MARSHALL, Defendant PROTECTION FROM ABUSE AND CUSTODY AND NOW, TEMPORARY PROTECTIVE ORDER this ~ day of Marchr 1994, upon presentation and consideration of the within Petition, and upon finding that the plaintiff, LISA K. MARSHALL, now residing at 609 North Second Street, Wormleysburg, Cumberland County, Pennsylvania, is in immediate and present danger of abuse from the defendant, STEVEN D. MARSHALL, the following Temporary Order is entered. The Protective Order entered September 20, 1993, in Perry County, and registered in Cumberland County under the above- captioned number remains in full force and effect, and is modified to include the following: The defendant is hereby excluded from the residence located at 609 North Second street, Wormleysburg, Cumberland CountYr Pennsylvania. The defendant is hereby notified that if he resides in the plaintiff's domicile contrary to this Order, he may be in indirect criminal contempt which is punishable by a fine not to exceed $1,000.00 and/or by a sentence of up to six months in jail and any other appropriate punishment. Resumption of co-residence on the part of the plaintiff and defendant shall not nullify the provisions of the Court Order directing the ~.",> ~L_".' defendant to refrain from abusing the plaintiff. Temporary custody of JAMESON and CHASE MARSHALL is hereby awarded to the plaintiff, LISA K. MARSHALL. This Temporary protective Order shall remain in effect until case. A hearing shall be held of March, 1994, at /O:....JU.m. a final order is entered in this on this matter on the ~~~y in Courtroom No. I , Cumberland county Courthouse, carlisler Pennsylvania. The East Pennsboro and Wormleysburg Police Departments will be provided with a copy of this Order by attorneys for plaintiff. This Order shall be enforced by any law enforcement agency where a violation occurs by arrest for indirect criminal contempt without warrant upon probable cause that this Order has been violated, whether or not the violation is committed in the presence of the police officer. MARSHALL, by and through her attorney, Joan Carey of Legal Services, Inc., represents the following: 1. The plaintiff, LISA K. MARSHALL, is an adult individual whose permanent address is 609 North Second street, Wormleysburg, Cumberland County, Pennsylvania, 17043. 2. The plaintiff and her children are currently located at an undisclosed location for their protection and to avoid further abuse as is more fully set forth herein. This address will be furnished to the court upon request. 3. The defendant, STEVEN D. MARSHALLr is an adult individual whose permanent address is 609 North Second Street, Wormleysburg, Cumberland County, Pennsylvania, 17043. 4. The plaintiff had gotten a Protection From Abuse Order in Perry County in September 1993, and has since moved to Cumberland county with the defendant where she has recently registered her order. tt. :'~'>f'."t~~:'~ 5. Since December 1993, the defendant abused the plaintiff in violation of the Protective Order, and the plaintiff wishes to modify her current Order to exclude the defendant from the residence, to grant her custody and support, and to extend the Protective Order for one year from the entry of the final order in this case. 6. On or about February 23, 1994, the plaintiff and her two children left their residence at 609 North Second Street, Wormleysburg, Pennsylvania, in order to avoid further abuse. 7. The defendant has violated the Protective Order in ways including, but not limited to the following: a. On or about February 21, 1994, the defendant punched the plaintiff in the head while the plaintiff was holding one of her twins, causing bruising to the plaintiff's eye. The plaintiff made a report with the Wormleysburg Police Department. b. In or around the end of January, 1994, the defendant slapped the plaintiff in the top of her head causing soreness. c. On or about January 7, 1994r the defendant slapped, pushed, grabbed, kicked, and punched the plaintiff about her body, causing bruising and soreness to the plaintiff's arms, face, and buttocks. The plaintiff attempted to leave the residence with her children but the defendant blocked her exit with his body. This incident occurred while the plaintiff held her children. d. In or around the end of December 1993, the defendant grabbed the plaintiff by the neck, choking herr and pushed and shoved her. B. EXCLUSIVE POSSESSION B. The plaintiff asks this Court to exclude the defendant from a residence which is leased in the name of the parties. 9. The plaintiff desires exclusive possession of the residence so as to give the greatest degree of continuity to lives of the children and to allow them to continue their education at their schools and to continue their school and social activities. C. CUSTODY 10. The plaintiff also asks this court to grant custody to her. a. The plaintiff seeks temporary custody of the following children: ~ Present Residence Jameson T. The plaintiff does not know of any person not a party to this action who has physical custody of the children or claims to have custody or visitation rights with respect to the children. e. The plaintiff is employed at Blue Shield and currently receives $848.00 per month. 14. The plaintiff's income is insufficient to provide for the minimal needs of her children until such time as a support order can be obtained by filing at the Domestic Relations Office. 15. The plaintiff has petitioned for support with the Domestic Relations Office. WHEREFORE, the plaintiff requests this court to modify her Protective Order to include exclusive possession, temporary support, to confirm custody in her and to extend her Protective Order to expire one year after the entry of a final Order in this case.
