments and Pennsylvania law, and will be oolleoted in the
event of a third party purohaser at Sheriff's Sale. If the Mortgage
is reinstated prior to the sale, reasonable attorney's fees will be
charged that are actually incurred by Plaintiff.
8. No judgment has been entered upon said Mortgage in any
jurisdiotion.
9. Notioe of intention to foreclose and to accelerate the
loan balanoe has been given to the ~ortqagors in acoordanos with
Seotion 403 of Pennsylvania Act No.6 of 1974, but the ~ortgalJors
havs failed to reinstate the Mortgage in accordance with the I
provisions thereot. A copy of the Notice is attached hereto and made
a part hereof as Exhibit "C".
10. Defendants are not members of the Armed Forces of the
United states of America, nor engaged in any way whioh would bring
them within the Soldiers and Sailore Relief Act of 1940, as amended.
11. Plaintiff has complied with the procedures required by
Pennsylvania Act 91 of 1983 (Homeowners' Emergency Mortgag~
Assistance Payments Program) and Defondants have either failed to
meet the time limitations as set forth therein or have been
determined by the Housing Finance Agency not to qualify for
assistance.
WHEREFORE, Plaintiff demands judgment in mortgage foreclosure
against Oefendants for the aforementioned total amount due together
with interest at the rate of 8,5% ($3.14 per diem), together with
other charges and costs inclUding escrow advances incidental thereto
to the date of Sheriff's Sale and for foreclosure and sale of the
property within described.

1. Plaintiff, FEDERAL NATIONAL MORTGAGE ASSOCIATION, i. a
oorporation originated under an Act of Congress and existing pursuant
to the Federal National Mortgage Association Charter Act, with a
Servicing Agent of Margaretten & company, Inc., having an office at
201 East Cary Street, Post Office Box 26388, RiChmond, Virginia
26388-6388.
2. Defendants, Robert A. Griff.iths and Keni E. Griffiths, are
adult individuals whose last known address is 38 West Reller Street,
Mechanicsburg, Pennsylvania 11055.
3. On or about May 29, 1975, said Defendants executed and
delivered a Mortgage Note in the Bum of $26,000.00 payable to Bogley,
Harting, Mahoney & Labling, Inc., (original Mortgagee), a copy ~f
which Note is attached hereto and marked Exhibit "A".
4. contemporaneously with and at the time ot the execution of
the ator.said Mortgage Note, in order to secure payment of the sam.,
D.f.ndants made, ex.outed and delivered to original Mortgage., a
o.rtain real estate Mortgage which is recorded in the Recorder of
Deeds Offioe of the within County and Commonwealth in Mortgage Book
589, Page 952, conveying to original Mortgagee the subject premi....
The mortgage was assigned to Federal National Mortgage Association,
and recorded in Book 215, paqe 275 on June 5, 1975.
5. The land subjeot to the Mortqaqe iSI 38 West Reller
street, Meohanicsburq, Pennsylvania 17055 and ie more partioularly
de.oribed in Exhibit "B" attaohed hereto.
6. The said Defendants are the real owners of the land
eUbject to the Mortqaqe.
7. The Mortqaqe ie in default due to the taot that Mortgaqors
have tailed to pay the installment due on April 1, 1993 and all
subsequent installments thereon, and the fOllowing amounts are due on
the Mortqaqel

The attorney's fees set forth above are in conformity with the
Mortgaqe documents and Pennsylvania law, and will be collected in the
event of a third party purohaser at Sheriff's Sale. If the Mortgage
is reinstated prior to the sale, reasonable attorney's fees will be
charged that are aotually incurred by Plaintiff.
8. No jUdgment has been entered upon said Mortgage in any
jurisdiction.
9. Notice of intention to foreclose and to accelerate the
loan balanoe has been given to the Mortgagors in aooordanoe with
Seotion 403 ot Pennsylvania Aot No. 6 ot 1974, but the Mortgagor.
have tailed to reinstate the Mortgage in aooordanoe with the
provi.iona thereot. A oopy ot the Notioe is attaohed hereto and made
a fart hereot a. Exhibit "C".
10, Detendants are not members of the Armed Foroe. of the
United States of Amerioa, nor engaged in any way which would bring
them within the Soldiers and Sailors Relief Act of 1940, aa amended.
11. Plaintiff has oomplied with the procedures required by
Pennsylvania Act 91 ot 1983 (Homeowners' Emergency Mortgage
Assistanoe Payments Program) and Defendants have either failed to
meet the time limitations as set forth therein or have been
determined by the Housing Finance Agency not to qualify for
assistance.
WHEREFORE, Plaintiff demands judgment in mor.tgage foreolosure
against Defendants for the aforementioned total amount due together
with interest at the rate of 8.5\ ($3.14 per diem), together with
other oharges and oosts inoluding oscrow advances inoidental thereto
to the date of Rheriff's Sale and for foreclosure and sale of the
property within desoribed.
