NOW COMES Detendant Frank W, Jackson, M.D., by and through
hie counsel, ~eeter, Wood, Allen' Rahal, and moves this
Honorable Court to dismiss with prejudice the above-captioned
matter tor plaintiff's failure to prosecute this action, averring
as tollowsl
1, Plaintift, Dorothy I. Deppen ("Deppen"), instituted the
above-captioned action against defendant, Frank W, Jackson, H,D.
("Jackson"), by writ of summons on February 17, 1994.
2. Deppen has shown a want of due diligence in failing to
proceed with reasonable promptitude I there has been no activity
on the docket other than the tiling of the writ of summons, no
formal di.covery ha. been conducted by either party, and Deppen
has never communicated with Jackson regarding the basis tor this
action,
3. There is no compelling reason for Deppen'. delay in
proceeding with this action,
4. Deppen's delay in proceeding with this action has
prejudioed Jaoksonl the docket for this action has been inactive

for a period of 1lI0re than two yean, thereby r"ult:1nq in a
pre,ullIption of prejudice.
5, Under Penneylvania law, an order to di'llIie. tor lack ot

WHEREFORE, Jackson respectfully requests this Honorable
Court to grant his llIotion to dismiss for lack of docket activity
and to enter a judgment of non pros with prejudioe in favor of
detendant Jackeon and against plaintiff Deppen.
