WHEREAS, Kenny Ray .,Johnson ilnd cc)Onie Lehman, (the
"Owners"), located in the 1'ownship of Middlesex, County of
Cumberland, and Commonwealth of Pennsylvania, is about to execute
contemporaneously herewith a contract with J&B Construction, (the
"contractor"), of 54 south Market Street Elizabethtown, FA 17022,
for the following services in connection with vacant land more
particular ly described on Exhibi t "A" 11 ttached hereto t Si te
planning (excavation), storm sewer, curbing, public utilities,
sanitary sewer, street paving and related activity.
NOlf, this eleventh day of February 1994, at the timE! of and
immediately before the execution of the pdncipal contract, and
before any authority has been given by the Owner to Contractor to
commence work on the said land, or purchase materials for the same
in consideration of the making of the said contract with the
Contractor, and t~e further consideration of One ($1.00) Dollar to
the Owner paid by the Contractor, it is agreed that no lien shall
be filed against the land by the Contractor, or any sub-contractor,
nor by any of the materialmen or workmen, or any other person, for
any labor or materials purchased, or extra labor or materials
purchased, for the above work, the right to file such liens being
expressly waived.
