whom re.ide with Plaintiff. Plaintiff filed her divorce oomplaint
on February 18, 1994.
I. MARITAL ASSETS
a. Real Bstate.
1. The pr.imary asset of the marriage is the marital
home looated at 76 Miller. Gap Road, Mary.ville, Pennsylvania.
The partie. purchased it in Ootober of 1988 tor $11~,000.OO and it
is pre.ently encumbered by a mortgage to First Union Mortgaga with
a balanoe due in the approximate amount of $~O,OOO.OO for whioh
monthly payments of $638.14 are due, thi. inoluding escrow for
fire insuranoe and real estate taxe.. The estimated fair markat
value of the property i. not muoh above it. puroha.e price

from misoommunication between Attcrney and olient and do not offer
a valid reason for a continuance. Please note that Mrs. Bergen ie
the plaintitf in this matter and still has not filed an inventory
and appr.aisement or income and expense statement to which we can
then respond. I believe since the current situation is .0 highly
tavorable to her she is reluctant to have a decision made in this
matter.

Additionally, of concern is the faot that Mrs. Bergen is
in exclusive possession of the marital residence and has been aince
August ot 1991. Despite repeated requests she has not had the
perlonal property appraised or the real estate appraieed and
controls access to both of those items. I would re.pectfully
request instruction to the effect that a mutually acceptable
appraiser should be obtained, and the cost of the apprai.al split
between the parties, and this appraisal to be completed within 30

The parties hereto were married June 11, 1977 and
separated on August 1, 1991. This is the firet marriaqe tor both
parties. There are five children born of this marriage, JUlia C.
Berqen, born March. 23, 1979/ Jenna E. Bergen, born February 24,
1982/ Joseph E. Bergen, born March 11, 1984/ Christina Joy Bergen,
born January 28, 1986, and Jessica Rose Bergen, born January 28,
1989. The Complaint in Divorce was filed Februar.y 18, 1994.
I. Marital Assets
A. Real Estate.
1. The real estate is located at 75 Millers Gap Road,
Mary.ville, Pennsylvania, which was purchased Oct,:>ber, '1988 for
$116,000.00. There is a mortgaqe ourrently on this property in the
oriqinal amount of $60,000.00 with First Union Mortqaqe ot
Lancaster, and with payments of $638.14 which include an escrow for
fire insurance and real estate taxes. The estimated fair market
value ot th. property is $150,000.00. Despite repeated requests,

2. Building Lot. A building let adjaoent to the
property at 75 Millers Gap Road was sold on or about the time ot
the separation, with eaoh party receiving half of the proceeds
($15,000.00) each.
B. Motor vehicles.
1. At separation Huaband retaine~ the 1991 Subaru Legaoy
purchased for $12,000,00 which, at the time of separation, had no
equity beyond the outstanding loan balance.
2. Wife retained a 1991 Plymouth Voyager purchased for
$25,547.00 which is now believed to be paid in full, and whioh
payment. were made by Husband from the date of separation up until
the time of the entr.y of the Order of support.
c. Personalty.
1, Wife retained all item~ of personal property cwned by
the parties or accumulated by them dur in9 the course of the
marr~age except for a bedroom bureau valued at $100.00 and a video
oamera valued at $350.00 which have been retained by Husband. It
is unknown whether Wife has had the contents ot: the marital
residenoe appraised, but it is believed the fair market value ot

the item. therein as ot the date ot separation, were $5,000.00.
II. Marital Debt.
1. Other than the parties car loans and the mortgage on the
marital r~.idsnce, the only item of outstanding marital debt
consists ot an obligation due and owing Donald C. Bergen in the
approximate amount of $2~,OOO.oO. The debt stems from inheritance
tax stemminq trom the death ot Husband's mother.
The fund.
di.tributed were tt. e sole Bcurce ot the down payment for the
purchase ot the mari '~al residence in the approximate amount ot
.70,000.00.
III. Income and E~~enses.
1. Plaintiff has failed to file an Income and Expense
statement to date.

Defendant.

2. At issue is the oarninq capacity of Plaintiff, which
earning capacity is substantially hiqher than that of Defendant,
although Plaintiff has steadfastly refused to work on more than a
part time basis.

as dopendent' deductions which could result in substantial
additional tinancial liability, and which deductions to Wite, in
conjunction with the mort9age deauctions, substantially reduces her
tax liability.
4. Husband's TIAA-CREF benetits. Husbana dia not be9in to

accrue his TIM-CREF benefits throu9h his employment at the
Pennsylvania state University until atter the parties separatea in
AU9ust, 1991, and this pension is non-marital in nature.
VII. Proposed Resolution.
1. The marital resiaence should be sold and the proceeds
diviaed 55\ to Husbi1nd, 45\ to Wife, followin9 payment of the
$25,000.00 to Donald Bergen ana payoff of tho present roortgaqe.
Husband to receive appropriate creaits for payment of marital debt
inoluding $10,000.00 to Donala Bor9on, the fair rental value ot the
