~ND NOW, the Petitioner, Cumberland county Area Agency on
A9in9, by it. ~olicitor, Anthony L. DeLuca, Esquire, pursuant to
the provioione of the Older Adults Protectivo Services Act, 311 P.S.
Oec. 10211 at~, respectfully repre.ents as followsl
1.
The Petitioner, Cumberland County Area Aqency on Aging
(CCAAA), with its office located in the annex of the cumberland
County Courthouse, Carliele, Cumberland County, Pennsylvania, is
the local provider of protective services for older adulta in
Cumberland county.
2.
The Respondent, Alfred WOhler, ie an older adult, aqe 65, who
resides at 8 Houston Drive, Mechanicsburg, cumberland county,
Pennsylvania.
3.
On or about February 17, 1994, the Petitioner, through ita
authorized representative, visited the resid.nce of Alfred Wohler
and spoke to him about hie ability to take care of himself and his
medical problftms, and obeerved him and his living conditions.

Investigation by the Petitioner on February 18, 1994 indioate.
that the R.spondent hade
a. tampered with tho peg tube resulting in no tub.
te.ding intake sinoe his discharge from the hoapital
on February 14, 1994;
b. deolined receipt and uae ot the tube feeding
.upplement;
o. tailed to apply proper hygenic care to the Ileoatomy
baq; and
d. lost a total of 6 pounds between February 16 and
February 18, 1994, thua reducing his total weiqht to
approximately 98 pounds on a 6 foot 2 inch fram..

Petitioner believes and, theretore, avers that, Dued upon ita
inv..tigation, Alfred Wohler haa failed to provide for himself and
i. in imminent risk of death or .erious physical harm if he doe.
not reoeive proper. nutrition through the peg tube feeding, which up
to the prssent time he has refused.

Petitioner turther avers that the .peoific ehort-term, lea.t
re.trictive involuntary proteotive .ervices required in this ca.e
i. the immediate removal of Alfred Wohler trom hi. residenc., his
transport ion to Harriaburq or carlisl. Hospital tor phy.ical and
p.ychiatric evaluation., tollowed by hie plac.ment in an
appropriate living .ituation.

The proposed services would remedy the situation or condition
which presents an imminent risk of death or serious physical harm
by Altred Wohler receiving the appropriate care and nutrition that
ar. pressntly lacking.

The proposed services are not overbroad in extent or duration
becau.e of his condition.
15.
Le.s restrictive alternativslI are not adequate becauss of his
condition.

1. The Reapondent, Alfred ~. Wohler, and the Petitioner agree that
Respondent is no longer in imminent riek of death or .erious phy.ical
han.
~. The Re.pondent, Alfred ~. Wohler, currently .uffers from
"Chrohn's" d1lIla.e.
3. The Re.pondent, Alfred L. Wohler, ourrently requires medical
assistance or health care a.e1ltance with maintaining a "G" or "peg"
tube for nutritional and feeding purpose..
4. The Respondent, Alfred L. WOhler, ourrently requires medical or
health care a..i.tan~e with complications aseociated with an Ileostomy.
5. Th. Respondent, Alfred L. Wohler, agr.ea to and ie desirou. of
attending the Leader East adult care facility, looated at 800 King Ru..
Road, Harrisburg, penn.ylvania, fe-'r further rehabilitation and treat-
ment.
6. The Reepondent, Alfred L. Wohl~r, and Petitioner agree that the
Court of co.-on Pleae ehall maintain general juriediotion for a period
ot eix (6) month. from any Dubeequent order ot court.
7. Th. Agency agreee to review and .valuat. the medioal condition
of R..pondent Alfred L. Wohler after ninety (90) daye from any eub.e-
quent Order of Court and eubmit a written report to Re.pondent and
coun..l of r.cord.
8. Th. Agency agreee to forward a copy of thie Agreement and any
eube.quent Order of Court to the Leader Eaet adult oare faoility
through Trioia Bartlett, Director of Admieeione, or any other agent of
the care faoility.
9. Re.pondent acknowledge. that he i. currently under the medical
eupervi.ion of the Interniste of central Pa. located at the Harrieview
Profe.eional Center in Lemoyne, penn.ylvania.
10. Re.pond.nt, Alfred L. Wohler, and the Agency acknowledge that
the provieione of this Agreement and stipulation have been fUlly
explained to the parties by their respective coun..l, by Anthony L.
DeLuoa, I.quire, attorney for the agency and Andrew C. Sheely, Zaquire,
Court-Appointed Attorney for Re.pondent, including all righta to them
under the Older AdultD Protective Servioes Act, AJ amended. The
partie. further agree that each i. entering into this Agreement freely
and voluntarily and that the exeoution of this agreement ia not the

1. On March 16, 1994, the Honorable J. Wesley Oler, Jr.,
entered an Order ot Court direotinq that the Court shall continue
the above-captioned matter for a period of Six (6) months trom
the Order ot Court.
a. On or about April 12, 1994, Andrew c. Sheely, Eequire,
Attorney tor Re.pondent, Alfred L. Wohler, was advised that the
Re.pondent had died at the Holy Spirit Hospital in camp Hill,
Cumberland county, Pennsylvania earlier in the day.
3. As a re.ult of the Respondent I s death, the ab,ove
captioned matter i. moot.
4. Coun..l tor both parties stipulate and aqree that the
abov.-captioned matter ahould be dismissed as a reSUlt ot the
