her dependentl. The Arnold. turther promiled to be perlonally
re*ponsib1e tor any CRC services not covered by insurance. A

obligation. and has provided rehabilitative and other medical

6. Atter any insurance payment. and ether credit.
have been applied, a balance ot $10,004.16 remains unpaid on

7. CRc's oontractua1 olaim against Defendants has
been liquidated, du., and owing since 4/1/92. Aocording1y, CRC
is entitled to six percent annual intere.t ($1,139.81) oomputed
on its prinoipa1 claim trom 4/1/92 through 2/23/94.
8. To date, despite repeated reque.ts, Detendants
have breached their oontraotua1 obligation. by tailing to pay
CRC'. olaim, inclusive ot intenlt and costs.

1. Harrisburg Medical Management, Inc. is a
Pennlylvania corporation which, inter alia, trades and doel
bUlinellB aa The capital Recovery Center ("CRC"), an outpatient
rehabilitative facility located at 3514 Trindle Road, Cumbsrland
county, camp Hill, Pennsylvania 17011. Harrisburg Medical
Manaqement, Inc.'s registered office and principal place of
bu.ines. are located at 409 S. Second Street, Harrilburg, Dauphin
county, Pennsylvania 17101.
2. Dsfendants, Jack and Char.lene Arnold, are adult
individuals currently residing at 300 Ridge Road, Etur., YorK
cr)unty, Pennsylvania 17025. At all relevant times, Defendants
were and are married al husband and wife, and had express,
implied, or apparent authority to obligate one another for the
payment ot CRC'I ..rvices, al alleged below.

3. CRC incorporates herein by reference paraqraphs 1
throuqh 2 above.
4. On or about November 12, 1990, Mrs. Arnold sillned
CRC'. standard agreement ("agreement"), under which the Arnolds
agreed to essi\Jn all insurance payments to CRC to cover the cost
of rehabilitative and other medical services provided to her and
her dependents. The Arnolds further promised to be personally
responsible for any CRC services not covered by insurance. A
copy ot the agreement is attached as Exhibit "A." .
5. At all relevant times, CRC has complied with it.
obligations and has provided rehabilitative and other medical
services on behalf of Mr. and/or I~rs. Arnold.
6. After any insurance payments and other credits
have been applied, a balance ot $10,004.16 remains unpaid on
Defendants' account.
7. CRC's contractual olaim against Defendants has
been liquidated, due, and owing since 4/1/92. Accordingly, CRC
is entitled to six percent annuai interest ($1,139.81) computed
on its principal claim from 4/1/92 through 2/23/94.
8. To date, despite repeated request., Defendants
have breached their contractual obligations by failing to pay
CRC'. claim, inclusive ot interest and costs.

10. In the alternative, assuming there was no express
written contract as averred in Count I above, there existed an
impUed-in-tact contract between the parties based on their oral

eurrounding CRC's provision of rehabilitativlil and other medical
services.
11. Under the impl.ied-in-fact contract, Defendants and
each of them agreed to pay CRC for rehabilitative and other
medioal .ervicIII provided to one or both of them, after applying
any available insurance and other credir.s.

12. Under the implied~in-tact aqreement, Detendants
and e.oh of them a9reed roo .ssi9n any insurance benetits to CRC
to cover all or a portion of the cost of its services.
13. Under the implied-in-fact agreement, Defendants
had implied obli9ations of good faith, fair dealing, and
disclosure.
14. Defendants have preached their implied obli9ations
and promises to pay, and have defaulted on their opligations
under the implied-in-fact contract, leaving a current balance of
$10,004.16 due and owin9 since 4/1/92.

duty on the part of Detendant-Hueband and Defendant Charlene Arnold
(Detendant-Wife) to pay for oertain medical eervioe. provided by
Plaintiff to Defendant-Wife.
The preliminary objeotion of Detendant-Hueband to Plaintiff'a
complaint is based upon the propoaJ.tl,on that a husband oannot b.
liable for medical coats inourred by hil spouse where he was not a
s;arty to the oontract between the provider and hie spouae and where

Pennsylvania corporation which, inter alia, trade. and doe.
buline.s as The capital Recovery center ("CRC"), an outpatient
rehabilitative taaility looated at 120 S. Filbert st.,
Meohanialburq, cumberland County, Pennsylvania 17055.
Harriaburq Medical Management, Inc." registered otfioe and
prinaipal plaoe ot businesl aro located at 409 S. Seoond street,
Harriaburq, Dauphin County, Pennlylvania 17101.
2. Detendants, Jaok and Charlene Arnold, are adult
individuale currently residing at 300 Ridge Road, Etters, York
county, pennsylvania 17025. At all relevant times, Detendant.
were and are married as hUlband and wite, and had express,
implied, ostensible, or apparent authority to obligate one
another tor the payment ot CRC's servioee, as alleged below.
3. Alternatively, assuming Detendantl di4 not have
suah authority, they are prelumed to have the power and right to
obliqate one another, beeause they mutually benetited trom CRC's
servioes and trom their joint personal injury olaim, ftS alleged
below.
4. Alternatively, the reasonable expeotations ot the
Arnolds' areditors (includinq CRC) were that each spoule's
inoome, asset., and in.urance procaeds would be held tor the
benetit of the marital partnership and their oreditors, and that
both ot them would be held liable tor necessaries provided to one
spou.e (inoluding CRC's medical service.).

6. On or apout November 12, 1990, Mrs. Arnold signed
CRC's standard agreement ("aquement"), under which the Arnold.
agreed to aSlign all insuranoe payments to CRC to cover the cost
of physiaal therapy and other rehabilitative and medical service.
provided to her and her dependents. The Arnolds turther promisod
to be perlonally re.ponsible for any CRC services not covered by
in.uranae. A copy of the aquernent il attached as Exhibit" A. II

1. Mrs. Arnold Bought and reoeived .ediaal treatment
from CRC aa a reault ot injuries sustained by her in a July 14,
UtO motor vehiole eccident (lithe aocident").
8. Charlene and Jack Arnold jointly aa.erted a
liability alaim aqain.t AETNA Ineurenae company (IIAETNA"), the
in.urer who.e poliay covered the other motor vehiale involved in
the aocident. The Arnold. received the tull $100,000.00 limits
ot the AETNA liability polioy, and thereafter asserted a joint
underinsured motoriat claim under their own AETNA policy. The
Arnolds' under insured arbitration claim was heard by arbitrators
aesi9ned by the American Arbitration Association.
9. By letter dated February 13, 1995, the Arnolds'
attorney, David Lutz, advised CRe's attorney, Bradford Dorrance,
that the arbitrators had molded a $202,700.00 underinsured
motorist award in favor of the Arnolde and against AETNA.
Attaohed as Exhibit liB" is a copy ot AETNA's $202,700.00 cheak
payable to "Jaok Arnold and Charlene Arnold Individualyy (Ilia) ,
as husband and wife and their attorney, David Lutz. II
10. At all relevant time., CRC has complied with it.
obligations and has provided phyaioal therapy and other medical
servioes on behalf of MrB. Arnold.
11. CRC' s eervice. were reasonable and necessary,
benefited both .pOU.I', and represented a portion ot the damaql'

13. A balanoe of $10,004.16 remains unpaid on
Detendants' CRC aoaount.
13. CRC's contraatual claim against Defendants has
been liquidated, dus, and owing sinoe 1/22/92. Aacordin91y, CRC
i. entitled to six percent annual interest ($2,751.14) computed
on its principal claim from 1/22/91 through 8/22/95.
14. To dats, delpite repeated requests, Defendants
have breached their contractual obligations by tailing to assign
their insuranoe proceeds and/or by failing to pay CRC's olaim,
inolusive ot interest and oosts.

1. Plaintiff has a $10,004.16 claim against
detendants, Jaok and Charlene Arnold, based on physioal therapy
and related medioal servicee provided to Mrs. Arnold.
2. Plaintitt's medical servioes were provided to Mre.
Arnold as a result of injuries sustained by her in a motor
vehiole aocident.
3. The Arnold. asserted a liability claim against the
other driver involved in Mrs. Arnold's motor vehicle aoaident/
and later asserted an underinsuranoe claim against their motor
vehicle inluranoe carrier.
4. The Arnold. received net recoveri.s from their
motor vehiole olaim. in exoes. of $200,000.00, but have refused
to pay plaintitf'l claim, arguing that detendant, Jack Arnold, is
not re.poneible tor his wite's medical expenses.

5. At her June 2, 1997 deposition, Mr.. Arnold agreed
to authorize plaintitt to obtain records from her helllth
in.uranoe oarrier, Blue cross/Blue Shield, identifying any
peyment. reoeived by her which related to the .ervice. provided
by plaintiff.
6. During the past 14 months, plaintiff'. undersigned
aoun.el, Bradtord Dorranoe, has sent numerous letter. to
detendants' ooun.el, David Lutz, seeking to obtain thi.
information. Attached III Exhibit "A' are copie. of four letter.
from Mr. Dorranoe to Mr. Lutz, together with a copy of an Ootober
11, 1997 letter trom Mr. Lutz to Mr. Dorrance.
7. Plaintiff believes there is suffioient vause to
remove thie ea.e trom the purge list in thatl
(a) although thi. action was filed in 1994, both
coun.el have been relatively active in tiling pleading., engaging
in written discovery and depo.ition., a. well as .ettlement
negotiation. 1
(b) plaintiff took the deposition of the
detendants in June of 1997, and thereafter requ""ted the
remaining item of discovery (health insurance payment reaords) in
antioipation ot tiling a summary judgment motion1
