COMPLAINT
1. Plaintiff Eastern Motor Inns, Inc. is a Pennsylvania
Corporation with its principal business address at 101
Alexander Spring Road, Carlisle, Cumberland County,
Pennsylvania 17013.
2. Plaintiff Eastern Motor Inns, Inc. is the owner of
Days Inn, a motel located at 101 Alexander springs Road,
Carlisle, Pennsylvania 17013.
3. Adams County Asphalt is an unincorporated business
entity with an address of 614 N. Front Street, P.O. Box 1531,
HarriSburg, Dauphin County, Pennsylvania 17105.
4. Richard Levandosky is an adult individual whose last
known address is P.O. Box 185, Charleroi, Washington County,
Pennsylvania 15022.
5. Richard Levandosky was an employee of Adams County
Asphalt for the time period in question, April 26, 1993 through
August 13, 1993.
6. On or about April 26, 1993 through June 4, 1993,
Richard Levandosky stayed at the Days Inn and incurred bills
in the amount of $1,282.96.
Copies of the statements are
attached hereto, incorporated by reference and marked Exhibit
"A".
7. Adams County Asphalt paid $1,282.96 to Days Inn in
payment of the above referenced charges by check no. 20892
dated JUly 8, 1993. A copy of the check stub is attached
hereto, incorporated by reference and marked Exhibit "B".
8. On or about June 14, 1993 through August 13, 1993,
Richard Levandosky stayed at the Days Inn and incurred charges
in the amount of $2,017.18. Copies of the statements are
attached hereto, incorporated by reference and marked Exhibit
"C".
9. After numerous demands for payment, neither Adams
County Asphalt nor Richard Levandosky have paid the amount due
of $2, 017 .18 .
10. It is averred that Richard Levandosky had real and/or
apparent authority to direct that the bills incurred as a
result of his stay at Days Inn be paid on his behalf by Adams
County Asphalt.
11. Days Inn never received notice of revocation by Adams
County Asphalt of the authority of Richard Levandosky regarding
payment of his motel bill from Days Inn.
12. It is averred that in light of the payment by Adams
County Asphalt for charges incurred by Richard Levandosky, it
was reasonable for Days Inn to believe that Adams County
Asphalt would continue to pay charges incurred by Mr.
Levandosky.

THEREFORE, Plaintiff prays this honorable court find
judqment against Defendants, finding them jointly and severally
liable to Plaintiff in the amount of $2,017.18 plus interest
and costs.

AND NOll comes the above-named Defendant, Adams County Asphalt, and files the
following Answer and New Hatter to Plaintiff's Complaint:
1. Admitted.

3. Denied. Adams County Asphalt is a corporation organized and conducting
business under the laws of the Commonwealth of Pennsylvania.
4. Admitted.
5. It is admitted that Levandosky was employed by Adams County Asphalt for some
period in 1993 but denied that that employment continued through 13 August 1993.
6. Denied. Defendant Adams County Asphalt, after reasonable investigation, is
without knowledge as to whether Levandosky stayed at the Days Inn on the dates claimed
because that information is within the exclusive control of the Plaintiff and
Levandosky, both of which are hostile parties to Adams County Asphalt. Adams County
Asphalt denies same and demands proof thereof at trial.
7. Admitted.
8. Denied for the same reasons set forth in Paragraph 6 hereinabove as well as
for the reasons stated in the New Hatter hereinbelow.

any payment to Plaintiff.
10. Denied. Levandosky never had real or apparent authority to incur charges or
debts in the name of Adams County Asphalt.
ll. Admitted. By way of further answer, it is denied that there was any
authority to revoke.
12. Denied. The fact that Adams County Asphalt paid one bill incurred by
Levandosky. whether that bill was paid correctly or incorrectly, does not obligate
Adams County Asphalt to make any further payments to Days Inn on account of
Levandosky's debt.
VHBRBPORB, Adams County Asphalt prays this Court to dismiss Plaintiff's claim
against it.

13. Plaintiff's claim against Adams County Asphalt is barred by the statute of
frauds.
14. Levandosky charged variouB services at the Plaintiff's motel without the
advance knowledge or permission of Adams County Asphalt, including charges for persons
other than Levandosky to board at the motel.
l5. The actions taken by Levandosky in providing lodging for parties other than
himBelf contravened the conditions of his employment by Adams County Asphalt.
I 16. There was never any agreement between Plaintiff and Adams County Asphalt
I whereby Adams County Asphalt was to pay for services charged by or provided to
Levandosky or any other party.

17. No representative of Plaintiff ever contacted Adhms County Asphalt to
ascertain whether it would pay for Levandosky's lodging and other charges.
18. The services provided for Levandosky by Plaintiff did not benefit Adams
County Asphalt, directly or indirectly, in any way.
VRBRBFORB, Defendant prays this Court to dismiss Plaintiff's Complaint and to
enter judgment in favor of Adams County Asphalt in this matter.
CROSS-CLAIM AGAINST RICHARD LBVANDOSIY
AND NOW comes the above-named Defendant, Adams County Asphalt, and makes the
following Cross-Claim against the Defendant, Richard Levandosky:
19. All services provided to LevandoBky by Plaintiff were provided at
Levandosky's request,
20. All services provided to I,evandosky by Plaintiff were provided without the
advance authority or consent of Adams County Asphalt or were provided in contravention
of Levandosky's terms of employment by Adams County Asphalt.
21. Levandosky, by his improper conduct, made himself liable to Plaintiff for all
charges incurred by him.
22. Levandosky, by his conduct in inducing Plaintiff to provide services to him
on the basis that Adams County Asphalt would pay for those services and by inducing
Adams County Asphalt wrongfully to pay for some of those services, became liable to
Adams County Asphalt for all services provided to him by Plaintiff and all funds paid
to Plaintiff by Adams County Asphalt.

23. In the event that Adams County is found to be liable to Plaintiff, Levandosky
owes Adams County Asphalt full indemnity for all amounts Adams County Asphalt must pay
Plaintiff.
WHBRBPORB, Adams County Asphalt demands Judgment against Richard Levandosky in the
amount of $3,300.14, plus interest from and after 31 August 1993, plUS costs of suit,
and further for full indemnity to Adams County Asphalt for any sums awarded to
Plaintiff in the instant litigation.

Inns, Inc. and files the following Answer to Defendant's New

contract in an amount under $500.00.

allegation. Strict proof thereof is demanded at trial.

verbal and written communications with Debra Freeman and Lawrence

willingness of Defendant to pay those bills incurred by
Levandosky.

Manager of Days Inn, made contact with Patricia Patrick of Adams
County Asphalt on numerous occasions regarding the outstanding
balance due on the hotel bill.

Plaintiff were provided to an agent of Defendant, such agency
having been established by prior payments made on his behalf by
Adams County Asphalt and absent any notice of revocation of
agency by the principal.
WHEREFORE, Plaintiff prays this Court dismiss Defendant's
New Matter and enter judgment in favor of Eastern Motor Inns,
Inc. in this matter.
