1. Plaintiff Jack E. Patti, i. an adult individual re.iding
at 192 Spring Drive, Dilbburg, York County, penn.ylvania.
2. Defendant Eugene and Oma Rotz are adult individual.
tldlbla H & R Cu.tom Built Home., Ino., a Penn.ylvania
oorporation, have as it. prinoipal plaoe of bu.ine.. 1106 Ba.y
Road, Carli.le, Cumberland County, ponn.ylvania.
3. At all time. relevant hereto, Plaintiff wa. in the
bu.in... of, inter alia, framing newly built home..
4. At all time. relevant hereto, Defendant. W~~j in the
bu.ine.. of oon.truoting home. and other building..
5. In July and Augu.t, 1993, Defendant required the
.arvioe. of Plaintiff to frame a home they were building in
Li.burn, penn.ylvanie, which job Plaintiff performed in a
profe..ional manner, in a timely fa.hion and without oomplaint
from Defendante.
6. A. a re.ult of the above work, Plaintiff billed
Defendant. for hiB work (See Bxhibit "A" attaohed hereto), thb
for the total amount of Five Thou.and Six Hundred Seventy Dollar.
and Sixty.fiv8 Cent. ($~,670.65) and with payment to be ~de
within thirty (30) day..
7. Defendant. ancepted the above referenced bill without
complaint and on October 14, 1993, paid Two Thou.and Two Hundred
($2,200.00) Dollar. on it, on November 22, 1993, paid One Thou.and
($1,000.00) Dollar. on it and Ma~ch, 1994 paid One Hundred
($100.00) Dollar. on it.
8. Deepite repeated reque.te therefore Defendant. have
refu.ed to pay the balance of their debt owed Plaintiff.
