Hoke Husband and Wife hereinafter called the Owner, WITNESSETH THAT: The Contractor by Instrument dated November 8, 1993 entered Into an Agreement with the Owner for the erection and construction of a single family dwelling ,sltuatedon Lot No. 34 Wineberry Drive "Whitebrier" Upper Allen Township AND WHEREAS. the Contractor has covenanted and agreed therein to enter Into an additional agreement with the Owner stipulating that no lien or liens of any kind shall be filed against the above building or the appurtenances thereto. NOW, THIS AGREEMENT WITNESSETH, that the Contractor, for and In consideration of the awarding to him of the said contract as for the sum of ONE DOLLAR ($1.00) to him In hand paid by the Owner. the receipt of which Is hereby acknowledged, promises and agrees that no Mechanlc's Lien or liens shall be flied against the aforesaid building or the appurtenances thereto by any subcontractor, subcontractors, materialmen, mechanics, laborers or anyone lor materials furnished, work done or services rendered of any kind whatsoever, for or about, or on account of the aforesaid building or on the credil thereof, IN WITNESS WHEREOF, the said parties hereunto set their hands and seals the day and year aforesaid. EXHIBIT "A" LEGAL DESCRIPTION ALL THAT CERTAIN piece or parcel of land situate in Upper Allen Township, Cumberland county, Pennsylvania, bounded and described as follows: BEGINNING at a point on the eastern right-of-way line of Wineberry Drive at the southwestern corner of Lot No. 33, Preliminary/Final Subdivision Plan for Harold D. Stoner "Whitebrier" recorded in Plan Book 66, Page 121, Cumberland County Recorder of Deeds office; THENCE South 36 degrees 25 minutes 52 seconds East, 231.63 feet (erroneously set forth as 231.78 feet on the subdivision plan> to a point at lands now or formerly of James K. Tritt; THENCE along same South 54 degrees 26 minutes 51 seconds West, 70 feet to a point on the northeastern corner of Lot No. 35 on said subdivision plan; THENCE North 35 degrees 33 minutes 09 seconds West, 142.63 feet to a point on the right-of-way line of Wineberry Drive; THENCE along the right-of-way line of Wineberry Drive by a curve to the right, having a radius of 250 feet, a length of 65.52 feet to a concrete monument; THENCE North 53 degrees 34 minutes 8 seconds East, 40.88 feet to a point, the place of BEGINNING.
