19. Plaintiff avers that she cannot be on par with
Defendant in this litigation unless this Court orders Defendant
to pay Plaintiff's reasonable interim counsel fees, costs and

WHEREFORE, Plaintiff respectfully requests that this
Honorable Court enter an Order directing Defendant to pay
Plaintiff's reasonable interim and final counsel fees, costs and
expenses pursuant to 53702 of the Domestic Relations Code.

20. Plaintiff hereby incorporates Paragraphs 1 through
19 of her complaint as if fully set forth herein.

21. The public policy of the Commonwealth of
Pennsylvania encourages parties to a marital dispute to negotiate
a settlement of their differences.
22. While no settlement has been reached as of the date
of the filing of this Complaint, Plaintiff is willing to negotiate
a fair and reasonable settlement of all matters with Defendant and
is hopeful that Defendant may also be willing to enter into a
marital settlement agreement.
23. To the extent that a written settlement agreement
might be entered into between the parties, Plaintiff desires that
such written agreement be approved by the Court and incorporated in
any divorce decree which may be entered dissolving the marriage
between the parties.
WHEREFORE, if a written settlement agreement is reached
between the parties prior to the time of hearings, Defendant
respectfully requests that this Honorable Court approve and
incorporate any agreement in the Final Divorce Decree.

The Petition of JO-ELLEN USIADEK respectfully represents
that:
1. The Petitioner is Jo-Ellen Usiadek, Plaintiff in the
above divorce action.
2. Respondent is Thomas J. Usiadek, Defendant in the
above divorce action.
3. The Complaint in Divorce was filed on March 14, 1994
and inter .!!l.!s!. requested Alimony Pendente Lite (Count IV) and
Interim Fees and Costs (Count V).
4. The parties have been unable to reach a settlement
in this case and Plaintiff now must proceed with litigation to
protect her rights under the Domestic Relations Code.

5. Petitioner believes, and therefore avers, that
Defendant's annual income is in excess of Eighty Thousand
($80,000.00) Dollars; Plaintiff's annual income is under Thirty
Thousand ($30,000.00) Dollars.
6. Plaintiff seeks alimony pendente lite to be on par
with Defendant during these continued proceedings.
7. Plaintiff has employed Maxine Kay Lewis, Esquire to
represent her in this matrimonial cause.
8. Plaintiff is unable to pay all the expected counsel
fees, costs and expenses in this action and avers that Defendant is
able to pay same without any hardship or significant effect on his
lifestyle.
9. Plaintiff avers that she cannot be on par with
Defendant in this litigation unless this Court orders Defendant to
pay her Alimoney Pendente Lite and reasonable interim counsel
fees, costs and expenses.
WHEREFORE, Petitioner requests this Honorable Court to

which sum shall be paid through the Domestic Relations Office, P.O. Box 320, Carlisle,
PA 17013. The Defcndant agrees to pay the pro-rated Service Fee of $10.50 ,payable

Office of any change of employment, or change of pcrsonal or employment addrcss in
writing or by personal appearance in the Domestic Relations Office within seven days of
such change. Should a party wilfully fail to inform the Domestic Relations Office of
the required information, the court may adjudge the party to be in contempt of court
pursuant to Rule 1910.21, and may order the party to be punished by one or more of the
following: jail, fine, or probation. If the defendant accumulates arrearages in an
amount equal to at lcast one month's support obligation, the Domestic Relations Office
shall inunediately take steps as provided by law to attach the defendant's income.
