PRELIMINARY OBJECTIONS
AND NOW, this 13th day of April, 1994, comes the Attorney
for the Defendant, Robert F. Jordan, and respectfully avers
the following:
PRELIMINARY OBJECTION IN THE FORM OF A
MOTION FOR MORE SPECIFIC PLEADING
1. Plaintiff's Complaint lacks specificity in that in Paragraph
five (5) of said Complaint, Plaintiff alleges "various items
of personal property belonging to Plaintiff were illegally
removed".
2. Paragraph six (6) of Plaintiff's Complaint states, "items
referred to in Paragraph five include, but are not limited
to,.. .11
3. Paragraph seven (7) of Plaintiff I s Complaint states, "some
of the items..."
.
4. Paragraph nine (9) of Plaintiff's Complaint states, "non-
returned property..."
5. Plaintiff's Complaint lacks sufficient specific pleadings
for Defendant to answer said complaint.
6. Plaintiff's Complaint is couched in broad language, and
is not specific and Defendant is unable to file a responsive
pleading based on said broad, general language.
7. Defendant is unable to determine what items the Plaintiff
is alleging that he came into possession of and/or failed to
return.
WHEREFORE, Defendant respectfully requests your Honorable
Court to require the Plaintiff to file a more specific pleading.

AND NOW comes Plaintiff, GEORGB J. DBCKBR, JR., by and through
his counsel, SMIGEL, ANDERSON , SACKS, and avers as follows:
1. Plaintiff, George J. Decker, Jr., is an adult individual
currently residing at 1511 North 5th street, Harrisburg, Dauphin County,
Pennsylvania.
2. Defendant, Robert F. Jordan, is an adult individual
currently residing at 226 Bosler Avenue, Lemoyne, Cumberland county,
Pennsylvania.
3. On or about April 16, 1993, Plaintiff legally parked his
vehicle by or near the residence of Defendant.
4. On or about April 16, 1993, some time after Plaintiff
left his vehicle, Plaintiff's vehicle was broken into.
s. On or about April 16, 1993, various items of personal
property belonging to Plaintiff were illegally removed from Plaintiff's
vehicle.

I. The items referenced in paragraph 5 above include, but
are not limited to, a golf bag, golf clubs and a cassette tape
collection.
7. On or about April 16, 1993, Plaintiff discovered some of
the items stolen from his car on the porch of Defendant's residence.
8. some, but not all, of Plaintiff's personal property was
returned to him.
i. In consideration of the non-returned property, Plaintiff
and Defendant entered an Agreement whereby Defendant promised to pay
Plaintiff One Thousand Dollars ($1,000.00) by July 16, 1993 or make
arrangements with Plaintiff to make payments totalling One Thousand
Dollars ($1,000.00). A true and correct copy of the aforesaid Agreement
is attached hereto as Exhibit "A."
10. The aforementioned Agreement was witnessed and sealed by
a Notary Public.
11. As of the date of the filing of this Complaint, Defendant
has made no payments to Plaintiff.
12. As of the date of the filing of this Complaint, Defendant
has refused, and continues to refuse, to make arrangements with
Plaintiff to make payments in fulfillment of the Agreement.

WHEREFORE, Plaintiff, GEORGB J. DECKBR, JR., respectfully
requests that this Honorable Court enter judgment against Defendant,
