Defendant
COMPLAINT
AND NOW comes the Plaintiff, by and through its
attorneys, Friedman and Friedman, P.C., and brings this cause of
action against the Defendant, and avers as follows:
1. The Plaintiff is JohnstonlSpectra Laboratories, a
Pennsylvania Corporation in good standing with a business address
of 4705 E. Trind1e Road, Mechanicsburg, Cumberland County, PA
17055.
2. The Defendant is Datom Products, a Pennsylvania
Corporation in good standing with a business address of 452 E.
Drinker street, Dunmore, Lackawanna County, PA 18512.
3. On or about November 14, 1992, the Defendant, by
and through its duly authorized agent, Mr. Thomas Jimmie,
requested that the Plaintiff provide services to the Defendant in
the nature of 11 testings for contamination of soil by petroleum
hydrocarbon.
4. An oral agreement was entered into between the
parties providing for 11 separate testings to be provided by the
Plaintiff in exchange for payment on the part of the Defendant in
the amount of $120.00 per test,
5. The charge of $120.00 per test is a usual and
customary charge in the industry and was agreed to by the
Defendant.
6. On or about November 19, 1992, samples were
provided by the Defendant to the Plaintiff, for testing by the
Plaintiff.
7. The Plaintiff did perform the services agreed to,
and a written report was generated on November 30, 1992 by the
Plaintiff and was provided to the Defendant. A copy of this
written report is attached hereto and marked as Exhibit "A".
8. The Plaintiff performed the agreed-to testing in a
good and workmanlike manner.
9. Despite demands, the Defendant refused to pay the
Plaintiff for the services as agreed to, and does continue to
refuse to pay for said services.
10. The Plaintiff charges a service charge of 1.5\ per
month for unpaid balances, which is a service charge that is
usual and customary in the industry.
11. The Defendant was given notice of the Plaintiff's
service charge by way of invoice provided to the Defendant, A
copy of the invoice is attached hereto and marked as Exhibit "B".
The Defendant has likewise refused to pay said service charge,
WHEREFORE, the Plaintiff requests that this Honorable Court
grant judgment in its favor in the sum of $1,320.00 with interest
thereon from the 30th day of November, 1992, in the amount of
1.5' per month, plus all other interest and costs of this action
as deemed appropriate by this Honorable Court.
