A true and correct copy of the "Purchase Order" as provided by Aaron Enterprises, Inc. is attached hereto as Exhibit "A." 6. The drilling and blasting work were to be performed in accordance with the specifications provided to the Defendant by plaintiffs and as prepared by L. A true and correct copy of the plans are attached here to as Exhibit "B." 7. plaintiff, Ray J. Dadigan further advised Defendant of the specifications for the contracted work. To wit, the -2- 8. plaintiffs also instructed Defendant not to over drilling and blasting were required to construct a basement nine (9) feet deep. blast. 9. On october 4, 1993, Defendant commenced work by drilling holes 11 feet deep for the placement of dynamite. 10. plaintiff Ray J. Dadigan again asked Defendant to drill and blast only to a depth of nine (9) feet and further questioned Defendant's method of blasting below the bedrock rather than placing the dynamite at the actual location of the bedrock. 11. On October 5, 1~93, Defendant completed loading the drilled holes with dynamite and detonated the charges. 12. The resulting blasts from the dynamite as laid out by Defendant created a crater approximately 16 feet deep. Moreover, the blasting did not demolish the bedrock slabs, but detonated below the bedrock in many locations. -3- t....."- ~'~...',_..". 13. Denied. On the contrary, Defendant was never provided with any written specifications for the job in question. No representative has ever seen the drawing attached to the complaint prior to this complaint being filed. 7. Admitted and denied. Denied that Dadigan "further advised" Defendant of specifications. On the contrary, Mr. Dadigan was not present at the job site on September 30, 1993, despite his promises to Defendant. Mr. Dadigan promised to be at the job site at 9:00 a.m. on september 30, 1993, to provide instructions regarding basement depth. Finally, the Plaintiffs' excavator advised the Defendant to drill nine feet from the top of the ground. The excavator never mentioned the existence of the crawl space area and did not provide written plans or specifications to the Defendant. Mr. Dadigan did not appear on the job site until mid-way through the second day of work when he announced that the I i (-. ,..'" :" '~Iil'!.,:.".. 12715.1\AUthoraMF\U.lr'CLG\DltlaM.rch 14, 1994 nine feet should be measured from the string line and not the top of the ground. 8. Denied. On the contrary, Defendant is without knowledge or information sufficient to form a belief as to the truth of said averment. 9. Admitted that Defendant drilled holes eleven feet deep pursuant to the instruction of Dadigan to blast a basement nine feet deep. By way of further answer, it is standard practice for the industry to drill two feet deeper than the desired level in question. lO. Denied. On the contrary, Defendant was asked only to blast to the depth of nine feet. Furthermore, Dadigan did not question the method of blasting. 11. Admitted. 12. Denied. On the contrary, the "crater" was created by three events: a. Dadigan failed to be present at the jOb site as promised to set up an accurate means for the excavator to confirm the required excavation depth. 2 12715.1\AutharoM'\U..roCLG\DltloMlrch 14. 1994 b. The nature of the rock material was sedimentary. As a result, it contained mud and clay seams laying in layers with an angle in a downward position. c. The angle used by the excavator to dig out the rock was such that he tended to pullout large flat slabs. l3. Denied. On the contrary, the work performed by the Defendant was performed in accordance with industry standards and was done properly. Furthermore, said blasting was done in accordance with the only instructions provided to the Defendant by Dadigan. As set forth previously, no project drawings were provided to the Defendant prior to blasting. 14. Denied. On the contrary, the work performed by the Defendant complied with the oral specifications provided by the Defendant from Dadigan. Furthermore, to the extent a problem exists with the depth of the basement, it was due to improper excavation work performed prior to September 29, 1993. 15. Denied. On the contrary, as set forth above, Defendant did not perform any improper work. As a result, Defendant is not responsible for any expenses claimed by the Plaintiff. 16. Denied. Defendant incorporates its answer to paragraphs 1 through 16 as if as set forth at length herein. 18. Denied. On the contrary, Defendants' obligation pursuant to an oral contract between the parties was to blast the bedrock, to the extent possible, to a depth of nine feet in preparation for construction. Defendant did blast in accordance with industry standard. 19. Denied. On the contrary, Plaintiffs set forth a legal conclusion to which no response is required. 20. Denied. On the contrary, Plaintiffs set forth a legal conclusion to which no response is required. By way of further, as set forth above, Defendant performed its obligations under the contract in accordance with industry standards and the limited oral instructions provided by the Plaintiffs. 21. On the contrary, the individuals who performed the work are licensed, competent and qualified individuals for blasting and drilling. c. Denied. On the contrary, Defendant followed the limited oral instructions provided by the Plaintiffs. d. Denied. On the contrary, Defendant employed normal and proper blasting techniques. As set forth previouslY, to the extent there is a problem with the depth of the basement, it was due to over-excavation by the excavator after the blasting and the nature of the rock structure itself. 22. Denied. On the contrary, as more fully set forth in the New Matter and Counterclaim, Plaintiffs have not compensated Defendant for the work properly done by the Defendant. A balance due and owing from the plaintiffs to the Defendant is $4,705.62. Furthermore, to the extent there is a problem with the depth of the basement, it was caused by Plaintiffs' negligent supervision of the excavation work. 23. Denied. On the contrary, Plaintiffs set forth a legal conclusion to which no response is required. By way of further answer, Defendant performed its obligations in accordance with the terms of the oral contract between the parties. As a result, Plaintiffs are not entitled to any damages. By way of further answer, Plaintiffs would have incurred costs for the removal of bedrock and stone from an excavator regardless of whether their claim has any legitimacy or not. Furthermore, Defendant 5 12715,I~Ulh.r""F\U..r.CLG\D.I.aH.rch 14, 1994 believes, and therefore avers, that the remaining claim for damages are unrelated to any actions that may have been taken by the Defendant. Sheely Cumberland County Courthouse Cumberland County Court of Common Pleas 1 Courthouse Square Carlisle, PA l7013 RE: Ray and Andrea Dadigan v. Aaron Enterpris6s, Inc. No. 999 Civil 1994 Dear Judge Sheely: We are writing regarding the Rule to Show Cause issued by your honor in the above-referenced action. As you may recall, Defendant filed a Praecipe For the Appointment of Arbitrators and Plaintiffs filed a Motion to Strike the Praecipe as untimely. Upon receipt of the Rule, the parties have reached an understanding regarding the scheduling of this case for arbitration. Accordingly, at this time your guidance is no longer necessary. It is anticipated that future guidance from this Court will not be necessary to schedule arbitration, however, in the event it is necessary, the parties request that your Honor will intercede. We have enclosed an Order for your signature setting forth this understanding and ask that you sign the Order if it is acceptable to you.
