Diehl, his wife, adult Individuals residing at 401 Myers Road, Boiling Springs, Cumberland County, Pennsylvania 17007. 2. Defendants are Chesler M. Teals and Melody A. Teats, his wife, adult Individuals residing at 123 Oak Flat Road, Newville, Cumberland County, Pennsylvania 17241. 3. Said Exhibit "A" shows Donald E. Diehl and Suzanne Diehl, his wife, as Sellers, in addition to Plaintiffs; but by an Assignment dated the 15th day of February, 1994 and recorded in 2 .. ; : c:'..pll'rardidollJudl_,... 11Io'11391-27 I ( the Office aforesaid, Donald E. Diehl and Suzanne Diehl, his wife, assigned all their right, title and interest In said Sales Agreement to Plaintiffs. A copy of said Assignment Is attached hereto, made part hereof, and marked exhibit 'B'. 6. There has been no prior exercise of power to confess Judgment on exhibit 'A". 7. Plaintiffs aver that Defendants have defaulted on their obligations as set forth In exhibit "A" in the following Instances: A. Contrary to Paragraph 1 of exhibit "A", Defendants have failed to pay the required monthly Installments of $124.36, due on the thirtieth day of each month, for the months of May, June, July, August, September, October, November and December, 1993; and January, 1994 (In February, 1994, Defendants paid a total of $250.00 to Plaintiffs, which was applied to their obligation); and B. Contrary to Paragraph 3 of exhibit "A", Defendants failed to pay the 1993-1994 Big Spring School District real estate tax due upon said premises, which tax Plaintiffs were required to pay in the total amount of $199.65 plus a $15.00 penalty In order to protect their Interests. 8. Plaintiffs have repeatedly advised Defendants of their default, both orally and In writing, but Defendants have consistently failed and/or refused to cure said default. 9. After diligent research, Plaintiffs believe, and therefore aver, that vacant ground is excluded from the definition of "residential mortgage" under the Act of January 30, 1974, P.L. 13, No. 6 ~101 et seq., and Judgments may therefore be confessed pursuant to exhibit "A" without the requirement of notice pursuant to said statute. 3 c:lwp51lrayollcblljuolclllml"m me' 1123.94.27 10. As a result of Defendants' default hereunder, the amount due to Plaintiffs Is the following: Balance due as of March 15,1994 for principal, Interest and penalty, and after allowing credit for the $250.00 paid by Defendants In February, 1994 - $10,146.59; 1993-1994 School Real Estate Taxes paid by Plaintiffs, Including penalty. $214.65; Attorneys' commission hereinafter set forth; costs of suit, unliquidated. COUNT 1 11. The averments set forth in Paragraphs 1 through 10 above are incorporated herein by reference, as though set forth in their entirety. 12. Pursuant to Paragraph 11 of Exhibit "A", Plaintiffs declare that the entire principal sum remaining unpaid has become due and payable at once, and demand Judgment in their favor in the total amount of $10,879.30, which includes attorneys' fees calculated at the rate of 5% of the balance due to wit: $518.06; and in addition, costs of suit in this action. WHEREFORE, pursuant to the warrant of attorney set forth in said Paragraph 11 of Exhibit "A", Plaintiffs demand and direct the entry of Judgment by confession in their favor and against Defendants.
