By order of Court of President Judge Harold E. Sheely
dated september 1~, 1994, the full-time Master has been
appointed in the above referenced divorce proceedings.
A divoroe complaint was filed on February 22, 1994,
raising grounds for divorce of irretrievable breakdown of the
marriage. No economic olaims were raised in the divoroe
oomplaint. However, Plaintiff attached an affidavit under
Section 3301(d) of the complaint averring that the parties have
been separated for a period in exoess of two years, since
November 24, 1991.
I In response to the complaint, the Defendant filed a
counter-affidavit indicating that she opposed the entry of a
divorce decree but did not indicate the reason, and further
stated that she wished to claim eoonomic relief but did not
specify what ooonomic claims she wished to raise. Therefore,
presentlr there are no economic claims raised in the proceedings
and I wi 1 not go forward with a directive until counsel havo
clarified for me what economio issues are to be litigated and
the issues have been properly raised in the pleadings. I do
not. tnat the motion for appointment of Master indicated that
the claim to be litigated was the distribution of property.
I will expect to hear from counsel within ten (10) days
of the date of this letter regarding the statue of any

attorney Del Duca indioatinq that .he has raised in the
pleadinqs claims for equitable dietribution, alimony, and
counsel fee. and costs.
Now that the economic claims to be litiqated have been
rai.ed in the pleadings and since grounds for divorce are
apparently not at issue, I am directing each oounsel in
accordanoe with P.R.C.P. 1920.33(b) to file a pre-trial
statement on or before Monday, Ootober 31, 1994. Upon receipt
of the pre-trial statements I will immediately schedule a

Husband is 38 years of age and reside. in ftn
apartment in carlisle with a female friend according to wife'.

of Art. Degree and i. ft program manager for sprint/united
Telephone. FQr 1993 he snowed a gro.. annual income of
$~O,B77.8B. Husband is also in the National Guard Reserve and
tor 1993 had a qross income from the re.erves of $3,057.78.
Husband does not oomplain of any health problflms. Husband has
medical insurance benefits through hi. employment/ however,
aocording to wife's attorney he removed her from his plan
ooverage and she has been havinq to provide her own coverage
through employment at a cost to her. The Master inquired as to
the reason that husband removed wife from the coverage and his
oounsel b qoinq to attempt to respond to that inquiry.
Wife is 38 years of age and reside. in the marital
home at 118 Willowview Drive, Carlislo, Pennsylvania. She
resides in the home witn the four children of the marriage
Thomas, 8g& 20/ Paul, age 17/ Michael, age 14, and Elizabeth,
age 11. Wife is a c~stomer servioe representive with EDS and
for 1993 showed a gross annual income of $19,139.28. Wife has a
high school education and does not complain of any health
problems.
wife is not the benefioiary of any formal support
order entered through the Domestic Relations Offioe. Husband
has been voluntarily paying the mortgage payments on the first
and .econd mortgages, the PP'L bill, the quarterly service
bills, taxes, and homeowner's insurance, Aocording to his
oounsel, his contribution monthly is approximately $1,300.00 to
the nou.ehold.
Wife has indicated that she would like to remain in
the marital home with the ohildren. The home has be.n appraised
by Theodore Stefan, Jr. on September 19, 1994, ehowing a market
value of $130,000.00. The home is subject to a first mortgage
in favor of Farmer's First Bank in the approximate payoff amount
of $70 000.00 and the seoond mortgage in favor of Dauphin
Deposit Bank and Trust company in the approximate payoff amount
of $15,000.00. Counsel have indicated that they will be able to
stipUlate to the market value of the home at $130,000.00 and
will provide at the time of the hearing the updated pay offs on
the two mortgages so that we can use those numbers to derive an
equity valUe for the home.
Husband is a partioipant in a pension plan at
Sprint/united Telephone which is a two part plan involving a
savings plan and a stook plan. Counsel have agreed to nave the
plan valued and initially have agreed to split the costs of the
valuation. Husband previOUSly paid the costs of having the real
estate appraised. Until we get the value of the pension we are
unable to be very specifio about determining how to structure
any kind of a settlement in these proceedings,

Today is Tuesday, February 14, 1995.
Present for a Master's hearing are the Plaintiff, Thomas J. Horn
and hi. counsel James J. Kayer, and the Defendant, Christine
Horn and her counsel Frances H. Del Duoa.
Counsel for the parties have advised that they will
have their clients sign and file affidavits of oonsent within
the next couple of days so that the divoroo can be concluded
under Section 3301(0) of the Dom6stio Relations Code.
The economic claims raised in the proceedings to be
resolved at the hearing are equitable distribution, alimony, and
counsel fees and expenses.
We have had some extensive
discussions this mornings, the Master with counsel and then
counsel with their respective olientsl however, although we can
agree to oertain identification of assets and values, we are
unable to come to a resolution of the issues. Therefore, we
will have to schedule another hearing to take testimony on the
outstanding issues that are identifiad.
We have through
discussions come to an understanding as to what the assets are
that are to be distributed and the value of those assets. The
Master is going to place on the reoord in the presence of the
partie. and counsel a stipulation with respect to those matte~.

STIPULATIONS
The parties were married on July 13, 1974, and separated
on November :14, 1991.
The parties are the natural parents of four children,
Thomas, born July 26, 1974, PaUl, born June 19, 1977,
Michaol, born Maroh 16, 1980, and Elizabeth, born January
8, 1984. All of the children re.ide with the Defendant,
and with the exception of Thoma. are minors. Thomas is
currently attendinq colleqe at Harrisburq Area Community
College.
Husband has been makinq payment. on account of expenses
with reqard to the operation or the household and those
expenses amount to approximately $1,300.00 per lIIonth.
The.e payments on aocount of the expenses for the
household have been in lieu or speoirically designated
ohild and spousal support.
HU.band is employed as a proqram manager for United
telephone/sprint. His income as evidenoed by a W-2
.tatement for 1994, annually is $53,326.00. In addition
hu.band receive. income as a member of the National
Guard in the amount of $3,473.60 annually. His net
income from the two sources of income is $40,269.57
annually.
Wife is employed as a oustomer service representative for
EDS. Her annual income as evidenoed by the 199,4 W-2 is

THE MASTERI Today is Tuesday, August 29, 1995.
Present tor a Master's hearing are the Plaintiff, Thomas J. Horn
and his oounsel Carol J. Lindsay, and the Defendant, Chrbtine
"orn and her counsel Frances H. Oel Ducn.
A divorce complaint was filed on February 22,
1994, raising grounds for divoroe of irretrievable breakdown of
the marriage. With respect to the grounds for divorce, husband
filed an affidavit of conoent on February 17, 1996, and wife
filed an affidavit of consent on April 18, 1995.
Economic claims raised in the proceedlnge are
equitable distribution, alimony, and couneel tees and expenBes.
Counsel have advised the Master that after extensive
negotiations today that the parties have reached an
understanding with respect to a resolution of the outBtanding
eoonomio issues.
Counsel are going to place on the reoord an
agreement and stipulation in the preBence of the parties, and
that statement of resolution of the economic issues will be
oonsidered the agreement of the parties and not subject to any
ohange. or modification except tor typographical errors which

MS. LINDSAY I
1. Divi.ion ot 'roperty. Husband will retain hi. employment
beneflts, Wite will retain the marital home and will retinanoe
the tirst and aeoond mortgage on the marital home .0 that
hu.band ia no longer liable tor any debt on aooount of Baid
home. Wite will so retinance within ninety days of the date ot
this hearing. At the time of the refinance or, in any event,
within ninety days, husband will pay to wife $7,038.00.
If wife is unable to retlnance after using her best
eftort., wite will refinanoe within tifteen months of the date
ot this ~greement. Wife'_ obligation to refinanoe within ninety
dayY shall not be limited by the interest rate which suoh
refinanoe would require. However, in the event that wife oannot
obtain a mortgage to retinanoe aa atoresaid, she will refinanoe
within titteen months of the date of thia hearinq. In the
interim, any spousal or child support for whioh huaband i8
obligated shall be paid in the torm of payments to the tir.t and
seoond mortgage holders and for the taxea and lnsurance tor the
home. If at the end of titteen months trom the date ot this
agreement wite oannot retinance, the houae will be plaoed for
sale. The sale prloe will be determined by an average of the
market values obtained by the parties' real estate agent. in the
event the parties themselves cannot agree. The house will be
sold tor a prioe reasonably olose to its fair market value. In
the event that the parties oannot determine the sale prioe or
the liating price, they will Beek prompt guidanoe trom the
Court.
In the event that the house is listed for sale, husband
wll1 oontinue to make his ohild support and alimony payments in
the torm ot payments for the prinoipal and intereBt on the two
mortgages, the taxes and insuranoe. Should the house be aold
for an amount which nets in excesa of $46,689.00 atter the oosts
of aale are paid and the first and second mortgages are paid,
husband will reoeive 40' of this differenoe. He will be
responeible tor the capital gain taxes on the amount ot money
whioh he reoeives. The balance of the proceeds ot sale will be
the sole property of wite. This Igreement anticipates that
there shall be no liens on the property as a result of any
post-separation debt of wife or husband. It is the intention ot
the parties to ahare in the 8ame proportion the division at
property as of thie date any increase ot value of. the houae
oooasioned by a delay in the sale of the house. Pending the
sale of the house, wite will be solely responsible tor any
utilitiea and the general upkeep ot the home.
All other property shall be the sole and separate property
of the party in whose possession it is as of the date ot th1.
agreement.
~. With regard to alimony, husband will pay to wite $400.00
per month as alimony commenoing the month the divorce deoree ia
entered. Said payments will cease upon the death, cohabitatlon
or remarriage ot wite. This alimony payment may be modifiable
upon a showing ot changed circumstances in accordanoe with the
provisions ot seotion 3701(e) of the Divorce Code.
3. Tax oonsiderations. The parti.e will file individual
income tax rsturn. tor the 1996 tax year. On his return husband
will b,1 entitled to take as deduotions the interest on the
mortgage and seoond mortgage payment. tor 1995 up to the dats of
retinanoe and the real estate taxee thereon up to the same date.
He shall also be entitled to take one dependent as hi. exemption
in 1996 and in yelr. thereafter so long as there are three
dependents to claim by the partles, Furthermore, husband will
be entitled to take alimony and/or .upport payment. in the
amount of $400.00 per month trom January 1995. He shall take
them as spousal eupport or alimony for purposes ot tederal
inoome tax oomputltion. This agreement shall opsrate as an
order ot court in the event the Internal Revenue Servioe
requires documentation of the amount ot spousal support paid ln
1996.
4. Child support. The support guidelines indioate that the
applioable present child support ie $768.00 per month. The
parties agree to etipulate to the Office of Domestic Relations
child support tor two children in that amount. This agreement
is entered, although wit. has had a slight increase in inoome
sinoe the Bupport oalculations were made. The amount ot ohild
eupport and the amount ot alimony set out above shall be paid in
the form ot payments for the tirst and second mortgage, the
taxes and the insurance on the marital home pending the
refinance or eale of the marital home. The balance ot husband's
oombined child support and alimony payment whioh exceeds the
prinoipal, interest, taxes and insurance on the marital home is
$111.00. That amount shall be paid to the ottioe of the
Domestio Relatione each month until the refinanoe or .ale ot the
marital home. Thereatter, alimony and child support payment.
will be made through the attioe ot Domestio Relations ot
cumberland County, Pennsylvania.
6. Each party shall be responsible for his or her own counsel
tees and for the oosts already paid.
6. Exoept as herein otherwise provided, each party may dispose
ot his or her property in any way and each party hereby waives
and relinquishes any and all righte he or she may now have or
hereatter aoquire under the present or tuture laws of any
jurlsdiotion to share in the property or the estate ot the other
as a result ot the marital relationshlp inoluding without
limitation, dower, courtesy, statutory allowanoe, widow'.

the other, and right to act as adminiBtrator or executor in the

WITNESSETH:
WHEREAS, the parties were husband and wife, having been Joined In married on July 13,
1974, and divorced by Decree of the Court of Common Pleas of Cumberland County on October 24,
1996; and
WHEREAS, Incorporated but not marged with the Decree In Divorce was an Agrellment
reached In the Office of the Divorce Master on August 29, 1996, a copy of which Agreement Is
attached hereto as Exhibit "A"; and
WHEREAS, the parties desire to amend said Agreement In consideration of the payment
by the Plaintiff to the Defendant of $10,000,00.
NOW, THEREFORE, in consideration of the mutual promises contained herein and other
good and valuable consideration, and Intending to be legally binding, the parties agree as follows:
1, Christine Horn hereby waives, effective August 2B. 1998, any and all claims for
alimony as set out In Paragraph 2 of Exhibit "A",
