1. The plaintiff, Angela E. Spelas, hereinafter referred to
as the mother, resides at 309 Elsventh Street, Apartment 2, New
Cumberland, Cumberland County, Pllnnsylvania 17070,
2, The defendant, Daniel M, Spelas, herllinafter referred to
as the father, resides at an addrlls5 unknown to the mother in
York County, Pllnnsylvania,
3, The part ie5 are the parents of Joshua Danilll, Danielle
May and Amber Lauren Spelas.
4, On or about February 16, 1994 a Complaint for Custody
was filed in the above-captioned matter by the mother, A
conciliation conference i5 not yet scheduled,
5, The mother has been thll primary caretaker of thll
children since their birth.
6, On or about January 19, 1994, the father took the
chi Idren for a one week visit. Despite repeated requests by the
mother to the father to return tho children, he refuses to do so
and denies reasonable telephone contact between the mother and
the chi ldroll,
7. The mother believes that the father is falling to
provide adequate medical care to the children, To the best of
the mother's knowledge, the youngest child has had a severe rash
for at hut three weeks, and the father has not taken the chi ld
to a doct.or,
8, The mother believes that the children are being shuffled
between three babysitters and various relatives and that the
children require a more stable environment than what they
currently have, The mother is better able to prOVide a stable
and caring environment.
WHEREFORE, the plaintiff requests that this court enter a
Temporary Order ordering the immediate return of the children to
the plaintiff and granting immediate primary custody of the
children to the plaintiff and partial custody to the defendant
every other weekend from Friday at 7:00 p.m, unti I Sunday at 7:00
p.m, until further Order of Court.

AND NOW, thi. 15th day of Maroh, 1994, the Court
held a hearing today on a petition tor epecial relief tiled by
Deniel M. spe1ae conoerning hi. three ohildren, Joahua, born
Maroh 11, 1989/ Danielle, born May 28, 1991/ and Amber, born
July 15, 1992,
The parties have been separated einoe 1993, The
children were in the primary custody of their mother until
Jenuary of 1994 when by agreement ot both the mother and father
they .pent one week with the tather and then the euooeeding week
with the mother.
On January 19th, 1994, the father qot cuetody of the
three children and refuaed to return them to the mother, I
aiqned an order on February 18th, 1994, direoting that the
children be returned to their mother with partial ouatody in th~
tather every other weekend trom Friday at 7100 p,m, until Sunday
at 7100 p.m,
on or about February 17th the cuatody conoiliator for
Cumberland county by order set a hearinq between the partiea on
the cuatody iaaue for April 7th, 1994, at 9130 a.m. I believe

and trequsntly must leave town, and sinoe in his care, the

January 19, 1994, he has not acted in the children's best
interest by denying the mother contact with the children in spite
ot the mother's repeated requests and a request by the mother's
tormer counsel,
sinoe January 19, 1994, the mother has also been
denied reasonable phone contaot with the children,
10. Eaoh parent whose parental rights to the
children have not been terminated and the person who has physioal
custody ot the ohildren have been named as parties to this
action,
WHEREFORE, the plaintitt requests this Court to grant
primary custody ot the ohild to the plaintitt and partial oustody
to the detendant every other weekend trom Friday at 7100 p.m.

The Defendant, Daniel M, Spelas, by and through his attorney,
John D. Briggs, Esquire, represents the followingl
1. On February 18, 1994, in an ex parte prooeeding, the
Plaintiff obtained primary oustody and limited the Defendant' s
oustody to every other weekend front Friday at 7100 p,m, until
sunday at 7100 p.m, The Defendant was not provided with any notioe
of the proceeding, was not informed of the filing of any aotion for
oustody and was denied an opportunity to be heard,
2. On February 22, 1994, the polioe entered the Defendant's
premises and obtained oustody of the ohildren under oolor of the ex
parte Court Order,
3. There exists neither a formal oustody agreement nor a
prior oourt order. Furthermore, there is no established history of
oustody following the parties separation on November 26, 1993,
Rather, oustody has been exohanged at irregular intervals,
4, The parties are the parents of Joshua Daniel, Danielle
May and Amber Lauren Spelas,
5. The father has maintained primary and exolusive oustody
of the three ohildren since January 19, 1994 with the Plaintiff'_
oonsent and at her request,
II. sinoe the beqinninq of January, 1994, Plaintiff hu been
evioted from two aeparate residenoea, thereby aerioualy ql~e.tioninq
the Plaintiff'a ability to provide the ohildren with a atable
environment,
7. To the best of the Defendant'a knowledqe, the Plaintiff
haa no eetablished residenoe.
8. Plaintiff hu told the defendant that ehe tried to kill
herlelf on three ~eparate ocoasiona.
9. On two aeparate occas ions, when the ohi ldron returned to
their father for visitation, it was observed that Joshua .uffered
a larqe cut and bruise aoross the left side ot his face and that
Danielle suttered a broken nose and a larqe cut across her atomach,
both of which ocourred while in the Plaintiff's custody.
10. When the children were stayinq with the Plaintiff at the
Wealey Park residenoe, the landlord e)Cpre.led concern for the
weltare of the children and informed the Defendant that the
Plaintiff was throwinq parties which resulted in the polioe beinq
8ummoned to the premises on more than one oooasion.
11. Plaintiff has repeatedly and explioitly told the
Defendant that the ohildren are ruininq her life and that she no
longer wants them, On or about Deoember 22, 1993, the Plaintiff's
own sister asked the Defendant to remove the ohildren from the
Plaintiff's oontrol beoause she was ooncerned for the ohildren.'

12. When the Plaintiff has provided custody of the ohildren
to the Defendant, she presented the children in a state of neqlect.
13. Plaintiff has misused the funds allocated to the children
and paid to her by Defendant on previous ocoasions.
14. The Defendant has provided for the best interests of the
children at all times and has diligently oared and provided for the
ohildrens' needs,

John D, Briggs, Esquire, represents the following I
1, On February 28, 1994, the Defendant's patition for
speoial Relief was filed with the court, and served upon opposing
oounsel by hand delivery. A copy of this petition and its
transmittal letter are attached hereto as Exhibit "All and
inoorporated herein by reference,
2, sinoe the date of filing of the Defendant's original
petition, additional facts have come to light,
3, It is believed and therefore averred that the children
are being abused while in the Plaintiff's custody, The Defendant
has observed burn marks on his daughter's hand and has been given
additional information concerning potential sexual abuse,
4, The Defendant is ooncerned about the health, safety and
welfare of his children and requests immediate relief as they may
be in danger of. further injury,
5, The current order does not refleot the status quo.

1. On March l!l, 1994, a hearing WIl8 held ooncerning the
Petition for Emergenoy Relief filed by Defendant, Daniel H, Speln.
2. At the hearing, Mr, Spelas was prevented from te.tifying
that his five year old son, Joshua speln, told him that he was
being hit by the Plaintiff's boyfriend and that his mother WIl8
hitting his sisters in the faoe. The basis for the JUdge's
deoision was that the testimony was hear.~"
3, The trial Judge agreed to take the testimony ot the
ohildren, inoluding Joshua Spolas, at the request of the
undersigned ooun.el.
4, The trial Judge ooncluded the prooeedings and determined
that he would not call the ohildren to testify. The Judge provided
his deoision ooncerning the Petition for Emergenoy Relief without
hearing the testimony of Joshua Spelas and the other children and
without the benefit of Mr. spelas' testimony concerning their
statementa to him.
15. Mr. Spelal was prevented from introduoing the key pieoe
of ev.i.dence ooncerninq abuse of his ohildren and the express reaaon
for his ooncerns regarding the safety of his children.

AND NOW, this 15th day ot March, 1994, the Court
held a hearing today on a petition tor speoial reliet tUed by
Daniel H. Spelas concerning his three children, Joshua, born
March 17, 1989; Danielle, born Hay 28, 1991; and Amber, born
July 15, 1992.
The parties have been separated sinoe 1993. The
children were in the primary custody ot their mother until
January ot 1994 when by agreement ot both the mother and tather
they spent ono week with the tather and then the lucceeding week
with the mother.
On January 19th, 1994, the tather qot custody ot the
three childron and refused to return them to the mother. I
signed an order on February 18th, 1994, directinq that the
children be returned to their mother with partial custody in the
tather every other weekend from Friday at 7100 p.m. until sunday
at 7:00 p.m.
On or about Februar.y 17th the custody conciliator tor
Cumberland County by order set a hearinq between the parties on
the custody iSBUe tor April 7th, 1994, at 9:30 a.m. I belreve

At the hearing today I heard te8timony ooncerning the
circumstanoes ot the parties primarily .ince January 1, 1994.
It would appear trom what I heard today that both parents are

I had oriqinally said I would speak to the older boy
about oertain thinqs that have taken place, but based on the
testimony today I don't teel that'e neces8ary. It Hubert
Gilroy, Esquirll, the custody conciliator, wishes to .peak to
JOshua at the hearinq that he has set tor April 7, 1994, I would
direct that he make that request known so that the mother can
produce Joshua tor that hearing.
The tather shall have custody of the children the
weekend ot March 18th and the weekend ot March 25th. The
partie. shall split the weekend ot April 1st with tho fath*r
having custody until saturday at 6100 p.m. and the mother havinq
custody the rest ot the weekend.
