Doris Cashman. Defendant alleges that claimant's condition has improved since the work injury of March 30, 1973 and that there is work available to her within her physical capabilities which pays wages equal to or greater than her pre-injury wages, Claimant filed a timely answer denying the material allegations, Supersedeas was requested and, after a hearing, was denied by Referee Knighton by decision dated February 7, 1992, The case was heard by Referee Knighton and was transferred to Referee Niven for decision on March 15, 1993, FINDINGS OF FACTI 1, Claimant incurred a compensable injury on March 30, 1973, for which she was paid compensation at the rate of $76,14 per week from April 2, 1973 to January 22, 1974, 2, Claimant returned to work for defendant at her previous occupation as a school bus driver from January 22, 1974 to July 28, 1975, 3, Claimant again became totally disabled on July 28, 1975 as a result of her compensable injury and defendant reinstated compensation as of that date at the above rate of $76,14 per week, Claimant has not worked since that date, 4, Claimant was required to undergo surgery on september 19, 1975 for removal of a herniated disc at L4-5 as a result of the compensation injury, 5, In support of its petition, defendant introduced the testimony of Lance Freeman, Director of Personnel and Equal Opportunity for defendant (N,T, p, 6), 6, Mr, Freeman stated that he used restrictions set forth by Dr, Yarus and offered claimant a position as a bus monitor in the transportation department (Id, p, .9), 7, Mr, Freeman stated that the position was available, that it paid greater than claimant's pre-injury wage and that claimant was asked to return to work september 9, 1991, Mr, Freeman stated that claimant called in and stated that she was unable to perform the work (N,T, pp, 11-13), '10' Cashman Ii 00-24-0549 ,/J 4 ,FIlmINGS OF FACT (Continued) 8. Henry Knouse, Benefits Accountant for defendant, confirmed that the job offered paid in excess of claimant's pre-injury wage (N.T. pp, 17-18) , 9, Vincent Milliner, route coordinator for the transportation department of the defendant, also testified on behalf of the defendant, Mr, Milliner identified Defendant's Exhibit 2, job description for the bus monitor position, Mr, Milliner also identified Defendant's Exhibit 3 which was a videotape of the bus monitor position (N,T, pp, 19-21, p, 24), 10, Defendant's Exhibit 2 included qualifications such as obtaining a certification as a school bus driver within 90 days of employment which defendant said it would waive (N,T, p. 40). The responsibilities included riding an assigned bus to and from schools, assisting in maintaining order on the bus, getting off the bus and assisting children in crossing streets and assisting the driver in maintaining a clean bus, The hours were 6,5 per day, but were distributed three hours from 6:30 a,m, to 9:30 a,m. and then 1:30 p,m, to 5:00 p,m, (N,T, p, 30), 11, Mr, Milliner stated that the bus monitor position involves a fair amount of step climbing (N,T, p, 24). 12, Defendant also introduced the testimony via deposition of Dr, Lance 0, Yarus, an orthopedic surgeon, who saw the claimant on February 27, 1991 on behalf of the defendant, 13, Dr, Yarus stated that, based on the history and physical exam and a review of medical records, his "diagnosis" was that claimant was capable of employment with the following restrictions; standing and walking, one to four hours; sitting, one to three; driving, one to three; and occasionally restricting the bending, squatting and climbing (Yarus Dep, pp. 13-16), 14, Dr, Yarus stated that he reviewed the bus monitor job description and that, in his opinion. the claimant was capable of performing it (Id, p, 16), 15, Dr, Yarus admitted that the EMG'examlnation revealed signs of acute de-innervation and chronic re-innervation of L5 and S1 radiculo- pathy bilaterally (Id. p, 18). 16, Claimant stated that at the time of the work injury .in 1975 she had pain in the lower back, tailbone area and the legs, and continues to have pain in the back and numbness in the legs and feet (N,T, pp, 44, 49), 17, Claimant stated that she can't lift, bend or climb steps (Id. p. 52) , . Aashman 1~0-24-0549 FIlmINGS OF FACT (Continued) 18, Claimant stated that she was not capable of performing the bus monitor position because she couldn't manage the steps and that when she has climbed steps, she has to take pain pills (N.T. pp. 53, 56), 19, Claimant stated that she resides in a one-story house (Id, p. 54). 20, Claimant stated that she can sit and stand for 10 to 20 minutes at a time and then must change position (N,T, p, 57), 21, Dr, Douglas Sanderson, an orthopedic surgeon, testified via deposition on behalf of claimant, Dr, Sanderson has been claimant's treating physician for her back since 1975 (Sanderson Dep, p, 4), 22. Dr, Sanderson stated that with a reasonable degree of medical certainty, that claimant's diagnosis is multiple areas of chronic muscle strain and associated upper and lower extremity neuropathy (Id, p, 13), 23, Dr, Sanderson advised claimant to observe the following restrictions: 15 lb, weight limit, that she sit as much as possible only in arm chairs, that she avoid continuous periods of sitting greater than 10 minutes, that she avoid continuous periods of standing or walking for 10 minutes without a three minute rest period, that she minimize as much as possible use of stairs and inclines (Id, pp, 14-15), 24, Dr, Sanderson stated that claimant's current medical condition is a result of the work injury (Id,), 25, Dr, Sanderson stated that he had reviewed the bus monitor job description and that, with a reasonable degree of medical certainty, claimant is not physically able to do the job successfully and that he would recommend against it (Id, p, 17), 26, Dr, Sanderson also stated that climbing steps will aggravate claimant's problems (Id, p, 28), 27, The testimony of the claimant is accepted as credible, 28, The testimony of Dr, Sanderson is more persuasive than that of Dr. Varus, 29, Claimant is not physically capable of performing the job offered by defendant, 30, Claimant's counsel submitted a fee agreement providing for a single payment of $1,000,00, , . /cashman '200-24-0549 , 1 6 FIRDINGS OF FACT (Continued) 31, Claimant incurred $630.55 in costs in prosecuting the case.
