1. Plaintiffe, ~BITH HARRISON and KRISTINE L. HARRISON, hUlband
and wife, are adult individuale reeidinq at 30 Buttonwood Lane,
Carliele, Pennsylvania.
2. Defendant, SPANKBY'S AUTO SALES, INC., ie a PenneYlvania
Corporation with a principal place of bueineee at 701 Baet Locust
Street, Mechaniceburg, Pennsylvania. (Hereinatter referred to as
Spankey'e Auto.)
3. Defendant, PATRICK CURRY, ie an adult individual employed by
and aotinq as an authorized agent of Spankey'e Auto at ite place
of bUlinese at 701 Eaet Loouet Street, Mechaniceburg,
Pennsylvania.
4. Defendant, FACTORY FINANCE COMPANY, INC., is a penn.ylvania
corporation with a principal plaoe of bueine.s at 701 East Locu.t
street, Meohanio.burg, Penneylvania. (Hereinafter referred to as
Faotory Finanoe.)
COUNT I
Para9rephs one through four are incorporated by reference.
~. In september, 1993, plaintiffe want to spankey's Auto to
inquire about a vehiole to pull their 26 foot camper/ trailer.
6. At the time of their visit to spankey's Auto the plaintiffs
were met by patrick curry.
7. plaintiffs advised Patrick curry of their desire to purcha.e
a vehicle that could pull their 26 foot camper/ trailer.
a. Patrick curry showed the PlaintiffS a 1985 Cheverolet
suburban truok.
9. patrick curry advised tile Plaintiffe that the SUburban truck
could pull their camper/trailer. Patric~ curry further advised
the plaintiffS that the Suburban truck had a 350 engine.
10. plaintiffS, relying on these representationa, entered into an
installment sale contract for the purohase of the suburban truok.
Said contract called for a down payment of $1,1500.00 for the
vehicle, .et a total salea price, including sales tax, tag fee,
title fee, enoumbrance, and notary fee, for the vehicle at
$7,40B.00, and required a credit insurance premium payment of
$15~3.79. A copy of the installment eale contract being attached
a. Exhibit >>A>>.
11. Ae part of the previou.ly desoribed contract, Plaintiffs were
further required to give a security interest in their 1979
International tractor to spankey's Auto. plaintiffS did so by
providing spankey's Auto with the title to their tractor.

13. The previou.ly deecribad contract wae eub.equantly aasignad
by SpankeY'e Auto to Factory Finance.
14. Plaintiff., as a result of their entering into the previouely
deecribed contract have paid to the date of this oomplaint a
total of $a,4el.00 to either spankey's Auto or Factory Finance as
aesignee of the contract.

115. Subaequent to the september, 1993, purchase, Plaintiffe
experienced varioua mechanical difficulties with the SUburban
truok requiring them to return it to Spankey's Auto or affiliated
repair ehope for service.
16. Durinq the course of these repairs PlaintiffS were advieed
for the first time that the Suburban truok had been damaqed and
that its front end was rebuilt. During Plaintifts' final return
tor repairs to the truck in mid~December, 1993, they were adviaed
that it had only a 306 engine and not a 3150 engine as stated by
Patrick Curry.
17. Due to the difference in engine aize the Suburban truck could
not pull Plaintiffa' camper/trailer.
18. Plaintiffa did, in mid~December, 1993, adviae Spankey's Auto
that Plaintiff.s wished to resoind their contract on the baais
that the suburban truck could not fulfill the requirements tor
which it wa. purchased. Plaintitfs r.queated a return of their
money and title to their tractor.
19. Spankey'. Auto refu.ed to rescind the oontract.
20. The .tatement. by Patrick curry described in paraqraph 9 of
this complaint constitute expre.. or implied warrantie. that the
Suburban truck had a certain size engine and would be able to
pull Plaintiff.' oamper/trailer.
21. At the time of the september, 1993, .ale Patrick curry failed
to disclo.e the fact that the suburban truck had been damaqed and
that it. tront end rebuilt.
22. At all relevant time., patrick curry was acting a. an aqent,
employee, and .ervant of Spankey's Auto.
23. Spankey'. Auto knew or .hould have known that Patrick curry
u.ed the sale. tactic. de.cribed in thie complaint. On
information and belief is averred that .uch tactios were used
with the expre.. or implied consent of Spankey'. Auto.
24. plaintiff. are entitled to recind their contract with
Defendant. on the basis of breach of warranty and fraud and to
have their tractor relea.ed a. .eourity.
WHEREFORE, plaintiff. demand judgment against Defendant. in the
amount of $2,4151.00 plus interest and costs of .uit and return of
the title of their International tractor or, in the alternative,
judqment in the additional amount of $3,000.00 plus intere.t.

215. Defendant. knowingly mierepre.ented the engine .ize in the
suburban truck that was the .ubject of the September, 1993,
contract with Plaintiff..

Suburban truck to pUll Plaintiffs camper/trailer.
a7. Defendant. knew or ehould have known that the Suburban truck
wa. damaged and that ite front end wae repaired. Defendant.

purchale the Suburban truok waB done intentionally and with the
knowlldge of the truck's repair history and actual engine Bize
and capacity.
WHEREFORE, Plaintiffs demand judgment not to exceed $215,000.00
againet Defendants which shall include an award of compensatory
damages of $2,4151.00 and return of the title of their Inter-
national tractor or, in the alternative, jUdgment in the
additional amount of $3,000.00 and punitive damaqes together with
interest and counsel fees.

29. The misrepresentations, omissions, and/or concealment ot
faots by Defendants constituted unfair methods of competition and
unfair or deceptive acts or practicel within the meaning ot the
Pennsylvania Untair Trade Practioe. and Consumer proteotion Law
(73 P.S. a01-1 et eeq.) and the Auto IndUstry Trade Practices
Regulation. (37 Pa.Code 301.1 et seq.).
30. Plaintiffl sUffered an alcertainable loss as the result of

additional c~unt to their complaint filed in the above captioned
matter.
COUNT IV
Paragraphe one through thirty are incorporated by reference.
31. subeequent to the September, 1993, purchase, Plaintiffs, a.
a result of experiencing various mechanical difficulties with the
Suburban truck, learned that the truck required repairs to it.
carburetor, and its exhauat sy.tem, and ita braking .yatem and
that it required new ball joints and tie rod end. and a general
overhall of the engine.
32. Defendant. knew or should have known that the SUburban truck
required the repair. etated in paragraph 31. Oefendant. failed
to remedy the defect. requiring theee repair..
~3. In light of the required repair. stated in paragraph 31 the
the suburban truck was not "roadworthy" in acoordance with the
proviaion of the Penn.ylvania Auto Xndu.try Trade practice.
Regulation. (37 Pa. Code 301.1 et seq.).
WHEREFORE, Plaintiffe demand judqment not to exceed $215,000.00
againat Defendant. which shall include an award of compensatory
damage. ot $2,4151.00 and return of the title of their Inter-
national tractor or, in the alternative, judgment in the
additional amount of $3,000.00 and an award in an amount of three
time. the actual damages sustained pursuant to the Penn.ylvania
Unfair Trade Practices and consumer Protection Law together with
interest and counsel fees.

that Curry is an adult individual employed by Spankey's. It is
denied that he is an authorized agent of Spankey's.

that Patrick Curry advised the Plaintiffs that the vehicle had a
350 cubic inch engine. It is denied that he advised the
Plaintiffs it could pull their camper/trailer.
10. Admitted in part and denied in part. It is admitted
that the Plaintiff.s entered into an installment sales contract.
By way of further answer it is stated that the contract, being a
writing, speaks for itself. It is denied that the Plaintiffs
relied upon representations of the Defendants in entering into
the contract.
11. Admitted.
12. Denied. It is denied that the fair market value of the
International tractor is $3,000.
13. Admitted.
14. Denied. After reasonable investigation Defendants are
without knowledge or information sufficiont to form a belief as
to the truth of the avorments and the Bame are therefore denied.
15. Denied. After reasonable investigation Defendants are
without knowledge or information sufficient to form a belief as
to the truth of the averments snd the same are therefore denied.

that the engine is 305 and not 350. It is denied that during the
oourse of the repairs, the Plaintiffs wer.e advised for the first
time that the vehicle had been damaged and that its front end had
been rebuilt ae after reasonable investigation Defendants are
without knowledge or information sufficient to form a belief as
to the truth of the aVerments and the same are therefore denied.
17. Denied. It is denied that due to the differ.Bnce in
engine size tho vehicle could not pull tho Plaintiff's
camper/trailer.
18. Admitted in part and denied in part. It is admitted
that in March of 1994, Plaintiff's counsel advised counsel for
Spankey's Auto that Plaintiffs wished to rescind the contract.
It is denied that in mid-December, 1993, Plaintiffs advised
Spankey's Auto that they wished to rescind their contract on the
basis that the Suburban truck could not fulfill the requirements
for which it was purchased.
19. Admitted with the qualification that the refusal
occurred in March of 1994.
20. Denied. The averments contained in paragraph 20 are
conclusions of law to which no responsive pleading is required.
If a responsive pleading is deemed to be required, it is denied

that the statements of cu~ry constitute express or implied
warranties.
21. Admitted. By way of further answer it is stated that in
September, 1993, Curry did disclose the fact that the vehicle had
been damaged and that its front end had been rebuilt as he did
not know, or have reason to know those facts.
22. Denied. The averments contained in paragraph 22 are
conclusions of law to which no responsive pleading is required.
If a responsive pleading is deemed to be requiI'ed, it is denied
that at all relevant times, Curry was acting as an agent,
employee, and servant of Spankey's.
23. Denied. It is denied that Spankey's knew or should
have known that curry used the sales tactics in the complaint.
By way of lurther answer Curry's actions were not improper or
illegal.
24. Denied. The averments contained in paragraph 24 are
conclusions of law to which no responsive pleading is required.
If a responsive pleading is deemed to be required, it is denied
that Plaintiffs are entitled to rescind their contract and to
have their tractor trailer released as security.
WHEREFORE, Defendants Spankey's Auto sales, Inc., patrick
Curry, and Factory Finance Co. demand that Plaintiffs' complaint

be dismissed with prejudice and the cost~ of this action be
awarded to the Defendants.
COUNT I I
25. Denied. It is denied that the Defendants knowingly
misrepresen.ted the engine size of the vehicle.
26. Denied. It is denied that the Defendants knowingly
represented or misrepresented the ability of the vehicle to pull
Plaintiff's camper/trailer.
27. Admitted in part and denied in part. It is admitted
that the Defendants did not advise the Plaintiffs that the
vehicle had been damaged previously! that its front end had been
repaired and that Defendanta did not apprisQ themselves of these
facts. It is denied that Defendants knew or should have known
that the vehicle was damaged and that its front end was repaired.
28. Denied. It is denied that Defendant's course of
conduct induced Plaintiffs to purchase the vehicle. It is
further denied that Defendants actions were intentional with
knowledge of the vehicle's repair history and engine size.
WHEREFORE, Defendants Spankey's Auto Sales, Inc., Patrick
Curry, and Factory Finance Co. demand that Plaintiffs' complaint
be dismissed with prejudice and the costs of this action be
awarded to the Defendants.

CQVNT III
29. Denied. The averments contained in par.agraph 29 are
conclusions of law to which no responaive pleading is required.
If a responsive pleading is deemed to be required, it is denied
that the actions of the Defendants were violations of the
Pennsylvania Unfair Trade Practices and Consumer Protection Law
and the Auto Industry Tradf' Practices Regulations.
30. Denied. After reasonable investigation Defendants are
without knowledge or information sufficient to form a belief as
to the truth of the averments and the same are therefore denied.
WHEREFORE, Defendants Spankey's Auto Sales, Inc., Patrick
Curry, and Factory Finance Co. demand that Plaintiffs' complaint
be dismissed w~th prejudice and the coats of this action be
awarded to the Defendants.
COUNT IV
31. Denied. After reasonable investigation Defendants are
without knowledge or information sufficient to form a belief as
to the truth of the averments and the same are therefore denied.
32. Denied. It is denied that Defendants failed to remedy
the defects stated in paragraph 31 of Plaintiffs' complnint. It
is further denied that Defendants knew or should have known that
the vehicle required said rRpairs and/or that Defendants were in
fact obligated to make such repairs.

33. Denied. The avermenta contained in paragraph 3J are
conclusions of law to which no responsive pleading is required.
If a responsive pleading is deemed to be r~quired, it is denied
that the vehicle waa not "roadworthy" in accordance with the
provisiona of the Pennsylvania Auto Industry Trade Practices
negulationa.
WHEREFORE, Defendants Spankey's Auto Salea, Inc., Patrick
Curry, and Factory Finance Co. demand that Plaintiffa' complaint
be dismiaaed with prejudice and the costa of this action be
awarded to the Defendants.
NEW MATTER
34. At the time of the purchase, Plaintiffs entered into a
written contract with Spankey'e. A true and correct copy of that
contract was attached to Plaintiffa complaint as Exhibit "A".
35. The written contract atated that the vehicle was sold
"as is" and "without any guarantees".
36. Pursuant to the written contract, Plaintiffs claim
againat the Defendants is barred.
37. Plaintiff Keith Harrison is knowledgeable concerning
motor vehicles, has represented himself to be a automobile
mechanic and has been employed by Spankey's as such.

38. Plaintiff Keith Ha~rison had the requisite skill and
knowledge to determine the size of the engine in the vehiole
which he purchased.
39. Plaintiff Keith Harrison had the requisite skill and
knowledge to determine whether the vehiole had previously been in
an aocident.
40. Plaintiff Keith Harrison had the requisite skill and
knowledge to determine whether the vehicle was capable of pulling
his camper/trailer.
41. Plaintiff Keith Harrison had the requisite skill and
knowledge to determine whether the vehicle had any mechanical
defectlB.
42. Having the knowledge previously stated in pax'agraphs 37
through 41, and having the time and opportunity to adequately
inspect the vehicle, Plaintiffs have waived any claim for
damages.
43. Plaintiffs did not justifiably rely upon any alleged
representations made by Curry and were in a better position to
know the requirements for the vehicle they were purchasing.
44. Plaintiffs purchased the vehicle on September 24, 1993.
45. Plaintiffs aver at paragraph 18 of their complaint that
in mid-Deoember, 1993, they advised Spankey's Auto Sales that
"they wished to rescind their contraot on the basis that the

&uburban truck could not fulfill the requirements for which it
was purchased."
4~. Plaintiffs claim is barred as untimely since they
utilized the vehicle for three months and had the time and
o~portunity to determine whether the vehicle was capable of
pulling their camper/trailer.
47. Plaintiffs claim for rescission is barred, As they
have driven the vehicle for three months, it is no longer in
substantially the same condition as when it was purchased.
48. Plaintiffs have not stated a cause of action pursuant
to the Pennsylvania Unfair Trade Practices and Consumer
Protection Law or the Auto Industry Trade Practices Regulations
as they have not suffered an ascertainable loss
49. Plaintiffs have not stated a cause of action against
Fact.ory Finance.
50. Plaintiffs have not stated a cause of action as the
alleged non-conformities do not substantially impair the use,
value or safety of the vehicle and do not give rise to claims for
rescission or damages.
51. The allegations of Plaintiffs Complaint do not give
rise to the imposition of punitive damages and fail to state a
claim for recovery of punitive damages.
