A pretrial conference was held on Wednesday,
February 28. 1996. before the Honorable George E. Hoffer. Judge,
This is the second pretrial on this case.
Present are Brad W. Williamson, Esquire, on behalf of the
plaintiff and William A, Addams. Esquire. on behalf of the
defendant. By stipulation made today. Defendant Varden Piper
has been released from the case,
Defendant Poorbaugh admits liability, The issue
for the trial judge will be a decision on the limited tort
option at the outset of the trial, Both counsel are directed to
submit a memorandum to the court at the conclusion of the
plaintiff's case.
The case is estimated to take one day to try with
four challenges apiece. Counsel agree thot all other issues
have been covered adequately in the prior pretrial order.

IN RE: PRETRIAL CONFERENCE
A pretrial conference was held in the chambers of
Judge Oler in the above-captioned case on Wednesday, December
27, 1995. Present on behalf of the Plaintiff was Brad R.
Williamson, Esquire. Present on behalf of Defendants was
William A. Addams, Esquire.
This is a negligence action for personal injuries
arising out of a two-car accident on April 1, 1993. The
Plaintiff's car was rear-ended at the bottom of an exit ramp off
Interstate Route 81 in Cumberland County by a car driven by
Defendant Poorbaugh while he was allegedly an agent of Defendant
Piper. Plaintiff sustained no broken bones, but allegedly did
suff~r a herniated disk as a result of the accident.
Defendant Poorbaugh admits liability, but
Defendant Piper does not concede an agency relationship between
himself and Defendant Poorbaugh and, consequently, does not
admit liability. One of the defenses in this case is that
non-economic damages are not recoverable because the limited
tort option had been elected with respect to the automobile
liability insurance policy applicable to this incident and
because Plaintiff's injuries were allegedly not serious.
This will be a jury trial in which each side,
pursuant to agreement of counsel, will have four peremptory
challenges, for a total of eight. It is estimated to be of a

duration of one and a half days.
With respect to medical expenses and lost wages,
Plaintiff has agreed to prove only those expenses and lost wages
which can be recovered in this case under Act 6. These are
estimated to be in the amount of about $750.00 for medical
expenses, and $5784.00 for lost wages (there having been no
insurance coverage for lost wages).
Two or more videotape depositions for use at
trial remain to be taken, and counsel are directed to furnish
copies of transcripts of those depositions, to the extent that
there are any objections contained in them to be ruled upon by
the trial court, at least four days prior to the commencement of
the trial term, with the areas of objections highlighted and
with brief memoranda in support of their respective positions
concerning the objections.
with respect to settlement negotiations,
Defendants at this point are not willing to concede that the
injuries of Plaintiff can be shown to have been serious, and,
for that reason, no offer has been made on the part of
Defendants.

I. FACTS
On April 1, 1993, Plaintiff, John Mancuso, was operating an
, automobile that was at the end of the exit ramp of Exit 17 of 1-81,
Cumberland County, when an automobile then and there being operated
by Defendant, Dean Poorbaugh, and owned by Defendant, Varden Piper,
ran into Plaintiff/s vehicle from behind.
II. CONTENTIONS AS TO LIABILITY
The Defendant failed to properly operate and control his motor
vehicle and struck the Plaintiff from behind.
III. LIST OF REOUESTED STIPULATIONS OF FACT OR AUTHENTICITY
1. Liability;
2. Authenticity of all medical bills, records and reports
and that the medical bills reflect usual and customary
charges; and
3. Authenticity of wage loss documentation.

he made diligent search and inquiry for the within named defendants to
wit: Dean Poorbaugh and Varden Piper, but was unable to locate them
in his bailiwick. He therefore deputized the Sheriff of Westmoreland
County to serve the within Civil Action Complaint and Notice according
to law.
WESTMORELAND COUNTY RETURN: Now, March 24, 1994. at 7:15 o'clock P.M.
served the within Notices and Complaint in Civil Action upon Dean
Poorbaugh at residence, R.D. H 1 Box 221 Scottdale, Westmoreland County
Pennsylvania by handing to him personally a certified copy of the
original Notices and Complaint and made known to him the contents thereof.
So answers: Gary Uhrin Sheriff Westmoreland County.
Now March 31, 1994, after diligent search and inquiry failed to find the
within Varden Piper within my bailiwick. Reason unable to locate Per
