Defendant specifically denies each and every other avennenl of Parabrraph 5 and slrict proof
thereof is demanded at trial. To the contrary, the Defendant avers that all work WIIS perfonned
in a workmanlike manner according to standard practice.
6. Each and every avennent of Paragraph 6 is specifically denied and slrict proof lhereof
is demanded at the time of trial. To the contrary, the Delendant avers that the PlaintifTnever.
prior to the filing of her Complaint, notified Defendant of any defects with regard to items (a)

9. The allegations of paragraphs 1 through 8 of the Complaint
are incorporated herein by reference.
It is denied that prior to
the filing of her Complaint, Plaintiff never notified Defendant of
the defects listed in Sea) through (g) of the Complaint. Defendant
was aware of said defects since at least January 5, 1994, the date
upon which Defendant responded to Plaintiff's letter to him dated
January 3, 1994, regarding said defects.
Moreover, Defendant was
made aware of the defects through verbal communication by Plaintiff,
and through a letter from plaintiff's attorney, dated January l4,
1994.
The aforesaid letter from Plaintiff's counsel contains a
demand for payment in the amount of $l,720.00, and Plaintiff's
letter to Defendant dated January 3, 1994, also contains a demand
for payment in the sum of $1,720.00.
10. Denied as stated.
It is denied that Plaintiff refused to
allow Defendant access to her property for the purpose of completion
of the work and therefore prevented Defendant from painting the
basement ceiling.
It is admitted that Defendant offered to do some
tOUCh-Up painting, and it is admi tted that Plaintiff did not want
the tOUCh-up painting done until the drywall was properly finished.

of the defects set forth in paragraphs 5(a) through (g) of the

basis for her claims. This averment is scandalous and impertinent.

COMPLAINT
AND NOW, comes the plaintiff, Sharon L. Parker, by and through
her attorneys, Cleckner and Fearen, and in support of the within
Complaint, alleges as follows:
1. Plaintiff is Sharon L. Parker, an adult individual who
resides at l24 Pleasant View Terrace, New Cumberland, Pennsylvania
17070.
2. Defendant is Harry G. Minnick, Jr., an adult individual
who is engaged in the construction business, and who uses a
business
address
of
5217
Deerfield
Avenue,
Mechanicsburg,
Cumberland County, Pennsylvania 17055.
3. On or about November 14, 1993, Plaintiff and Defendant
executed a written agreement for the remodeling of the basement of
Plaintiff's residence. A true and correct copy of the agreement is
attached hereto, made a part hereof, and labeled Exhibit "A".

4. Plaintiff has fulfilled all of the provisions of the
agreement on her part to be performed, and has paid Defendant the
full contract sum of $4,000.
5. Defendant has performed certain of the work in a poor,
improper and unworkmanlike manner contrary to standard practice, as
follows:
(a) Many sections of casing are cracked:
(b) Many sections of baseboard are cracked:
(c) Closet shelves are not level:
(d) Cloaet doors are not properly hung:
(e) Access door to electrical panel box was not installed
properly:
(f) Garage door was improperly hung:
(g) Drywall was not properly finished: and
(h) Painting of the ceil ings and walls was not completed.
6. The Defendant has failed and refused to remedy the items
as listed in number 5 (a) through (f) above, and has, in effect,
failed and refused to remedy item numbers 5(g) and 5(h), all
despite Plaintiff's repeated demand.
7. The reasonable cost of remedying the aforesaid conditions
is $l, 720.
8. Despi te demand, Defendant has failed and refused to pay
Plaintiff the sum of $1,720.

WHEREFORE, Plaintiff demands judgment against Defendant in the
amount of $l,720, together with costs and interest.
