PETITION TO SET ASIDE HEARING SUSPENSION
1.
Petitioner is Robin Lynn Burnhisel of 54 Tabor Road,
Newburg, Cumberland County, Pennsylvania.
2.
Petitioner is a licensed drive in the commonwealth of
Pennsylvania.
3.
On or about February 12, 1994, petitioner received a notice
of suspension.
4.
The underlying case for which the department was held had
been timely appealed to the Court of Common Pleas.
5.
The action by the Department was not warranted since the
matter as appealed.
Wherefore, Petitioner prays your Honorable court, reverse
the decision of the Department.

Dear Motoristl
As a result of your conviction on 12/02/1993 of
violal:ing secl:ion 3345A of the Vehicle Code PASSING A
SCIIOOL DUS on OS/28/1993, 5 points have been assigned to
your record.
As mandated under Section 1535 of the Vehicle Code, a
60 DAY(S) suspension is hereby imposed.
In order to comply with this sanction you are required
to return any current dri ver' s license, learner's permit
and/or temporary driver's license (camera card) in your
possession no later than the effective date listed below.
Failure to comply with this notico shall result in this
Dureau referring this matter to the PennsYlvania State
Police for prosecul:ion under Secl:ion 1571(a)(4) of the
Vehicle Code. If you cannot complY with the requirements
stated above, you must contact the Bureau (See information
below) for further directions on how to receive credit
towards your sanction.
When the department receives your license or
acknowledgoment, it will send you a receipt. If you do not
receive this receipt within 15 days contact the department
immediatelY. Otherwise, you may not be given credit toward
serving this sanction.
Credit will not begin until all driver's license
preduct(s) are recei,ed .in this Dureau.
Effective Date of Suspension 1 03/21/1994, 12101 a.m.
Please see the enclosed application for restoration fee
information.

Your driving privilege will not be restored until you
provide proof to the Department that all motor vehicles
registered in your name are covered by a motor vehicle
liability insurance policy or a program of self insurance
approved by the Department. This insurance information will
only be accepted within 30 days of the the eligibility date
of the restoration of your driving privilege.
You have the right tu appeal to the Court of Common Pleas
of the county of yuur residence within 30 days of the mail
d;>t9 (FEORUARY 14, 1??4) of lhis lIuUell. Sending a copy to
this department of a timely, filed appeal will stay the
department's action pending a final decision by the court.
