COMPLAINT IN CIVIL ACTION - REPLEVIN
COUNT I - REPLEVIN
AND NOW, comes the plaintiff, Green Tree Consumer Discount
Company by and through its attorney, Dennis M. Blackwell, Esquire,
and avers as follows:
1.
Plaintiff,
Green Tree Consumer Discount company
(hereinafter referred to as "Green Tree") is a Corporation
authorized to conduct business in the Commonwealth of Pennsylvania
and which does business and maintains offices at 300 Weyman Plaza,
Suite 480, Pittsburgh, Allegheny County, pennsylvania.
2. Defendants, Richard L. Matthews and Teresa L. Matthews,
(hereinafter referred to as "Richard" and "Teresa") are adult
individuals whose current address is 20 Marilyn Drive, Carlisle, PA
17013,
3. On or about December 23, 1991, Defendants, Richard and
Teresa, purchased from Royal Finance of PA, Inc., Harrisburg,
pennsylvania, a 1977 Windsor Mobile Home being VIN Z~70146659,
pursuant to the terms and conditions as set forth in a certain
Manufactured Retail Installment Contract and Security Agreement
(hereinafter referred to as "Contract") a copy of which is attached
hereto, made a part hereof and designated Exhibit "A".
4. The 1977 Mobile Home purchased is currently located at 20
Marilyn Drive, Carlisle, PA 17013.
5. Pursuant to said "Contract", Exhibit "A", Richard and
Teresa assumed the unpaid balance of the obligation which included
an annual interest rate of 13.75\ per annum in 84 consecutive
monthly installments of $159.42 commencing on February 1, 1992.
6. Pursuant to said "Contract", Exhibit "A", Seller, Royal
Finace of PA., Inc., retained a security interest in said Liberty
Mobile Home.
7. The "Contract", Exhibit "A", was assigned by the Seller,
Royal Finance of PA., Inc., to Green Tree. Said Assignment is
noted on the "Contract", Exhibit "A", attached hereto and made a
part hereof.
8. Pursuant to said Assignment, Green Tree further secured
it's lien on the Mobile Home by noting same on the Certificate of
Title. A copy of said Certificate of Title is attached hereto,
made a part hereof and designated as Exhibit "B".
9. Richard and Teresa currently in default of the provisions
of the "Contract", Exhibit "A", having inter alia failed to make
the agreen upon monthly payments of $159.42 which currently
includes insurance placed and being paid for by the Plaintiff, and
being currently past due for November and December 1993 and January
and February 1994.
10. Despite repeated requests by Green Tree, Richard and
Teresa have failed and refused to make any payments since December
31, 1993 in the amount of $180.22 and further Richard and Teresa
continue to maintain wrongful possession of the 1977 Windsor Mobile
Home.
11. The total balance required to bring the "Contract",
Exhibit "A", current as of March 1, 1994, is the sum of $720.88 and
the total balance due and owing as of said date pursuant to said
"Contract" is currently the sum of $7,735,60.
12. Pursuant to the terms and provisions of the "Contract",
Exhibit "A", Plaintiff is entitled to immediate possession of said
1977 Windsor Mobile Home.
13. On or about October 30, 1993, pursuant to the
mandates of the Pennsylvania Motor Vehicle Sales Finance Act of
1947, 69 P.S. Section 601 et. seq., Green Tree delivered to Richard
and Teresa Matthews a Notice of Intention to Accelerate, Commence
Legal Action or Repossess, said Notice being sent to Defendant in
advance of 30 days commencing this action. Copies of said Notice
88888is attached hereto, made a part hereof, and designated Exhibit
"C".
14, Green Tree is entitled to detention damages, special
damages, consisting of inter alia, detaching and transporting the
mobile home, shipping fees, and any cost for insurance placed on
the mobile home by Green Tree, late charges per the "Contract",
further costs for repossession and sale and attorney's fees and
costs of litigation necessary to obtain possession of the 1977
Windsor Mobile Home.
WHEREFORE, Plaintiff, Green Tree Consumer Discount Company
requests judgment against Defendants to recover the 1977 Windsor
Mobile Home located at 20 Marilyn Drive, Carlisle, PA 17013, plus
detention damages, and special damages consisting of inter alia,
detaching and transporting the mobile home, shipping fees, any
costs for insurance placed on the mobile home by Green Tree, late
charces per the "Contract", and any further costs for repossession
and sale, attorney's fees and costs of litigation in order to
obtain possession of the 1977 Windsor Mobile Home.
COUNT II - DAMAGES
16. Paragraphs 1 through 15 above are hereby incorporated
herein as if fully set forth.
17. This count is brought in the alternative to the relief
sought in Count I.
WHEREFORE, Green Tree Consumer Discount Co. requests judgment
against Defendants in the amount of $7,735.60 with interest and
late charges and special damages consisting of inter alia,
detaching and transporting the mobile home, shipping fees and any
costs for insurance placed on the mobile home by Green Tree, late
charges per the "Contract", any further costs of litigation in
order to obtain possession of the 1977 Windsor Mobile Home.
