per annum from November 29, 1993 ($4.08 per diem) together with
attorney's fees in the amount of 5 percent and all costs of
suit, by reason of the failure of the defendants to enter an
appearance or to file an answer within 20 days of the date of
service of the complaint endorsed with a notice to defend.

~MPLAINT
AND NOW, comes Farmers Trust company, through its attorney,
William A. Duncan, Esquire, and files this Complaint in
Mortgage Foreclosure, of which the following is a statement:
1. plaintiff is Farmers Trust Company, a corporation
organized and existing under the laws of the Commonwealth of
pennsylvania with its main office and principal place of
business located at 1 West High street, Carlisle, Cumberland
County, pennsylvania 17013.
2. Defendant, Betty A. Kuykendall, an adult individual,
who resides at 140 Appalachian Drive, Carlisle, Cumberland
County, pennsylvania 17013.
3. On or about June 28, 1988, Defendant made, executed and
delivered to Plaintiff a note and security agreement and a real
estate mortgage financing sixteen Thousand Six Hundred
Ninety-four and 66/100 Dollars ($16,694.66), a copy of said
note and security agreement and said real estate mortgage being
attached hereto as Exhibits "A" and "B", respectively, and are
incorporated herein by reference as though fully set forth.
4. Said note and security agreement and said real estate
mortgage have not been assigned.
5. Betty A. Kuykendall is the sole record owner in fee
simple of said premises subject to said mortgage, by virtue of
a Deed dated and recorded on October 5, 1967, and recorded in
the Cumberland County Recorder's Office in Deed Book "N",
Volume 22, Page 474, more specifically set forth in Exhibit
"C", attached hereto and made a part hereof by reference.
6. Said note and said real estate mortgage are in default
because Defendants herein have failed to pay the payments that
were due and owing for the months of November 10, 1993 to
February 10, 1994.
7. The Plaintiff has given to the Defendants written
notice of intention to foreclose on said mortgage as required
by law under Act 6, dated January 12, 1994, a copy of which is
marked Exhibits "0", "E" and "F", and attached hereto and made
a part hereof by reference.
8. The Plaintiff has given written notice of default as
required by the Homeowner's Emergency Assistance Act of 1983,
dated January 12, 1994, a copy of which is marked Exhibits "G",
"H" and "I", and attached hereto and made a part hereof by
reference.
9. By reason of the aforesaid default, the entire
principal balance of Twelve Thousand Three Hundred Thirty One
and 37/100 ($12,331.37) Dollars, with interest thereon at the
rate of twelve (12.00%) percent per annum computed from
February 28, 1994, accruing insurance premiums, attorney's fees
in the amount of six Hundred Twenty-seven and 00/100 Dollars
($627.00) are now due and payable.
10. The Defendant is liable to the Plaintiff for the
following on said mortgage loan:
A. Principal amount and interest
due through February 28, 1994 $ 12,331.37
B. Interest at 4.08238/day from
02/28/94 to 03/02/94 $ 8.16
C. Late Charges: $ 0.00
D. Attorney's Collection fee: $ 627.00
TOTAL: $ 12,966.53
WHEREFORE, Plaintiff prays the Court to enter judgment in
favor of Plaintiff and to order the foreclosure and sale of the
morgaged property and for the amount of Twelve Thousand Nine
Hundred sixty six and 53/100 Dollars ($12,966.53) together with
interest thereon, costs and all other amounts advanced by
Plaintiff.

verification being authorized to do so, and the facts set forth
in the foregoing Complaint are true and correct to the best of
