14. Plaintiff adopts and inoorporates herein by reterenoe
ther.to Paragraphs 1 through 13, inolusivA, of Plaintitt'.
complaint.
15. Admitted, except that the charge for the damage waiver
is an amount equal to ten (10%) per centum of the total equip-
ment rental, not $33.00 per day.
16. No response is required to the averments ot Paragraph
16, for the reason that the damage waiver clause speaks tor
itself. By of further answer and response, Plaintiff believes
and th~refore avers that Paragraph C and Paragrmph I under the
damage waiver clause obligate Defendants to pay for the damages
they caused to the equipment.
17. Admitted as to the previous rental on July 10-12,
1993. specifically denied that there were no claims ot damage
to the equipment. On the contrary, Defendants returned the
equipment to Plaintiff with a missing tooth, as the result of
which Defondantd wero charged, and they paid, the sum of
approximately $30.00 to replace the missing tooth.
18. Admitted, but Plaintiff believes and therefore avers
that Defendant Miohael Sohrim did not operate the baokhoe
durin9 the July rental.
19. Speoifioally denied that the equipment wae in a worn
and faulty oondition when delivered to Defendante. On the
oontrary, the equipment was only eighteen (18) month. old and
had only 700 hours of use to that point and was in good and
operable oondition.
20. Oenied, for the reasons set forth in Paragraph 19,
above, the averments of which are inoorporated herein and mad.

broke during Defendants' use and operation of the eqUipment,
but that is only normal wear and tear. The linkage was

de.cribed in Paragraph 17, above, included the cost ot the part
and the labor for its installation. The amount itemized for
the missing tooth in Exhibit "B" to Plaintiff's complaint iB
only the cost of the part and does not include the labor for
its installation.
28. The averments of paragraph 28 are specifically denied
for the reasons set for in Paragraph 27, above, the averments
of which are incorporated herein and made a part hereof by
reterence thereto.
WHEREFORE, Plaintiff respectfully request. your Honorable
Court to enter judgment in its favor and against the Defendant.

COMPLAINT

Plaintitt herein is A-1 LINCOLN RENT-ALL, INC., a
corporation duly organized and existing undsr the law. ot the
Commonwealth ot Pennsylvania, having an ottioe and place ot
busine.. at ~231 Simpson Ferry Road, Meohaniosburg (Hampden
TownShip), Cumberland County, Pennsylvania.

Defendants herein are MICHAEL SCHRIM alld MARY ANN SCHRIM,
hi. wite, adult individuals who live and reBide at 43 Old
Stonehouse Road, Carlisle (Silver Spring TownShip), Cumberland
County, Pennsylvania, Which premises the Baid DBfendants own a.
tenant. by the entireties.

At all timeB relevant alld material to this cause of action,
Plaintiff has been engaged in the retail sale and rental ot
various good., tools and equipment at the plaoe ot bUBine..
desoribed in Paragraph 1, above.

On or about November 6, J.993, Defendant Miohael schrilll, tor

(Cat 416) at the rate ot $220.00 per day, in accordance with
the term. and condition. a. ..t torth in the Openinq Contract
dated November 6, 1993, a true copy ot which i. attaohed hereto
and made a part hereot, marked Exhibit "A."

Plaintitt believe. and there tore aver. that the .aid
Detendant. rented .aid baokhoe in order to oon.truct
improvement. at the real estate described in Paraqraph 2,
above.

At the special in.tance and request ct Detendants,
Plaintitt delivered the baokhoe to Detendants' premi.e. a.
described in Paraqraph 2, above, on November 6, 1993, at
approximately 2140 O'clock P.H., at which time the said backhoe
was in qood condition and qood workinq order.

The said backhoe was used by the Detendants tor a total ot
twenty-three (23) hours between November 6, 1993, and November
10, 1993.
B.
At the epecial instance and request ot Detendants,
Plaintitt picked up the backhoe at Detendants' premi.e. at the
conclusion ot Detendants' work on November 10, 1993, at
approximately 10128 O'clock A.H.

Upon pioking up the backhoe, Plaintiff'. aqentm and
employeee notioed that the eame wae damaged in the following
re.peotel
a. The eide step and tread had been smaohed,
b. A tooth was mi.eing from the buoket and both .idee ot
the buoket were severely dented I
o. The barr.ls and rods of the left boom oylinder were
bent and were deeply scratohed and gouged.

Plaintiff immediately obtained an estimate for the repair
of the damage to the backhoe as described in Paragraph 9,
above, and Plaintiff issued a statement to Defendant for the
rental of the backhoe and for the cost of repaire, in the total
amount of $3,862.47, a true copy of whioh is attaohed hereto
and made a part hereof, marked Exhibit "B."

In the course of making the repairs as described in
Paragraph 10, above, additional damage to the backhoe was
disoovered, to Witl that the barrels and rods on the right
boom cylinder were also bent, and a tube was crushed, thereby
requiring additional repairs at a total cost of $2,363.32.

Plaintiff believes and therefore avers that the aforesaid
damages to the backhoe were caUsed by Defendants' misuse and

abu.e ot the backhoe by operatinq it in di.reqard ot .tandard
and proper operatinq procedure. and in.truction. qlven by
plaintitt and in breach ot the atore.aid rental contract.

D.epits plaintiff'S demands for payment, Detendants have
retused to pay tor the aforesaid rental or repair ot the
backhoe or any part thereot.
WHEREFORE, plaintiff demands judqment in its ravor and
aqainst the Defendants in the amount of $6,22~.79, toqether
with rea.onable attorney's fees as provided in the contract,
with interest and costs ot suit (inoludinq the oosts of
proceedinq& betore the Distriot:iu tice).
