1. Plaintiff Cheryl S. KoonU ("Koontz") ia an adult

2. Defendant Scott B. Hoover ("Hoover") 11 an adult
individual, of 30 Foreman Mill Road, Shippensburg, fA l7257.
3. Defendant Mellon Bank ("Mellon") ia a Pennsylvania bank
with a prinoipal place of bUlinesl at 1 Wezt King Street,
Shippenzburg, PA 17257.
4. On January 18, 1991, Koontl and Hoover entered into an
agreement for the pUrpole of purchaling, owning and liquidating
oertain real property located in Cumberland County at 30 Foreman
Mill Road, Shippen.burg, PA 17257. A copy of the Agree$ent i.
attaohed and marked "Bxhibit l."
5. Koontl and Hoover ownerl of an undivided intere.t in
laid real property a. joint tenants with a right of survivorlhip,
the real property i. more fully described al follows.

Town.hip, Cumberland County, Pennsylvania, dezcribed
according to lurvey by Thoma. A. Neff, Regiltered Surveyor,
dated Augult l7, 1971, al follows.

property now or formerlr of Leroy A. and Francel C. Durff by
deed recorded in Cumber and County Deed Book X23, page 193,

BIING the .ame premi.e. that Thoma. B. G.ell, II, and Lori
A. G.ell, hu.band and wife, by thei& deed dated January 18,
1991, and filed in the Offioe of the Recorder of Deed. of .
Cumberland County at Deed Book Y34, page 6l7, granted and
conveyed unto Soott I. Hoover and Cheryl S. Hoover.
6. Mellon hold. a mortgage intere.t in the realty, and on
the undivided intere.ts of ~oont. and Hoover in equal proportion,
in the amount of $41,175.00, by a mortgage dated March 13, 1992,
and filed March l7, 1992, in the Office of the Reoorder of Deed.
of Cumberland County, at Mortgage Book 1053, page l025.
7. ~oont. and Hoover made principal and intere.t payment.
to Mellon, and thereby reduced the obligation to Mellon to
approximately $31,000.00.
8. Xn aocordance with the term. of the afore.aid
Agreement, upon the termination of ~oont.' and Hoover'.

puroha.ed by either party or .old to a third party, and loont.
