STIPULATION
AND NOW, this '1 O-rL day of 1}{lJ , 1994, come the Plaintiff, James Twigg tla Stough's
Mobile Home Park, and the Defendant, Donald Murla\t, Sr., and enter the Stipulation agreeing to the following terms:
BACKGROUND
WHEREAS, on June 24, 1989, the Plaintiff leased Ihe premises at 219 Marle\te Drive, Mechanicsburg,
Pennsylvania (hereinafter "leased premises") to the Defendant, Donald Murla\t, Sr., under a mobile home site lease
agreement; and
WHEREAS, the Defendant allegedly defaulted under the lease agreement by failing to pay the rental payments
when due and to conform to other terms and conditions under said agreement; and
WHEREAS, Plaintiff filed a Confession of Judgment Complaint against the Defendant, Donald Murla\t, Sr.,
for possession of the leased premises and an award of monetary damages in the amount of One Thousand Two Hundred
Thirty Dollars and Fifty Cents ($1,230.50), as authorized in the lease agreement; and
WHEREAS, it is the desire and Intention of the parties to setlle this matler without the necessity of having
to go through a hearing before the Court:

For and In consideration of the mutual covenants conlained herein, and to se\tle the Issues set forth to the above
docket number, the parties agree that a Court Order shall be entered a.~ follows:
I. Defendant, Donald Murla\t, Sr., shall remove himself and all personal property from the leased
premises located at219 Marle\te Drive, Mechanlcsburg, Cumberland County, Pennsylvania 17055 on or before April
30, 1994.
2. Defendant shall have the right to remain at the leased premises through to and including April 30,
1994. No further rent payment shall be required from the Defendant provided he complies with the terms of this
sllpulatlon. In the event the Defendant has not removed himself and/or all personal property from said leased premises,
the Plaintiff may immediately direct the Sheriff of Cumberland County tooblain possession. Defendant hereby waives
all rights under the Pennsylvania Mobile Home Act and the Pennsylvania LandlordlTenant Act or any other law which
may be applicable for a stay or waiting period for Plaintiff toohtain possession after April 30, 1994.
3. In exchange for the Defendant vacating the lea.~ed premises, the Plaintiff shall withdraw and lift the
confessed judgment entered against the Defendant for possession of the leased premises located at 219 Marlette Drive,
Mechanicsburg, Cumberland County, Pennsylvania 17055 and the confessed judgment for monetary damages in the
amount of $1,230.50.
4. Defendant can sell, remove or convey the mobile home or any part thereof located at 219 Marletle
Drive, Mechanicsburg, Cumberland County, Pennsylvania 17055 and retain all proceeds therefrom until and including
April 30, 1994, unless Defendant pays Plaintiff $235.00 for May 1994 rent on or before April 30, 1994, in which case
Defendant will be permi\ted to keep the mobile home at the leased premises and retain all proceeds therefrom until and
including May 31,1994. After April 30, 1994, if Defendant does not pay the May 1994 rent, or after May 31, 1994,
if he pays this rent, the mobile home and all contents therein shall become the property of the Plaintiff which can be
disposed of by Plaintiff free and clear of any claim by the Defendant. In the event that any documentation must be
signed by Plaintiff and/or Defendant to convey free and clear titl~ or to execute a bill of sale for said property in any
third party, the Plaintiff and/or Defendant agree to cooperate and sign or relea.~e all documents within five (5) days
upon wri\ten request of their respective attorneys.

S. In the event the purchaser of the mobile home located at 219 Marlette Drive, Mechanicsburg,
Cumberland County, Pennsylvania 17055 desires to keep the mohile home In Its present location, Defendant agrees
that prior to the sale, the Plaintiff shall have the right to require the purchaser to complete an application and go
through the same application and approval process as would any other potential renter in the mobile home park.
6. Donald Murlatt, Sr. hereby waives the right to appeal this order and hereby agrees that any court to
which an appeal is filed shall upon motion of the Plaintiff strike said appeal, ex parte,
7. The parties hereto agree that this stipuiation shall be entered as a court order by the Cumberland
County Court of Common Pleas and shall constitute a full and complete settlement and release of any and all claims
of James Twigg tla Stough's Mobile Home Park against Donald Murlatt, Sr. arising out of his tenancy of the leased
premises and as alleged in the confession complaint filed to the above docket number. Defendant, Donald Murlatt,
Sr, hereby releases Plaintiff from any and all claims he may have arising out of his tenancy of the leased premises at
the Plaintiff's mobile home park and pursuant to the lease agreement dated June 24, 1989.
IN WITNESS WHEREOF, Intending to be legally bound, the undersigned hereby set their hands and seals

AND NOW, comes the Plaintiff by and through his undersigned attorneys, Johnson, Duffie, Stewart &
Weidner, and avers In support of his complaint as follows:
I. The Plaintiff, James Twigg, is the owner of Stough's Mobile Home Park, an entity doing business in
the Commonwealth of Pennsylvania having an office or principal place of business at 64-A Detroit Avenue,
Mechanlcsburg, Cumberland County, Pennsylvania 17055.
2. The Defendant, Donald Murlatt, Sr.. is an adult individual residing at 219 Marle\te Drive,
Mechanicsburg, Cumberland County, Pennsylvania 17055.
3. On or about June 24, 1989, Plaintiff leased the premises at 219 Marlette Drive, Mechanicsburg,
Cumberland County, Pennsylvania, to the Defendant, Donald Murlatt, Sr., under a mobile home site lease agreement,
a true and correct copy of which is a\tached hereto, incorporated herein by reference and marked as Exhibit" A."
4. Jerry Simpson Is the manger of Stnugh's Muhile Home Park and an authorized agent for the Plaintiff.
5. Said lease agreement has not been assigned by the Plaintiff. The lease agreement requires the
Defendant to pay unto Plaintiff a monthly rental of $185.00 payahle in advance on the first day of each month.

6. In 1994, the Defendant's monthly rental was Increa.~ed to $235.00 payable In advance on the first day
of each month.
7. The Stough's Mobile Home Park rules and regulations provided to the Defendant by the Plaintiff and
made part of the lease agreement by Paragraph 20, provides that any rents n~t received by the fifth day of each month
will receive a late charge of $25.00 per each month. A true and correct copy of the park ruies and regulations are
attached hereto, incorporated herein by reference and marked as Exhibit "B."
COUNT I . Possession
8. Paragraphs I through 7 inclusive are incorporated herein by reference as though the same were more
fully set forth at length herein.
9. The lease authorizes the Defendant, Donald Murlatt, Sr., and Rebecca Lawyer to be an occupant. The
other authorized occupants "Ty" and "Don, Jr." are believed to be minor children of the Defendant.
10. As of May 24, 1990, Rebecca Lawyer no longer resided with the Defendant at219 Marlette Avenue,
Mechanicsburg, Cumberland County, Pennsylvania,
II. The Defendant remains in possession of the leased premises, despite his failure to pay the monthly
rental and late fees accumulating against him,
12. The Defendant has been notified in writing that he is in default under the terms of the lease agreement,
and that unless he cures the default, legal action will be instituted to obtain possession of the premises. A true and
correct copy of a default notice is attached hereto, incorporated herein hy reference and marked as Exhibit "e,"
13. As a result of the Defendant's default and failure 10 pay the monthly rental and late fees, the Plaintiff
is exercising his right under the lea.~e agreement to confess judgment in ejectmenllor possession of the premises located
at 219 Marle\te Avenue, Mechanicsburg, Cumberland County, Pennsylvania 17055.

WIIEREFORE, PlaIntiff reque~ts this Honorable Court enter judgment in ejectment In favor of Plaintiff and
against Defendant, Donald Murlalt, Sr., for possession of the premises located at 219 Marle\te Avenue,
Mechanlcsburg, Cumberland County, Pennsylvania 17055, as authorized In the warrant of attorney In the Lease
Agreement.
COUNT II . Monetury Damages
14. Paragraphs I through 13 Inclusive are Incorporated herein by reference as though the same were more
fully set forth at length herein.
IS. Despite repeated demands, the Defendant has failed to tender the full rental payment or to make
payment on the back rent and late fees owing a.~ required under the terms of the lease agreement. See default notice
altached as Exhibit "C."
16. As a result of the Defendant's failure to make the timely monthly rental payments, there Is due and
owing to the Plaintiff from the Defendant, the sum of$I,070.oo for back rent and late fees under the terms of the lease
agreement. A breakdown of the rent delinquency is attached hereto, incorporated herein by reference and marked as
Exhibit "D."
17. Under the terms of the lease agreement, specilicaUy Paragraph 17, the Defendant is obligated to pay
to the Plaintiff the expenses of collection, including attorneys fees of 15 percent of the amount duly owing.
18. There is justly due and owing to the Plaintiff from the Defendant on account of the aforesaid breach
of the lease agreement, the sum of One Thousand Two Hundred Thirty Dollars and Fifty Cents ($1,230.50), calculated
as follows:

Hundred Thirty Dollars and Fifty Cents ($ 1,230.50), as authorized In the warrant of attorney In the Lease Aareement.
