STIPULATION
THIS STIPULATION, made this ;ffl'day of Auguat, 1994, by
and between SIGRID MOFFIT HOFFMAN, hereinafter referred to as
"Plaintiff"; and MERLE R. WITTER and CONSTANCE O. WITTER, his
wife, hereinafter referred to as "Defendanta" / WITNESSETHI
WHEREAS, Plaintiff commenced the above captioned action in
~ortgage foreclosure against Defendanta concerning a certain
purchase money Mortgage by which Defendants conveyed to Plaintiff
a security interest in all those four (4) certain tracts of land
situate in Monroe Township, cumberland county, Pennsylvania, and
more particularLy described in said Mortgage, as well aa
described in a certain Deed of Plaintiff to Oefendants dated
July 10, 1989, and recorded in the Office of the Recorder of
Deeds in and for Cumberland county, Pennsylvania, in Deed
Book "C", Vol. 34, Page 338/ and being improved with a aingle
family dwelling house known and numbered as 512 creekview Lane,
Meahanicsburg, Pennsylvania (the "Premises");
WHEREAS, the above captioned action has boen listed and
called for the September 1994 civil trial term commencing
september 6, 1994; and
WHEREAS, the parties hereto desire to settle and resolve the
above captioned action without the nocessity of such n trial.
NOW, THEREFORE, in consideration of the premises, the
parties hereto, each intending to be legally bound hereby, agree
as followsl
1. Defendants hereby consent to the entry of a judgment in
favor of Plaintiff and against Defendants as prayed for in the
Complaint filed in the above captioned action, the amount of
which ourrently due Plaintiff is One Hundred Eighty-fcur Thou.and
Four Hundred Twenty-seven and 51/100 ($184,427.51) Dollars,
toqeth.r with interest thereon at the rate of ten (lOt) p.rcent
per annum trom January 1, 1994, until paid or until po.....ion ot
the premi..s and a Deed in lieu of foreclosure therefor are given
to plaintiff at PlaintHf' s optiO/l, whl.chever event shall tirst
occur, an attorney's commission of five (5') percent on the .aid
principal sum and costs of suit.
2. It said judgment shall be or become a lien again.t those
two (2) certain tracts ot land, together with the improvement.
thereon erected now known and numbered as 332 and 334 Old stone
House Road South, situate in the Village ot Churchtown, Monroe
Township, Cumberland County, Pennsylvania, and more fully
described as Tract Nos. 1 and 2 in a certain deed recorded in
the Oft ice of the Recorder ot Deeds in and for Cumberland CQunty,
Pennsylvania, in Deed Book "U", Vol. 22, Page B09, th/l lien ot
said judgment is hereby released and toraver discharged
therefrom.
3. The parties hereto hereby authorize their respective
attorneys to sign and til~ a Praecipe, a copy ot which is
attaohed hereto as Exhibit "A" / agreeing to the entry of judgment
as provided tor herein and therein.
