COMPLAINT
NOW COME Plaintiffs, Andrea L. and Ray J. Dadigan, by
their attorneys, Rhoads & sinon, and file the within Complaint as
follows:
1. plaintiff, Andrea L. Dadigan is an adult individual
with a principal place of residence located at 268 Brindle Road,
Monroe TownShip, Mechanicsburg, Cumberland County, Pennsylvania.
2. Plaintiff, Ray J. Dadigan is an adult individual
with a principal place of residence located at 268 Brindle Road,
Monroe Township, Mechanicsburg, Cumberland County, pennsylvania.
3. Defendant, Aaron Enterprises, Inc. is a pennsylvania
corporation with a principal place of business located at 3361 West
Canal Road, Dover, York county, pennsylvania.
4. plaintiffs are owners of a parcel of land located at
137 Brindle Road, Monroe Township, Mechanicsburg, cumberland
county, pennsylvania.
5. On september 29, 1993, plaintiffs contracted with
Defendant for drilling and blasting work to be performed on their
unimproved land for the construction of a personal residence. A
true and correct copy of the "Purchase Order" as provided by Aaron
Enterprises, Inc. is attached hereto as Exhibit "A."
6. The drilling and blasting work were to be performed
in accordance with the specifications provided to the Defendant by
plaintiffs and as prepared by L. A. collins, 6010 Devonshire
Heights Road, Harrisburg pennsylvania, to remove bedrock so that a
foundation for a residential building could be constructed. A true
and correct copy of the plans are attached here to as Exhibit "B."
7. plaintiff, Ray J. Dadigan further advised Defendant
of the specifications for the contracted work. To wit, the

8. plaintiffs also instructed Defendant not to over
drilling and blasting were required to construct a basement nine
(9) feet deep.

9. On october 4, 1993, Defendant commenced work by
drilling holes 11 feet deep for the placement of dynamite.
10. plaintiff Ray J. Dadigan again asked Defendant to
drill and blast only to a depth of nine (9) feet and further
questioned Defendant's method of blasting below the bedrock rather
than placing the dynamite at the actual location of the bedrock.
11. On October 5, 1~93, Defendant completed loading the
drilled holes with dynamite and detonated the charges.
12. The resulting blasts from the dynamite as laid out
by Defendant created a crater approximately 16 feet deep.
Moreover, the blasting did not demolish the bedrock slabs, but
detonated below the bedrock in many locations.

13. The work performed and the resulting crater did not
comply with industry standards, the project drawings or the
instructions given to Defendant's employees prior to blasting.
14. The work performed and the reSUlting crater did not
comply with the oral specifications provided to the Defendant by
the Plaintiff Ray J. Dadigan.
15. As a result of the improper work, Plaintiffs
incurred considerable expense due to the delay caused by the
repair, and remediation of the building foundation excavation.
16. As a result of the improper blasting, the Plaintiffs
incurred considerable expense in removing bed rock not removed by
Defendant, in back filling the crater created by the Defendant and
in reconstructing the foundation per the specifications.
COUNT I - BREACH OF CONTRACT
17. Plaintiffs incorporate by reference paragraphs 1
through 16 herein as though fully set forth at length.

18. Pursuant to the contract between Plaintiffs and
Defendant, attached hereto as Exhibit "A," Defendant was to drill
and blast bed rock to a depth of nine (9) feet in preparation for
the construction of Plaintiff's personal residence, in accordance
with reasonable standards of care in the industry so as to provide
Plaintiff with a suitable site for the construction of their home.
19. Defendant expressly and impliedly warranted that it
would perform the drilling and blasting work in accordance with the
foregoing specifications of the contract in a good and workmanlike
manner and that its work would conform to a reasonable standard of
care in the industry. The defendant further warranted that its
employees possessed the requisite skill, knowledge, training and
expertise to perform the agreed upon drilling and blasting and
specifically warranted that Defendant would not "over blast".
20. Despite the terms and provisions of the contract,
Defendant performed the same in a poor, careless, negligent and
unworkmanlike manner, contrary to the form and effect of the
subject contract.
21. Defendant materially breached its contract with
Plaintiffs by failing to drill and blast in a workmanlike manner,
so as to insure that the resulting foundation would be in

accordance with the plans and specifications.
specifically,
Defendant breached its contract with Plaintiffs in the following
manner:
a. Failing to drill, blast and remove the bed
rock in a reasonable, competent, proper and workmanlike
manner expected of a contractor in the community and the
construction industry.
b. Failing to hire, employ and secure
competent and qualified persons to perform the actual
drilling and blasting of Plaintiffs' property.
c. Failing to properly follow and abide by
the provisions, plans, drawings and instructions of the
subject contract between Defendant and Plaintiffs in
drilling and blasting Plaintiffs' property.
d. Failing to utilize proper drilling and
blasting techniques in drilling and blasting Plaintiffs'
property resulting in a crater far deeper than required
in the specifications necessitating extensive back
filling of the hole and removal of several loads of bed
rock.

22. Plaintiffs fulfilled all of its Obligations and
responsibilities pursuant to the subject construction contract.
23. As a direct and proximate result of Defendant's
breach of said contract, Plaintiffs incurred significant damages
and losses, as follows:
a. for the crushing and removal of bedrock and stone,
including the rental of a bull dozer, $10, 500.00.
b. for the construction of walls in the crawl space area
not subject to blasting per the plans, $2,000.00.
c. alternative housing necessitated as a result of the
delay caused by the necessary remedial actions, $1200.00.
WHEREFORE, Plaintiffs demands judgment in its favor and
against Defendant for an amount in excess of $10,000.00 inCluding
interest and costs.
COUNT II - NEGUGENCE
24. Plaintiffs incorporates by reference paragraphs 1
through 23 as though fully set forth at length.

25. Defendant, Aaron Enterprises, Incorporated owed a
duty of care to Plaintiffs to perform the work as described in the
contract and further witnessed by the written and oral
specifications in a reasonable, competent proper and unworkmanlike
manner.
26. Defendant breached the duty of care it owed to
Plaintiffs.
27. Plaintiffs' damages and losses are directly and
proximately caused by the negligence, carelessness and recklessness
of the Defendant in the drilling and blasting of Plaintiffs'
property.
28. Defendant Aaron Enterprises, by and through its duly
authorized agents, servants, employees and or personnel, was
negligent, careless, and reckless in each of the following
particulars:
a. Failing to drill, blast and remove the bed
rock in a reasonable, competent, proper and workmanlike
manner expected of a contractor in the community and the
construction industry.

29. As a direct and proximate result of Defendant Aaron
Enterprises negligence, carelessness, and recklessness, Plaintiffs

have suffered extensive damages and losses in an amount as
described above in paragraph 24, in excess of $10,000.00.
WHEREFORE, Plaintiffs demand judgment in its favor and
against Defendant in an amount in excess of $10,000.00 including

Paragraphs 1 through 5 are admitted.

Denied. On the contrary, Defendant was never provided with
any written specifications for the job in question. No
representative has ever seen the drawing attached to the
complaint prior to this complaint being filed.

Admitted and denied. Denied that Dadigan "further advised"
Defendant of specifications. On the contrary, Mr. Dadigan was
not present at the job site on September 30, 1993, despite his
promises to Defendant. Mr. Dadigan promised to be at the job
site at 9:00 a.m. on september 30, 1993, to provide instructions
regarding basement depth. Finally, the Plaintiffs' excavator
advised the Defendant to drill nine feet from the top of the
ground. The excavator never mentioned the existence of the crawl
space area and did not provide written plans or specifications to
the Defendant. Mr. Dadigan did not appear on the job site until
mid-way through the second day of work when he announced that the

nine feet should be measured from the string line and not the top
of the ground.

Denied. On the contrary, Defendant is without knowledge or
information sufficient to form a belief as to the truth of said
averment.

Admitted that Defendant drilled holes eleven feet deep
pursuant to the instruction of Dadigan to blast a basement nine
feet deep. By way of further answer, it is standard practice for
the industry to drill two feet deeper than the desired level in
question.

Denied. On the contrary, Defendant was asked only to blast
to the depth of nine feet. Furthermore, Dadigan did not question
the method of blasting.

Denied. On the contrary, the "crater" was created by three
events:

As a result, it contained mud and clay seams laying in layers
with an angle in a downward position.
c. The angle used by the excavator to dig out the rock

Defendant was performed in accordance with industry standards and
was done properly. Furthermore, said blasting was done in
accordance with the only instructions provided to the Defendant
by Dadigan. As set forth previously, no project drawings were
provided to the Defendant prior to blasting.

Defendant complied with the oral specifications provided by the

Defendant was retained by plaintiffs to perform drilling and
blasting work on a time and material basis.

blasting work in a workmanlike and proper fashion.

The charges for the labor and materials provided by the
Defendant to the Plaintiffs totalled $4,705.62. A copy of
invoices evidencing said charges is marked Exhibit "A", attached
hereto and incorporated by reference herein.

Despite repeated demands, Plaintiffs have failed to pay
Defendant $4,705.62 for any portion thereof.
34.
To the extent Plaintiffs have a legitimate claim, the
existence of which is expressly denied, Defendant is entitled to
a set off in the amount of $4,705.62.

To the extent any depth problems exist in the basement in
question, it was due to improper excavation work done after the
drilling and blasting and the nature of the rock structure

admit the charges on the invoices total $4,705.62. Plaintiffs deny
the invoiced sum is an accurate reflection of what they owe under
the contract. By way of further answer, Plaintiffs contest the
charges because Defendant performed the contracted work in an
improper and unworkmanlike manner.

admit they have failed to pay Defendant but deny any such sum was

MOTION TO STRIKE PETITION
FOR APPOINTMENT OF ARBITRATORS
NOW COME Plaintiffs, Andrea L. Dadigan and Ray J.
Dadigan, by their counsel, Rhoads & Sinon, and file the within
Motion as follows:
1. Plaintiffs, Andrea L. Dadigan and Ray J. Dadigan,
are adult individuals who reside at 137 Brindle Road, Monroe
Township, Mechanicsburg, Cumberland County, Pennsylvania.
2. Defendant, Aaron Enterprises, Inc. is a Pennsylvania
corporation with a principal place of business located at 3361 West
Canal Road, Dover, York County, Pennsylvania.

3. On or about March 1, 1994, Plaintiffs filed this
instant action against Defendant seeking damages incurred as a
result of Defendant's improper drilling and blasting of Plaintiffs'
unimproved property.
4. Defendant filed a counterclaim for the amount
claimed due and owing for the improper work.
5. The pleadings were closed in this action on or about
April 7, 1994.
6. On or about April 7, 1994, Defendants served
Plaintiffs with Interrogatories and a Request for production of
Documents which were duly answered and served on May 6, 1994 by
Plaintiff.
7. On or about April 5, 1994, Plaintiffs served
Interrogatories and a Request for production of Documents upon
Defendants which were answered on or about May 9, 1994.
8. On or about March 30, 1994, the deposition of Jimmie
R. Hamilton, a nonparty witness, was taken by the parties.

9. Since the exchange of discovery requests and the
deposition of the non-party witness, no other discovery has been
pursued by either party.
lO. On April 4, 1995, Defendant's counsel requested
Plaintiffs consent to the appointment of arbitrators to hear
Defendant's counterclaim.
11. On April 13, 1995, Plaintiffs' counsel informed
Defendant's counsel that Plaintiff did not wish to proceed with
arbitration at this time solely on Defendant's counterclaim and
wished to schedule the deposition of Defendants' employees.
12. On or about April 17, 1995,
received notice of Defendant's Petition
Arbitrators.

13. Plaintiffs believe the appointment of arbitrators at
this time is premature as discovery has not been completed.
14. Plaintiffs are in the process of scheduling the
depositions of Vincent Rice, Craig Myers, Randy Eisenhower and
Donald Heckert, employees of Aaron Enterprises, Inc.

15. Plaintiffs believe the appropriate time to schedule
this case for arbitration is upon the conclusion of discovery.
16. Further, Defendants filed a Mechanic's Lien claim
against Plaintiffs' real estate on February 7, 1991 docketed to 571
M.L.D. 1994.
17. On or about February 28, 1994, Plaintiffs filed
Preliminary Objections to Defendant's Mechanic's Lien claim.
18. Plaintiffs' Preliminary Objections have been listed
for the July 5, 1995 session of Argument Court.
19. Plaintiffs believe their Preliminary Objections to
Defendant's Mechanic's Lien claim is dispositive of Defendant's
claim.
21. Accordingly, Plaintiffs believe arbitration of this
action is most appropriate after disposition of Plaintiffs'
Preliminary Objections.
