OF INDIRECT CRIMI~AL CONTEMPT
Thomaa A. Placey, Assistant District Attorney of Cumberland
County, pennlylvania, files the following petition ~or a hearing on
charges of indirect criminal contempt against Kevin James
Finkenbinder, as follows:
1. A Protection From Abuse Order waf entered by the Honorable
Harold E. Sheely on February 24, 1994. A certified copy of the Court
Order is attached as Exhibit 1.
2. Defendant's violation of this Order is averred in the
'attached criminal complaint. Attached a9 Exhibit 2.
3. The police, upon contact by the victim, alcertained her
immediate safety, and were not able to locate the defendant in the
vicinity.
4. The victim has requested the filing of charges on indirect
criminal contempt.
5. The commonwealth is requesting a hearing on the chargel of
indirect criminal contempt pursuant to 23 Pa.C.S.A. Section 6113.
WHEREFORE, the commonwealth requests a hearing on the charge of
indirect criminal contempt of the Protection From Abuse Ord~r.

Prior to the birth of the partie.' child, the respondent di.played act. of violence toward the
petitioner, Including attacklnll the petitioner and throwing het against a wall; arabblna the
petitioner'. hair and pulling her head back; making threat. to the plltitioner .tating "you wlJl pay

Neidlah.

On or about February 10, 1994, the petitioner snd respondent attended a hearing at the
Cumberland County Domestic Relation. Office, and an order of support was entered agaln.t the
respl)ndent; no previous order had been entered prior to February 10, 1994.

After the Domestic Relations hearing, the petitioner walked back to her car which wa.
parked In a lot located on PomtTet Street; the respondent drove up to the petitioner'. car, parklna
hi. truck directly behind the petitioner.

The respondent got out of his truck, approached the petitioner stating "why are you dolna
thi. to me," and stared at the petitioner In a threatening manner.

tho door,

The respondent lried to enler the clr Ihroush the back door, however, the car door wu
locked. The respondenl continued to yell It the petitioner.

The respondent I1nally moved his truck so thaI the petitioner could pull out of the parking
spICe. The respondent, thouSh, followed the petitioner Ihroush Carlisle, onto Route 641, and
onto Meadowbrook Road. Once the parties reached Meadowbrook Road, the respondent passed

the petitioner, and Immedialely spun hislruck sideways and blocked the road.

The respondent got out of his truck, then sot back Into his truck and quickly backed the
tlUck towards the petitioner's car, almost hitting her car.
