Kunkle entered Into a contract wilh Defendant, acting through its AdvertlslnglMarketing Manager Charles N, "oak, whereby Plaintiff alreed to display one (I) outdoor advertisina sign advertislnl Davenport's restaurants on Rt. 283 north of Route 30 In Lancaster, Pennsylvania. Pursuant to the Contract and in consideration for the advertising provided by Plaintiff, Defendant agreed to pay Plaintiff the sum of One Thousand, Nine Hundred Forty-two Dollars ($1,942.00) per month. 8. Plaintiff performed Il~ obligations under the contract by displaying advertising on behalf of Defendant for a period of twelve (12) months beginning on or about December 20, 1992. 9. To date Defendant has paid Plaintiff Twenty-one Thousand, Three Hundred, Slllty-two Dollars ($21,362,00) leaving an outstandlna balance owed to Plaintiff of One Thousand Nine 3 Hundred f/orty-two Dollar~ ($1,942.(lO). 10. Plaintiff has sent Invoices to DefenwUlt for Ihe amount due under the Contract, II. In accordance with the contract, Defendant has aal'eed to pay attorney's fees of IO'Wi of any dama2cs (I.e, $194.20) If Ica81 action Is taken to collect money owed by Defendant under the contract. Davenport's restaurants on Rt. 283 norlh of Route 30 In Lancaster, Pennsylvania. The slln was to be displayed for Ihirty-slll (36) monlhs, beglnninl on or about December 20, 1993. Pursuant to the Contract and In consideration for the advertisina provided by Plaintiff, 4 Defendant aJreed to pay Plaintiff the ~um of Onc Thousand l!ight Hundred Ninety Dollars (SI,890,oo) per month. l~. Plaintiff pclrformed Its oblll!ations pursuant to the terms of the Contract by displaying the outdoor advertising slIP on behalf of Defendant and continues to do so, 18. Plaintiff has sent invoices to Defendant for the amount due under Ihe Contract. 19. Despite repeated demands by Plaintiff, Defendant has failed or refused to pay Plaintiff . the balance due under the Contract of Threc Thousand, Seven Hundred, Eiahty Dollars (S3,780.oo) which amount Increases at the rate of $1,890.00 per monlh. 20.
